Kavanaugh Open Thread: Feinstein Refuses to Give Ford’s Letter to Grassley
Grassley to Feinstein: “Instead, you chose to sit on the allegations until a politically opportune moment. I cannot overstate how disappointed I am in this decision.”
It still looks like Brett Kavanaugh’s accuser Christine Blasey Ford will not show up for a hearing set for Monday, which has caused some mayhem at Capitol Hill.
The decision to not show up has caused the teetering Republicans to push for a confirmation vote if nothing happens on Monday.
To make matters worse, Feinstein won’t give the Republicans the letter that contains the accusations of sexual assault against Kavanaugh. Does this mean that no one else has actually seen the letter? Just Feinstein? How does she expect Ford to get a proper hearing on Monday if everyone else lacks all the tools?
Ford Open to Hearing Next Week If It’s Fair

In the email, obtained by The New York Times, the lawyer for Christine Blasey Ford said that testifying Monday — the timetable Republicans have set for a hearing — “is not possible and the Committee’s insistence that it occur then is arbitrary in any event.” The lawyer reiterated that it is Dr. Blasey’s “strong preference” that “a full investigation” occur before her testimony — wording that stopped short of demanding an F.B.I. probe and suggested she is open to testifying without one.
In the email, addressed to top Republican and Democratic aides on the committee, the lawyer, Debra Katz, wrote that she would like to set up a call later on Thursday to “discuss the conditions” under which Dr. Blasey would be prepared to testify.
“As you are aware, she has been receiving death threats, which have been reported to the Federal Bureau of Investigation, and she and her family have been forced out of their home,” the email said. “She wishes to testify, provided that we can agree on terms that are fair and which ensure her safety.”

Since her name became public, reported the New York Times today, Ford has been inundated with harassment and threats.
Ford has been “inundated with vulgar email and social media messages,” reports the Times, including death threats. Citing “a person close to” Ford who also wishes to remain anonymous, they report that the harassment has been so severe she has had to move herself and her children out of their home, and is arranging for “private security.”

Miranda on Twitter noted that she did not have “first hand knowledge” of the incident.
Miranda said staff from the Senate Judiciary Committee had reached out to her, something she was not expecting. She said she will not go through with a committee interview if asked.
Miranda says in high school she played soccer with Ford — whom she refers to as Chrissy — and that she continues to support her. Miranda added that despite not knowing specifics of what went on at the party three decades ago, she remembers that there was a “buzz” that went around the weekend of the party in question about an alleged incident involving students from her school and Kavanaugh’s.
Grassley Sets Friday Deadline
Ford has until Friday to decide if she will testify on Monday in front of the committee. From Fox News:
Grassley, in a letter to Ford’s attorneys on Wednesday, set a 10 a.m. Friday deadline to respond to the invitation “if she intends to testify on Monday.”
“You have stated repeatedly that Dr. Ford wants to tell her story,” Grassley wrote in the letter. “I sincerely hope that Dr. Ford will accept my invitation to do so, either privately or publicly, on Monday.”
It’s still not clear if Ford — who claims Kavanaugh sexually assaulted her more than 35 years ago while in high school — will ultimately accept the invitation to testify on Capitol Hill.
Republicans Still Pushing for Ford to Testify

