I invite Legal Insurrection readers to pour an ice cold brew and celebrate "Human Achievement Hour", slated to start today at 8:30 pm local time. The event is promoted by the Competitive Enterprise Institute; its website offers the background on today's festivities:
  • Human Achievement Hour is the counter argument to Earth Hour, which is an event where participants symbolically renounce the environmental impacts of modern technology by turning off their lights for an hour...
  • Symbolically or not, Earth Hour does little to protect the environment and is a misguided effort that completely ignores how modern technology allows societies around the world to develop new and more sustainable practices that help humans be more eco-friendly and better conserve our natural resources.

I have a late entry for the annual “Egregious 8″ tournament, which pits wasteful government programs against each other. It turns out that blogging can be fun and profitable...for those websites on the government dole!
Since Politico, a politics-focused website and newspaper, launched its subscription-based news service Politico Pro in 2011, government agencies have increasingly turned to the service to keep abreast of the latest developments in their spheres of policy. Government records show fiscal year 2011 contracts with the owner of Politico, Capitol News Company, totaling $41,900. By fiscal year 2014, there were no fewer than twenty-eight contracts with sixteen different departments and agencies, including the Executive Office of the President, totaling $431,800. A chart from the USASpending.gov website illustrates the trend (including the first five and a half months of fiscal year 2015) LI #15 Money to Politico The first five and a half months of fiscal 2015 have seen fifteen contracts for $198,188, although at least one agency, the FCC, appears not to have renewed a $50,000 fiscal 2014 contract in 2015.

It looks like the "luck of the Irish" continues today. Last week, I reported the US House of Representatives was poised to vote on H.R. 1030, the Secret Science Reform Act of 2015. The purpose of this legislation is “to prohibit the Environmental Protection Agency from proposing, finalizing, or disseminating regulations or assessments based upon science that is not transparent or reproducible.” The measure passed, along with another one that would put an additional check on the EPA:
The House has passed two Republican-backed bills that would place new restrictions on the Environmental Protection Agency. A bill approved Wednesday would require the EPA to disclose scientific data behind proposed regulations, while a measure passed Tuesday would prohibit the agency from appointing registered lobbyists to the EPA's Science Advisory Board. Both were approved largely along party lines. The scientific data bill was approved 241-175, while the advisory board measure was approved 236-181. Republicans said the bills would increase transparency at the EPA and make it more accountable to the public. "Right now, the EPA is trying to impose harmful regulations based on scientific studies that no one can check — not the public, not independent scientists, not even the United States Congress,' said House Majority Leader Kevin McCarthy, R-Calif. "It's called 'secret science' and it's wrong." If the EPA or any other agency proposes a rule that adds costs to businesses or infringes on private property, "the people have every right to know why," McCarthy said.

The California "mega-drought" has officially gained the attention of the regulatory community. Recently, a NASA administrator pushed the panic button hard... by saying the Golden State had less than a year of water in its reserves and that it needs to start water rationing now!
California will run out of water in 12 months, according to a NASA scientist. The state only has one year of supply left in its reservoirs due to persistent drought and is also running out of backup groundwater, Jay Famiglietti, senior water scientist at the NASA Jet Propulsion Laboratory, wrote. The drought means that total water storage in California, which has been in decline since 2002, has been sapped by the need to use the resource for farming, he said in the Los Angeles Times. ...Famiglietti suggested immediate water-rationing measures, which are being considered in southern California, across the state.
Color me skeptical, in a nice golden brown shade. The last time a NASA scientist chimed in on the climate, it turns out the temperatures used to tout the "hottest year ever" were chalk full of errors. Why should I trust any government scientist's interpretation about climate policy matters when there are money and regulations to be made? In fact, following the money in this instance is the most logical step to take! It turns out that our state's legislators are mulling over water rate hikes.

In the wake of the Ebola Czar stepping down and a presidential commission laying part of the blame for the spread of Ebola on this country, news comes that nearly a dozen Americans are heading home after potential exposure to the deadly virus.
At least 10 US citizens possibly exposed to the deadly Ebola virus were being flown to the US from Africa for observation, the US Centers for Disease Control and Prevention (CDC) said on Saturday. The individuals were set to be transported by non-commercial air transport, on their way to be housed near the University of Nebraska Medical Center, the National Institutes of Health in Maryland, or Emory University Hospital in Atlanta, the CDC said. It said none of the individuals had been identified as having Ebola. A US healthcare worker who tested positive for Ebola while in Sierra Leone arrived at the NIH on Friday and was in serious condition, the NIH said. CDC spokesman Thomas Skinner said 10 people who may have been exposed to the unidentified Ebola patient or who had a similar exposure to the virus as the patient were being flown to the US. But he said the investigation was continuing and there could be more Americans evacuated from Africa. A CDC statement said the individuals would follow the center’s recommended monitoring and movement guidelines during a 21-day incubation period.

