Inquiry: since Rittenhouse has been acquitted, can he be the target of a civil suit by the families of Huber and Rosenbaum, or by Grosskreutz? I’ve seen conflicting info and could use some second opinions.
Yes. A civil suit is completely different. The standard is something like “substantially caused the death of someone” and the only by a preponderance of the evidence with a majority of the jury. It’s kind of a low bar and finding a favorable jury on a case like this probably wouldn’t be difficult.
But, anyone suing might be opening a can of discovery worms, especially Grosskreutz, that they might prefer to leave closed.
I’m a retired police officer and have some experience with the courts. The answer to your question is, Yes. He can be sued in Civil Court. The problem is that Civil Suits would be filed by Attorneys who would be able to recover 1/3 of the award total as their share. That would mean that the Attorney representing the families would lose money if they didn’t win. With the overwhelming evidence for self defense. The Attorneys would be taking a great gamble. If U was an Attorney who had been asked to represent a family of one of the deceased I would turn it down.