McCaskill Will Vote Against Kavanaugh
Vulnerable incumbent Democrat Senator Claire McCaskill announced she will vote against Kavanaugh when the vote hits the floor. From The New York Times:
Ms. McCaskill said she was concerned about the accusation against the judge, but based her decision on campaign finance law. “He has revealed his bias against limits on campaign donations, which places him completely out of the mainstream of this nation,” she said in a statement.
The Kansas City Star had more:
“Going even further, Judge Kavanaugh will give free reign to anonymous donors and foreign governments through their citizens to spend money to interfere and influence our elections with so-called ‘issue ads.’ These ‘issue ads’ are now flooding the airways in this nation to directly influence election outcomes, drowning the concept of individuals having the strongest voice in our democracy.”
Feinstein Holds Onto the Letter
Senate Judiciary Chairman Chuck Grassley blasted ranking member Dianne Feinstein because she will not give him Ford’s letter that sparked this circus. From Fox News:
Senate Judiciary Committee Chairman Chuck Grassley on Wednesday unloaded a torrent of criticism on Sen. Dianne Feinstein for her handling of the sexual assault accusations against Supreme Court nominee Brett Kavanaugh, telling the ranking Democrat on the committee, “I cannot overstate how disappointed I am.”
Saying Feinstein “chose to sit on the allegations until a politically opportune moment,” Grassley demanded she immediately turn over an unredacted copy of the letter from Kavanaugh’s accuser, Christine Blasey Ford, that Feinstein received July 30.
Feinstein, D-Calif., shared the letter with federal authorities and other senators only last week, days before a key Judiciary Committee vote on Kavanaugh’s confirmation, after a leak about the letter was published in The Intercept. Republicans have accused Democrats of orchestrating that leak.
Grassley, R-Iowa, who called the document a “significant piece of evidence in Judge Kavanaugh’s confirmation process,” said that despite multiple requests, he still has access only to a redacted copy of the letter included in supplemental background materials provided by the FBI to a select group of senators.
Grassley said he needs the letter in order to have a proper hearing on Monday.
It looks like Feinstein cannot accept responsibility for the mayhem and keeps trying to deflect blame to the Republicans. She said:
Feinstein appeared to wash her hands of the process in a brief interview outside her Senate office with Fox News on Tuesday, saying, “I have no say, I’m the lead Democrat. … I think it’s really too bad that no one called her, or called her lawyer.”
She added: “This is a woman who has been profoundly impacted by this. Now, I can’t say everything’s truthful. I don’t know.”
Except THEY HAVE REACHED OUT TO HER. Numerous times! They are trying to do everything they can to hear from Ford and let her voice be heard whether it’s in the public or private.
Grassley brushed off Feinstein’s statement:
In his letter Wednesday, Grassley unequivocally dismissed Feinstein’s suggestions that her delays were motivated by a desire to protect Ford’s identity, and suggested that her actions had in fact compromised any legitimate desire to preserve her anonymity.
“These allegations could have been raised to me, or to Judge Kavanaugh, while protecting Dr. Ford’s anonymity,” Grassley said. “Had Dr. Ford not made her allegations public via The Washington Post over the weekend, I still would not know her identity.”
He continued: “These allegations could have been raised both within the last seven weeks and in a way that protected Dr. Ford’s anonymity. Instead, you chose to sit on the allegations until a politically opportune moment. I cannot overstate how disappointed I am in this decision.”

The CNN page says someone read to them a REDACTED version of the letter., that they had not seen the letter itself.
And Fineswine gave the Bureau a redacted copy of the letter. Fineswine, at least one or two of her staffers and perhaps some selected Democrats have seen the unredacted letter.
Thanks to leaks to the NYT and other reporters, we now all know what those “redacted” words were; the other person in the room at the time of the alleged assault was the writer named Judge, who has strongly denied ever having been part of any such thing, and another boy present was referred to as “PJ”, who has been identified as a classmate named Patrick J. Smyth. He has also strongly denied ever having been present during any incident of this kind.
I suspect what Grassley is most angry about is that DiFi is refusing to let him read the unredacted letter on grounds of “confidentiality”, and yet she’s shown it to every friendly MSM reporter that she knows.

I think Grassley should take a long weekend and show up at work at 8:59AM on Monday. I hear the Eastern Shore is nice this time of year. It is time to pull out the old “poor planning on your part does not constitute an emergency on mine” response. The other appropriate response to feinswine would be, “if this were the private sector, you would have been fired long ago (leave it vague for those to fill in months to decades as they wish).
We used to have these psycho relatives that drove between Maine and Texas every summer, and they always made plans to stop by in Ohio and visit for lunch, but every year they would call from Buffalo or Cincinnatti at around 5PM to say that they decided to keep on driving as “they were making good time, the weather was cooperating, etc.” So after a couple of times, we all would make other plans for the day, and then gather and laugh about it when the call would come. One point that may be overlooked is the event described appears to me to be a situation where the guy was trying to get to second base all the while skipping first base. A very plausible event, though very much out of character for what we know about Kavanaugh.

