Manhattan DA Wants Gag Order on Trump Before ‘Hush Money’ Trial

DA Alvin Bragg: “To protect the integrity of this criminal proceeding and avoid prejudice to the jury, the People respectfully request that this Court issue a narrowly tailored order restricting certain prejudicial extrajudicial statements by defendant.”

Manhattan District Attorney Alvin Bragg requested the court place a gag order on former President Donald Trump before his hush money trial.

“To protect the integrity of this criminal proceeding and avoid prejudice to the jury, the People respectfully request that this Court issue a narrowly tailored order restricting certain prejudicial extrajudicial statements by defendant,” wrote Bragg.

Trump will stand trial for allegedly paying hush money to porn star Stormy Daniels about their supposed affair.

“The legal authority for such an order is well established. And the need for such protection is compelling,” continued Bragg. “Defendant has a long history of making public and inflammatory remarks about the participants in various judicial proceedings against him, including jurors, witnesses, lawyers, and court staff. Those remarks, as well as the inevitable reactions they incite from defendant’s followers and allies, pose a significant and imminent threat to the orderly administration of this criminal proceeding and a substantial likelihood of causing material prejudice.”

Something tells me no one else will be gagged to stop them from denouncing Trump and making inflammatory remarks about him.

Bragg constructed the request similar to the gag order placed on Trump for his Washington election interference case.

The judge in Trump’s civil trial put a gag order on him, but man. No one stopped Attorney General Leticia James from making inflammatory remarks about Trump.

Gag orders bother me unless they are placed on everyone, including the prosecution.

Then again, maybe they’re scared. Perhaps silencing Trump would silence the truth?

DA Alvin Bragg inherited the case when he came into office in 2022 but suspended it. Then, he brought it back when Trump announced his 2024 presidential campaign.

It sure sounds like Trump might have a point about it being political!

You can’t gag mockery.

I agree that a gag order should be applied to both sides. Trump and his legal team would be smart to change tactics and push a counter-motion in such fashion (a la “we see the value of gag orders..they should also be placed on prosecutors and their offices to preserve the integrity of our election process and curb political interference”)

I think withdrawal of the DA’s motion could be a likely result.

On the contrary, I can’t imagine such an order not covering both parties. All the previous orders covered all parties as a matter of course.

Of course no gag order can include nonparties. The other side can use that, but so can Trump.

I don’t recall her saying anything that would be covered by the order, while the order was in effect. Can you point to such an instance?

Because I’m quite sure that had she done so Trump’s lawyers would have been on it immediately and demanded sanctions, and the judge would have been hard pressed to justify not granting them.

      Trump could also leak, and give press conferences, he just couldn’t speak on the topics he was barred from; and neither could the prosecutor.

      Cite one instance of a prosecutor in any of Trump’s cases violating a gag order and getting away with it. I don’t think you can. They were subject to the exact same orders, and they kept them. He was free to do whatever they did.

          Every gag order made against Trump has applied equally to all parties. Every single one. There has never been an order against him that did not apply to the other parties in that case. That is a fact, which you are not entitled to dispute. Now cite one case in which a prosecutor has violated such an order. Cite one case in which a prosecutor has said anything in public at a time when Trump was legally prevented from saying the same thing in reverse.

If only the trial were based on an actual crime being committed, the gag order wouldn’t be such an affront.

    It would, but there is no such thing as a one-sided gag order. Any gag order always applies equally to all parties. It certainly did in the case of all Trump’s earlier orders. If you can cite a case in which one of Trump’s adversaries violated such an order, at a time when it was in effect, saying something that he could not have said in reverse, please do. I don’t think it ever happened.

Causing material prejudice? I guess that means it could delay a NYC jury’s finding of guilt until after lunch.

But, don’t ban that. Just gag the defendant, so that the jurors only ever get to hear one side.

They’re giving up on keeping him off the ballot or even sending him to jail — now they just hope to shut him up before the election.

One nice thing in the “every cloud” realm is that Trump doesn’t need to spend much on advertising. The Democrats are essentially doing his campaigning for him.

It’s kind of interesting to me that Bragg would be worried about an NYC jury being prejudiced in Trump’s favor, especially considering that Trump’s rhetorical technique is basically “bull in a china shop”.

    No, Bragg is worried about what Trump supporters will do. Its well documented with respect to Trumps rhetoric precipitating death threats and worse during the course of cases.

      But we have only the word of some very sketchy people that it’s even true. Meanwhile the whole Trump family routinely gets threats, anonymous white powder in the mail, etc.

This is not a request for information. It is not a demand for corroboration of a statement.

It is a tactic.

They want you to waste time searching the internet for examples from sources you think they’ll just have to accept. And then, if you are fool enough to comply they will find a way to dismiss and belittle whatever you bring –even if it comes from the very mouths of their masters.

And even if you manage to stump them –perhaps by quoting them telling everyone they’re a registered Democrat– they’ll simply stop talking in that thread for a bit and come back a bit later as if they’d not been refuted at all.

    You are a filthy liar. You can’t cite such an example, because none exists. No prosecutor against Trump has ever said anything against him that he was barred at that time from saying in reverse. Because all of the gag orders on him applied equally to all parties, and the other parties all obeyed the orders. That is the fact, so you are left trying to obfuscate and tell outright lies.
