Trump’s EPA Poised to Slam Stake into Heart of Obama’s Climate-Grifting ‘Endangerment Finding’

EPA Administrator Lee Zeldin: “The proposal would, if finalized, amount to the largest deregulatory action in the history of the United States.”

Back in 2007, the Supreme Court’s climate change ruling, Massachusetts vs. Environmental Protection Agency, permitted the Environmental Protection Agency (EPA) to regulate carbon dioxide under the Clean Air Act Amendments of 1992. Following the Court’s directive, and after extensive manipulation of the scientific process and disinformation spread by the mainstream media, Obama’s EPA Administrator Lisa Jackson issued the “Endangerment Finding” in 2009.

The agency decided that six key greenhouse gases (including carbon dioxide, methane, and others) endanger both public health and welfare, laying the groundwork for hyper-regulation that restricted both prosperity and personal liberty. Those subsequent rules promulgated by the EPA allowed the agency to essentially conduct a “War on Fossil Fuels,” a “War on Appliances,” and a “War on Meat.” Biden’s ludicrous “Inflation Reduction Act” further fueled this inanity by codifying the “Green New Deal.”

During President Donald Trump’s first term in office, I noted that he was seeking advocates for sensible policy for his Department of Energy. During his second term, he has now unleashed the agency head, Lee Zeldin, to end the abuses of the “Endangerment Finding.

Speaking at a truck dealership in Indianapolis, Mr. Zeldin said the E.P.A. planned to rescind the 2009 declaration, known as the endangerment finding, which concluded that planet-warming greenhouse gases pose a threat to public health. The Obama and Biden administrations used that determination to set strict limits on greenhouse gas emissions from cars, power plants and other industrial sources of pollution.

“The proposal would, if finalized, amount to the largest deregulatory action in the history of the United States,” Mr. Zeldin said. He said the proposal would also erase limits on greenhouse gas emissions from cars and trucks on the nation’s roads.

Without the endangerment finding, the E.P.A. would be left with no authority under the Clean Air Act to regulate the greenhouse gas emissions that are accumulating in the atmosphere from the burning of fossil fuels.

I have no words to adequately convey the joy I feel at this news. I have been part of the CO2 Coalition for quite some time, as part of my early citizen activist work. There have been many hero scientists in this group who have been fighting the ludicrous ruling since it was first issued. The organization has put out a formal statement:

For more than 30 years, carbon dioxide has been demonized as a dangerous “greenhouse” gas by a cabal of special interests who pursued political science instead of true science. Since 2015, the CO2 Coalition has rebutted this narrative by educating the public about the beneficial role of the gas in nature and by insisting on rigorous scientific inquiry in deciding such matters. Thousands of scientists and researchers – both Coalition members and others – stood with us for the truth.

We believe EPA’s action – and other reforms of rules covering power plants – could ultimately end foolish public policy that has wastefully diverted trillions of dollars toward a manufactured climate emergency and away from work that could have otherwise benefited people.

…The theory that carbon dioxide threatens to catastrophically overheat the planet is fearmongering supported by computer models that have proven repeatedly to be unreliable and by exaggerations of CO2’s warming potential. The dominant influences of climate change have always been the sun and variations in Earth’s orbit and axial tilt that manifest themselves in cycles spanning thousands of years.

Over the past 80 years, the increase of atmospheric CO2 from human activity has resulted in an overall greening of most ecosystems and record production of food crops. These facts – supported by government data and reams of research – should be celebrated, and we will continue doing so.

The editorial board of the New York Post is also praising this move.

Back in 2009, Environmental Protection Agency functionaries listed carbon dioxide and other greenhouse gases as posing a public-health threat — not for any actual toxicity, but because of their role in speeding global warming.

That in turn allowed for unprecedented EPA regulation of factories, power plants and auto emissions — including the hated stop-start feature.

None of it ever made sense: Congress created the EPA in 1970 to fight actual poisons in our water and air, not to manage complex bank-shot contingencies as the “endangerment” finding envisioned.

…After all, anti-carbon mandates do major immediate harm to public health, by making electricity and other goods far more expensive: This green madness is a major reason why Western Europe has seen next to zero economic growth over the last two decades.

In this move, the administration is not only challenging science but also on legal arguments as well, suggesting the Obama-era finding overstepped the intended authority of the Clean Air Act. Of course, thanks to ObamaGate, we know Obama overstepped his authority on a significant number of issues.

Trump’s EPA has consistently advocated for stricter transparency rules, arguing that regulatory decisions should only rely on scientific studies whose data can be made fully public. The studies the “Endangerment Finding” relied on included health and environmental studies that were supported based on private or confidential data. This completely casts doubt on broad scientific findings underlying climate regulation.

“Man-made global warming” climate policy is a “quasi-religious” tenet and is not based on common sense nor sound, replicable science. The Obama-legacy policies unfairly prioritizes climate goals over economic realities and personal freedoms.

