LIVE Day Three: Barrett Faces More Questions (and Probably Conspiracy Theories) in the Senate

I cannot wait to see what Sen. Whitehouse has in store for Judge Amy Coney Barrett today! It all starts at 9 a.m. ET.

We have Democrats grandstanding, throwing out conspiracy theories, mansplaining Barrett’s cases to her, and asking about hypothetical cases knowing Barrett cannot answer them.

They Still Think She’s Scalia

But She Didn’t Agree With the Chief Justice on ACA!

So that means she must want to overturn it.

Barrett reminded the Senate that she spoke as an academic. She was a Notre Dame professor at the time:

Barrett, then a University of Notre Dame law professor, wrote in a 2017 law review essay, “Chief Justice Roberts pushed the Affordable Care Act beyond its plausible meaning to save the statute. He construed the penalty imposed on those without health insurance as a tax, which permitted him to sustain the statute as a valid exercise of the taxing power.”

She continued, “Had he treated the payment as the statute did —as a penalty —he would have had to invalidate the statute as lying beyond Congress’s commerce power.”

Democrats have argued during the confirmation hearings that Barrett’s criticisms of Roberts’ 2012 ruling to uphold Obamacare, which she made before she was appointed to the federal appeals bench in 2017, were a sign that she would try to overturn it.

Barrett insisted that was not the case, saying she had no agenda when it came to the health care law. “I am not here on a mission to destroy the Affordable Care Act,” she said. “I’m just here to apply the law and adhere to the rule of law.”

Harris Didn’t Do Much

Harris asked Barrett whether she agreed with Chief Justice John Roberts’ writing in the opinion that “voting discrimination still exists, no one doubts that.”

Barrett would not engage on the question, saying it was one that could come before the court.

“Sen. Harris I will not comment on what any justice said in an opinion, whether an opinion is right or wrong, or endorse that proposition,” Barrett said.
When Harris asked her about it a second time, Barrett said, “I think racial discrimination still exists in the United States.”

“I don’t mean to signal I disagree with the statement either, what I mean to say is I’m not going to express an opinion because these are very charged issues, they have been litigated in the courts, and so I will not engage on that question,” Barrett said.

You all know she cannot answer these.

Feinstein and Healthcare

Is this a Barrett hearing or one for the late Justice Scalia? They cannot stop bringing him up because Barrett clerked for him.

But I do not know why it is so hard for these senators to understand that Barrett will not answer questions about hypothetical cases.

Graham Happy With Proceedings

Unlike hearings for Justice Brett Kavanaugh, Barrett’s hearing has gone smoothly:

Sen. Lindsey Graham (R., S.C.) again praises the tone of the hearing so far, which has marked a sharp contrast from the confirmation of Justice Brett Kavanaugh in 2018.

In that hard-fought hearing, the outcome was uncertain, amid sexual-assault allegations that the nominee strenuously denied. Judge Amy Coney Barrett is expected to be confirmed, despite Democrats’ objections to nominating a justice this close to the election.

“I think we’re on track,” Mr. Graham said, to hold the hearings “in a way that hopefully people will say even though you disagree, strongly, you’re not that disagreeable.”

Day Three Setup

Luckily, the senators only have 20 minutes to question Barrett on Wednesday.

Or, in some, cases lecture and rail against Trump.

Judge Barrett demonstrates she is expert at suffering fools. These Dems/Progs are world class idiots, and shows the rest of us how not to treat people.

We really need Senators who don’t consider patting themselves on their institutional back to be a major accomplishment. A little more action and a lot less bullshit would be doing us all a favor.

    When you take into consideration that confirmation hearings really took off in the mid’50s – right when TVs became more and more common in the U.S. household – it becomes clear that they’re really nothing more than congresscritters using them for free campaign advertising.

    Those will be famous last words if he again allows these proceedings to again go off the rails at the last minute. I really, really don’t trust that guy one iota. He has been as big a polymorph as anyone in Congress for his entire career.

      I hope he has learned his lesson with Sotomayor…..that you cannot cross the aisle with the vile democrats and expect favors in return.

    I’ve been known to use that tactic with my kids: praise for small steps in the right direction, especially after calling them out for their egregious behavior.

    He also gave me a shout-out in his opening statement, because I am one of the many people who wrote him and told him that, as far as I am concerned, the Dems come to this hearing with unclean hands, and have no right to be heard, at all.

    Well, at least we haven’t gotten to the dead woman or naked boy stage of the hearing yet

But I do not know why it is so hard for these senators to understand that Barrett will not answer questions about hypothetical cases.

But now they can whine that that dastardly Republican wouldn’t answer their questions.

Durbin has followed Whitehouses lead yesterday, ‘I see conspiracies everywhere.’

If Whitehouse is smart, he will stop with the signs. The giddy kiddies have already made a fool of him over the last one.

Meanwhile, today’s San Diego Union-Tribune has a front-page story with all the huffing and puffing about Barrett’s refusal to commit to ruling one way or another. It’s almost as if they don’t know (or don’t want their readers to know) that this is exactly the way Ruth Bader Ginsberg answered that kind of question.

    Time was, the Union and Tribune were conservative papers.

      The Democrats think the Union-Tribune still is conservative, Republican, even.

      And, its local reporting does attempt to be even-handed. Some of it is very good.

      But their national news is all drawn from the New York Times and the Washington Post. They use the AP, seemingly unaware that its stories derive from the other two.

      They have a severe case of TDS, and it has led them to think, for example, that hydroxychloroquine is poison, which of course has led to the “necessity” in their view, to watch the county like a hawk and re-consider shut-down every week. If they dared acknowledge that we have drug treatments that, administered early, can avoid hospitalization, we could open up today.

When I look at the Democratic senators in the hearing with those wuhu masks on, I imagine them as herd of mules with their feed bags with their heehaw tongues flopping out between huge mule teeth. Big, impotent mules. Amy’s castrating them, y’all know.

Then I laugh. I laugh kind of hard.

Let ’em talk. Any good lawyer knows his opponent will make his case for him if the opponent is allowed to talk enough. Ms. Barrett obviously knows this, too.

Amy Coney Barrett has impeccable credentials, experience and integrity. It’s a shame she needs to endure such BS from the hate filled, vile and completely unprofessional Democrats on the Committee. The Confirmation Hearing process requires a complete overhaul. It’s a disaster.