I cannot begin to fathom the pain of a mother or father burying a child, especially when their son or daughter is senselessly murdered. There are circumstances surrounding the death of Jamiel Shaw that even compound that horror, especially in light of the very reasonable concerns Americans have about the type of immigrants being encouraged to cross our borders unimpeded. Shaw's father recently testified before Congress about the circumstances of his son's death, at the hands of a DREAM Act beneficiary.
“My son, Jamiel Andre Shaw II, was murdered by a DREAMer, a DACA recipient, a child brought to this country by no fault of his own,” Mr. Shaw told Representative Ron DeSantis (R., Fla.) while testifying before a House Oversight and Government Reform subcommittee panel. Shaw was murdered in 2008, before the Obama created the DACA program in the run up to the 2012 election cycle, but — as a young person brought into the country as a child, Shaw’s eventual murderer would likely have qualified for DACA status. “The illegal alien dreamer that murdered my son only served four months of an eight month sentence for assault with a deadly weapon and battery on a police officer,” Shaw said. “He was released from the county jail the day before he executed my son. Why was this violent illegal alien allowed to walk the streets of America instead of being deported?” “Do black lives really matter or does it matter only if you are shot by a white person or a white policeman?” he added, before alluding to the ‘hands up, don’t shoot’ saying that became popular following the Michael Brown shooting in Ferguson, Mo. “My son was shot in the head by an illegal alien gang banger while he lay on his back with his hands up. he still shot him through his hand into his head and killed him.”

One of the earliest projects I took on as a citizen activist was promoting the work of former UCLA professor, Dr. James Enstrom, an epidemiologist who challenged the voodoo science used by the California Air Resources Board to pass stiff, new air emission regulations. David French of the American Center for Law and Justice (ACLJ) explained what subsequently happened to this heroic whistle-blower:
The facts of the case were astounding. As the environmentalist Left pushed new, job-killing regulations in the interests of “public health,” Dr. Enstrom took his own look at the data and determined that the health threat from diesel emissions was being wildly overstated. As he looked further, he discovered that the lead researcher pushing the new regulations actually possessed a fraudulent degree, purchased from “Thornhill University,” a shady, long-distance diploma mill. Moreover, members of the state’s “scientific review panel” tasked with evaluating the science had in some cases overstayed term limits by decades. At least one was a known ideological radical. (He was a member of the infamous “Chicago Seven.”) Dr. Enstrom did what a scientist should do. He exposed public corruption, called out fake scientific credentials, and worked to save California from onerous and unnecessary regulations. So UCLA fired him. After more than 30 years on the job.

The destruction of treasured world-heritage archeological sites by ISIS continues unchecked. This time, the terror group obliterated Hatra, a city in Northern Iraq that was made famous in the opening sequence of the blockbuster horror film, The Exorcist.
Islamic State of Iraq and Syria (ISIS) militants bulldozed early Saturday the ancient city of Hatra founded 3rd or 2nd BC by the Seleucide Empire, activists and Kurdish media reported. Spokesman for the 14th branch of the Kurdish Democratic Party (KDP) in Ninveh province Saeed Mumuzini told Rudaw news website that “ISIS militants used buldozzers to destroy Hatra city.” “ISIS stole the ancient gold and silver coins, which were used by the Assyrian kings and were stored in the city,” Mumuzini added.
A small sequence from that movie will remind everyone of the stunning ancient masterpiece of architecture Hatra was.

From my point of view, the single best moment of the 2008 election season was Sarah Palin's speech at the Republican Party convention: Palin was so genuine, so impassioned, and so appealing -- despite lacking cherished Beltway connections and credentials -- that she instantly became a target. One of the most ridiculous attacks centered on her personal beauty, and terms such as "naughty librarian" were launched in a nuclear-scale War on One Woman. That Scott Walker has similar appeal is proven by the various attacks already being made, despite the fact that the first caucus vote has not been cast. However, the attack on good looks can't truly be launched against him directly. So, call the latest progressive response "naughty librarian by proxy".