Another toxic legacy from the Obama era is about to be erased, thanks to Trump.

      At some point I’m going to be demounting the showerhead I bought two months ago (to replace a sun-damaged 40 year old one that was pleasant to use) to find out where I need to drill, baby, drill. I’m tired of fog showers

        Public Service Announcement;
        I just discovered that all shower heads now being sold have a gummint-mandated flow restrictor in them.

        Take your showerhead off (it should just unscrew from the pipe coming out of the wall) or purchase a new one. Look at the pipe end; you will see a little plastic gizmo inside that you can remove with needle nose pliers.

        I thought the wimpy flow in my shower was due to old plumbing and low water pressure; not so. After removing the flow restrictor from a new showerhead, I’m enjoying hotel-pressure showers again.

        I had no idea.

        Ball style stopper in the head, a small drill and I have a really nice flow of water. Check out their entire line although I don’t know if they all use the same ball style stop.

The one danger of this is that if America’s policies and legislation do a total 180 every time the other party captures the presidency, then businesses will be in an impossible position. (This isn’t a critique of sanity mind you, only the danger of bipolar government).

Under Democrats they need to treat CO2 emissions akin to nuclear waste – to be avoided at all costs, while under Republicans, Green extremism is not only an unnecessary and a major cost, it may come with additional penalty measures e.g. unreliable energy providers can’t simply cherry pick the most profitable times to sell their power, instead they have to guarantee reliable power at their own cost.

    The solution is to shrink the government. A LOT. So that even when they try this stuff, they can’t distort the entire country the way they want.

    Unfortunately, I don’t see any significant shrinkage happening.

The Achille’s Heel of the climate science: cloud physics. Clouds affect the earth’s albedo, and a very small change in the earth’s albedo (averaged over time and space) can wipe out the whole CO2 effect. See Steven Koonin’s book “Unsettled.” Unfortunately we don’t know cloud physics, so scientists use various empirical approaches leading to a lot of variations in model predictions of climate sensitivity to CO2. A polite way of saying “they guess.”

Before we wreck our economy we need far more certainly in the science.

    The whole climate is (thankfully) dynamically stable, like a bowling ball at the bottom of a large bowl. You can push it to one side, but it takes far greater effort for every inch, and wants to return to the middle in an oscillation of Ice Ages. As we are just coming out of a recent Ice Age, of course there’s a slow thermal rise. I’m more concerned about what happens when that rise stops. The beginning of the next Ice Age can be extremely abrupt.

    The other Achille’s Heel is the fact that the output of climate models are completely dependent on the assumptions imbedded in them. The assumptions are designed to maximize the grift.

    Never heard oregulate the greenhouse gas emissions that are accumulating in the atmosphere from the burning of fossil fuels. this Koonin guyy. Based o the little bit you just copied, I”d not rust him much.
    CO2 has been around since God made the earth. Its not going awa. It is NOT a poisin. Without it we will all be dead due to starvation within six months. Go and learn about the vast variations in CO2 levels on this big ol dirtball, going back some milennia.

    You might also look up the website watts up with that, and stud some articles there, along with their high quality unbiased research on the matter.

What the Trump Administration does in this fashion can be undone by the next. We need legislation and a complete dismantling of agencies forcing this stuff on America

This is good, but….

The biggest expenses for us is housing and automobiles. The price of new houses has skyrocketed in large part due to EPA regulations for energy efficiency standards, which are adopted by local governments. The price of new cars is ridiculous because of what is needed for mileage and emissions control.

Rescind the regulations for new construction and automobiles to make them affordable and that goes a long way to revitalizing the Middle Class. Do it NOW while you’re still in office Mr. President.

    I don’t think the rising cost of houses has been due to energy efficiency standards. More likely material costs. For example, the cost of a 4×8 foot sheet of 3/4″ construction grade plywood was about $25 in 2000, $96 in 2021, and is now “down” to $45-$70. The cost of an 8″ concrete block has also doubled since 2005.

    My electric bill makes me wish that Florida required better sidewall insulation.

    Another contribution to high housing prices is higher interest rates.

    The CAFE standards have resulted in a huge decrease in the supply of medium size sedans, thus creating a huge increase in their cost – and the cost of used medium size sedans. I can’t afford to buy a decent used car.

      have you tried to remodel or build lael? Government have added incredible insanne mandates involving every aspect concerning design and construction, including materials and methods. These alone add some 40% to the cost o build

      One must not need dig very deeply to discover the causes relating to the mad increase in price regarding all wood products. Go back to the insane phantasy involving the “Spotted Owl” madness. That was 100% us gummit boondoggling, lying, tyranissing, manipulating…….

This is a longshot at the Supreme Court. The admin is all but asking the court to overturn EPA vs Massachusetts.
