A three-judge panel of the D.C. Circuit Court of Appeals has ordered Judge Emmet Sullivan to respond to Michael Flynn's Emergency Petition for a Mandate ordering the district court to dismiss the prosecution against Flynn as the government wants, and removing Sullivan from the case. Sen. Sheldon Whitehouse (D-RI), a member of the Senate Judiciary Committee, reacted by singling out and attacking only one of the three judges on the panel, Neomo Rao. Whitehouse tweeted a Politico article about the panel order with this commentary:

On August 13, 2019, we wrote about an extraordinary Amicus Brief filed by Senator Sheldon Whitehouse (D-RI) on behalf of himself and several other Democrat Senators. The Brief was extraordinary because it threatened the Justices with a potential restructuring of the Court if the Justices didn't dismiss as "moot" the first big 2nd Amendment case the Court has taken in a decade. The Brief was panned by right, left, and center as a thinly-veiled and inappropriate threat.

In August 2019, Rhode Island Senator Sheldon Whitehouse signed and filed an Amicus Brief in the U.S. Supreme Court that threatened the Justices with future court-packing if they didn't vote his way on a 2nd Amendment case. It had been almost a decade since the U.S. Supreme Court took a major 2nd Amendment case, something Justice Clarence Thomas lamented in a dissent from the Court's refusal to hear an appeal from a 9th Circuit decision upholding California's 10-day waiting period even for those who already owned guns legally and had gone through the permitting and background check.

Sheldon Whitehouse, the incumbent Rhode Island Democrat Senator, has been mocked nationally for his bizarre and intense interrogation of Brett Kavanaugh over high school yearbook entries Whitehouse suggested were sexual references. Kavanaugh pushed back, explaining that the term "boofing" meant flatulence, "ralphing" was vomiting, and "Devil's Triangle" was a drinking game. Whitehouse refused to accept Kavanaugh's testimony, even though high school classmates backed up Kavanaugh.

Sheldon Whitehouse is being challenged by former Rhode Island Supreme Court Justice Robert Flanders in the upcoming Senate race. We have been covering the race for months, long before it started to gain national attention. That recent attention is a result of Whitehouse's performance during the Kavanaugh hearings, when he earned national mockery for intensive questioning of Kavanaugh about such things as whether the term "boof" in a high school yearbook referred to a sex act or flatulence.

Democrat Sheldon Whitehouse of Rhode Island has earned national mockery due to his obsession with Brett Kavanaugh's high school yearbook entries, particularly a fart joke entry. Even Saturday Night Live made fun of him. One of Whitehouse's pet theories, that the "Devil's Triangle" reference in Kavanaugh's yearbook entry related to sex acts, not a drinking game, just took a big hit, Kavanaugh classmates back him up, ‘Devil’s Triangle’ was a drinking game at their High School.

Sheldon Whitehouse may have had the worst performance on Day 2 of the Brett Kavanaugh hearings. And that's saying a lot. In a forum filled with Democrat attempts to play gotcha with Kavanaugh, Whitehouse displayed the disdain and contempt for his political opponents that has become his hallmark.