The last time we checked in with the "Duke University Porn Star" Belle Knox, she was complaining about how the disclosure of her new-found adult film career was hurting her sex life. Knox seems to be making a second career out of complaining. She is a featured speaker for Liberty Fest NYC this October, on the high cost of education that she says drove her to her current job.
Belle Knox (Miriam Weeks) made headlines when it was revealed that she is a Duke University student paying for tuition by doing porn. Belle has used her new found fame to have an honest discussion with Americans about the state of college tuition & the federal government’s wasteful spending.
I would have more respect for Knox if she put her expensive education on hold and perhaps learned a trade that would provide her the income necessary to get the degree she wants. I would feel exactly the same way if Knox were male, though it seems the porn industry is one in which women earn substantially more than men. Perhaps the current administration could focus on this particular wage gap?

The last time we checked on California's new rules for issuing driver's licenses to undocumented immigrants, the Department of Motor Vehicles was so overwhelmed with requests for new licenses that it can take up to three months to get an appointment...even for lawful citizens. The new program has been so popular that now over 110,000 illegal immigrants now hold those vital pieces of identification.
California has handed out 110,000 driver's licenses to immigrants in the country illegally during the first seven weeks of applications. The figures for all of January and much of February were released this week by the state's Department of Motor Vehicles. In early January when the law took effect, hundreds of immigrants lined up at designated DMV offices for walk-in appointments. The applicants have to submit documents and take a written test, and later, they must take a road test. They receive licenses that read "not acceptable for official federal purposes" like boarding planes.
Let's take a look at the written test requirements for a moment. I remember studying diligently for several hours before taking my exam several years ago, and being very nervous about getting the correct answers. It is difficult to believe so many immigrants who have not had basic educational opportunities either here or in their native land would pass the exam.

Russia's Vladimir Putin isn't letting the untimely death of an opposition leader distract him from creating Soviet Empire version 2.0. With the Obama Administration suggesting jobs as a solution to ISIS and its brutal ambitions, the Russian leader seems to be forging a key alliance with two countries that are extremely concerned about the terrorist take-over of Libya.
Various unconfirmed reports are emerging indicating that there may be joint international action planned in Libya as early as next week. Egypt is already conducting air strikes against ISIS-linked targets in Derna, close to where Egyptian Coptics were massacred recently, as displayed in a gruesome video. Debka reports that Egypt’s president Abdel al-Fattah al-Sisi is planning further action in Libya, including more air strikes and possible ground troops, within a few days. According to the report, Egyptian commando and marine forces are preparing for sea landings to seize Derna and destroy the terrorist elements there. If this attack is actually launched, it will be the first time in modern times that an Arab country has sent ground forces into another Arab country. Al-Jazeera television reports that the Italian navy is getting ready to carry off sophisticated military drills off the coast of Libya as early as Monday. Although Italy claims that it will be a regular exercise, there are many more vessels taking part in this year’s exercise than have in the past, which Italy explains by saying that they are testing out sophisticated new technologies. ...Some reports indicate that Russia has hinted at a willingness to participate in a naval blockade of Libya to prevent arm supplies from leaving Libya for other countries. Russia could play a role in this because it already has a naval fleet in the Mediterranean.

When it comes to domestic problems, a common joke among my independently minded friends is, "It's all Bush's fault." However, when it comes to problems of a more international scope, the preferred target is the United States. So, when tasked with figuring out what went wrong, the Presidential Commission for the Study of Bioethical Issues blamed America first! Despite the fact that there have been regular flare-ups of Ebola in Africa since 1976, and that there is a United Nations group that is tasked "to improve health, particularly among disadvantaged populations", a recent report lays the blame for the spread of the virus at America's doorstep.
The United States fumbled its response to the Ebola epidemic before it even began, neglecting experiments to make vaccines and drugs against the virus, and cutting funding to key public health agencies, a presidential commission said Thursday. Americans focused on their own almost nonexistent risk of catching Ebola from travelers instead of pressing to help the truly affected nations, the scathing report from the Presidential Commission for the Study of Bioethical Issues says. They've been acting against their own best interest, the commission said in its report. "Both justice and prudence demand that we do our part in combating such devastating outbreaks. Once we recognize our humanitarian obligations and the ability of infectious diseases to travel in our interconnected world, we cannot choose between the ethical and the prudential," it reads. "Ethics and enlightened interest converge in calling for our country to address epidemics at their source."

