What I really want to comment on is the behavior of Clancy’s lawyer, Kevin Reddington, and the apparent spinelessness of the trial judge, William Sullivan. Reddington repeatedly attacked the holdout juror in open court and on television, both as the jury was deliberating and after the court had declared a mistrial. While deliberations were still going on, Reddington accused the juror of “lying to the court” and refusing to follow the court’s instructions.

I have never seen anything like this. I tried many jury cases, and I can’t imagine how a trial judge before whom I appeared would have come down on me if I had publicly attacked a particular juror, or group of jurors, as the trial was in progress. It is unheard of. And Judge Sullivan let Reddington get away with it, while, at Reddington’s insistence, holding hearings in open court, in front of television cameras, that should have been conducted privately in chambers. Given this behavior, it is hard to see how the court will be able to find jurors willing to serve in a potential retrial.

Well said. At the end, the trial became a soap opera, making a mockery of the courtroom and jury. Very sad to watch the decline on display. And it’s still not over…

The judge was Ito-esque, runaway trial by his hand. Another circus by practitioners who were reprehensible in behavior, massively unprofessional.

Who would want to be on a jury if a rogue defense attorney can target a juror who isn’t giving him or her what they want? Really bad precedent, and the fault lies with the judge.

Given this behavior, it is hard to see how the court will be able to find jurors willing to serve in a potential retrial.

One of the unwritten rules for prosecuting a crime is the determining the probability of getting a conviction. Its one of the reasons that Hillary clinton was not prosecuted. There is zero possibility of getting juror in NY or DC to vote for conviction.

Its the same in this case. MA is far too woke to get a conviction.

Judge William Sullivan projected little of the authority one expects from the bench in a murder trial of this magnitude. He often appeared hesitant, inarticulate and passive, allowing aggressive defense arguments to draw him into defensive explanations of his own rulings. Rather than cutting through complicated disputes with crisp, authoritative decisions, he sometimes seemed to wrestle publicly with them. The cumulative impression was not of a judge firmly in command of his courtroom, but of one being pulled along by it.

That was just ONE WEEK! When the legal system becomes bad entertainment and a joke…albeit not funny at all. Sad reality of how far off the path society has gotten. Stay vigilant when out and about.
