Democrats and their media cohorts are scrambling to figure out what to do about Joe Biden's self-inflicted court packing problem. Biden, as we noted yesterday, not only asserted that American voters "don't deserve" to know where he stands on court packing but made the absurd statement that Republicans are "court packing" by lawfully filling an open seat on the Supreme Court.  A move Biden ludicrously claims is "not constitutional."

There have been a series of district court and appeals court decisions (plus a Pennsylvania Supreme Court decision), in which the judiciary substitutes its judgment in place of state legislatures as to voting requirements for absentee and mail-in ballots. Extending ballot deadlines and waiting procedural safeguards have been part of the Democrat push to alter the rules by judicial fiat.

There are multiple reports from media outlets, supposedly confirmed with senior administration officials, that Court of Appeals Judge Amy Coney Barrett will be nominated tomorrow to fill the Supreme Court vacancy created by the death of Ruth Bader Ginsburg. Barrett -- can we call her Notorious ACB? - not only is Trump's choice, she was the overwhelming choice of Legal Insurrection readers.

The response to the loss of Justice Ruth Bader Ginsburg demonstrates once again that the loudest voices who claim to represent Democrats’ interests are shouting from the radical wing, further left than the Rev. Al Sharpton, former President Barack Obama, and even Ginsburg herself.