America has lost one of its most iconic actors. Leonard Nimoy is dead at age 83.
Leonard Nimoy, best known for playing the role of Spock in the "Star Trek" movies and television series has died at age 83, his rep confirmed to FOX411. Nimoy was taken to the hospital earlier this week and treated for lung disease. His son told the Associated Press he died in Los Angeles. The actor wrote on Twitter last month that he suffers from chronic obstructive pulmonary disease, despite quitting smoking 30 years ago. On Sunday, he tweeted: "A life is like a garden. Perfect moments can be had, but not preserved, except in memory. "

Islamic terrorists have destroyed more priceless objects of beauty and incomparable historical value, this time in Mosul.
Islamic State thugs have destroyed a collection of priceless statues and sculptures in Iraq dating back thousands of years. Extremists used sledgehammers and power drills to smash ancient artwork as they rampaged through a museum in the northern city of Mosul. Video footage shows a group of bearded men in the Nineveh Museum using tools to wreck 3,000-year-old statues after pushing them over.
The pieces in the video date to the Assyrian and Akkadian empires. The destruction is being decried by the international community.

About a year ago, the biggest political headache Oregon Governor John Kitzhaber faced was explaining why there wasn't a single enrollee in Covered Oregon ,after spending over $300 Million on the state health insurance exchange. This year, however, Kitzhaber is Oregon's former chief executive after resigning in response to reports indicating his finacee, Clivia Lynne Hayes, advised the governor and state employees on energy policy while getting paid by a group advocating on the issue. In the wake of that resignation, officials have started digging into Kitzhaber's other advisors...including the self-designated "Princess of Darkness", who was tasked with fixing Covered Oregon.
...Kitzhaber handed oversight of the Cover Oregon mess to a secretive campaign consultant who liked to call herself the Princess of Darkness. By her own admission, Patricia McCaig knew virtually nothing about health care reform or the reasons Cover Oregon had crashed. Her primary mission was not to save a beleaguered state program but to get Kitzhaber re-elected. Emails that Kitzhaber’s office tried to delete from state computers show McCaig was effectively in charge of all decision making for Cover Oregon beginning in February 2014.

Researchers now claim global warming predictions are greatly exaggerated. (This is not surprising to those of us climate change skeptics.) What is shocking is that the findings were published in a peer-reviewed journal and are now actually being covered by some media. The UK Daily Mail has a review of the study:
Since 1990, scientists have used complex models to predict how climate change and manmade greenhouse emissions will affect the world. But a team of experts - including an astrophysicist, statistician, and geography professor – has claimed these models ‘very greatly exaggerate’ the effects of global warming. Using a simpler, solar-based model, the researchers arrived at figures that are more than half those previously predicted. The paper, ‘Why models run hot: results from an irreducibly simple climate model’, was written by Lord Christopher Monckton of Brenchley, astrophysicist and geoscientist Willie Soon, Professor of Geography at the University of Delaware David Legates, and statistician Dr Matt Briggs. It has been peer reviewed and is published in the journal Science Bulletin.
Interestingly, one of the scientists who authored the paper has a connection to Cornell. Dr. Matt Briggs, who has a Ph.D. in mathematical statistics from that university, has been the focus of a lot of heat from global warming advocates. He explained the smear campaign to Stephen K. Bannon on Breitbart News Sunday.

After ISIS butchered Egyptian Coptics, members of the terror group threatened Rome and Pope Francis. Subsequently, ISIS unleashed a Twitter campaign: #We_Are_Coming_O_Rome. The Italians counter-attacked with a great deal of humor.
For the government in Italy, the prospect of IS-inspired attacks was cause for real concern. Indeed, the Italian foreign minister said last week that Rome would weigh participating in any military intervention to keep Islamic State forces from advancing in Libya. But while some in Italy fear the risk that terrorists, mingled among boatloads of migrants, could reach Italy from Libya, others have greeted the prospect with humor. They exploited the #We_Are_Coming_O_Rome Twitter hashtag to offer mock travel advice to IS operatives, including warnings about Rome’s terrible traffic congestion and restaurant recommendations.