Was the level of trauma exaggerated for political reasons or was level of trauma imagined because christine was dealing with issues.
There is a note in one of the comment sections of an individual whose family was a member of the same country club as kav’s family and Christine’s family. The scuttlebutt was that christine had the reputation of a trouble teen. That would be consistent with having significantly more trauma from a relatively trivial event. Also consistent with the typical profile of a professional in psychology and psychiarity, those professions tend to be populated by individuals with issues.

There is one problem with this – it presupposes the incident actually happened and actually involved Kavanaugh.
Otherwise I tend to agree.
Even if true, it presupposes that her “troubles” were derived from the incident. There were girls in high school who were “troubled,” meaning that they didn’t behave like the other girls (wink, wink, nudge, nudge, say no more) and therefore attracted “trouble.” Sometimes, I’m sure, the trouble came from someone from whom it was not wanted, but the reputation can cause an impressionable youth to take his chances.
Feinstein hasn’t even forwarded the letter? This lends some credence to the Internet rumor that Ford sent the same letter with allegations re Gorsuch.
The presence of White Out under Kavanaugh’s name looks suspicious. DiFi is waiting for the letter to be retyped.
The Dumb-o-crats first wanted the accuser to be heard. Now, having been offered the opportunity to be heard, in public or in private, in D.C., or, in California, the Dumbs’ narrative is, don’t “bully” the accuser into expeditiously testifying in support of her allegation. From what I’ve read, the “medical treatment” that the accuser claims that she sought consists of her 2011 or 2012 therapy sessions — almost thirty years after the incident that is alleged to have taken place. Thus, conveniently, she cannot proffer any medical record that is contemporaneous with the date of the alleged incident.
Is her marital therapist a medical doctor? I.e. a psychiatrist? Highly doubtful. Normally a couples therapist might have a master’s in counseling or psychology. Even a Ph.d but still wouldn’t be a “medical” doctor.

It seems to me that DiFi probably has multiple versions of this letter, each differing slightly in levels of outrageous and unfounded claims. She can later release one or the other, depending on the details of circumstances, and claim that it’s “the” letter.

Well, this Cristina King Miranda is not helping, is she? She says she didn’t know “Chrissy” Blasey Ford personally but there was a buzz going on around the school with few specific details.
As already pointed out Prof. Ford said she told no one about it until 2012. But one of the details she did provide was the party was during the summer.

That is a good point – There is always a lot of buzz the next couple of days after a party, but 2 weeks to 2 months later – Teenagers attention span isnt that long.
It’s abundantly clear that Dr. Crazy’s original letter to Feinstein, if provided in unredacted form, would prove that’s she’s crazy or a liar or both.
The timing suggests the letter to Feinstein was sent in July but prior to when the good Dr. “lawyered up.”
No doubt when Feinstein herself questioned the truth of Dr. Crazy’s story, even in passing, that was a thoughtless “Freudian slip” as she mistakenly was a bit truthful.
I suspect that “Miranda” like so many other fools, is so accustomed to making baseless accusations on Social Media that she forgot that making them outside those cesspits actually has some real consequences.

Just Monday ABC’s chief legal analyst stated that Justice Thomas is a sexual predator (words to that effect). Given that is the Left’s position, I’m happy to say that with the retirement of Kennedy Justice Thomas is the longest serving Justice on the Court (37 years this year).
In light of this current circus and a chapter right out of the Democrats’ playbook — accuse without proof – they should wear that stink like a badge of honor. They were both considered enough of a threat that decency and fairness went out the door during a no holds barred assault.

The proper response Republicans should make should the Dems try anymore BS delaying tactics once this business with Ford is taken care of.
1. A raucous round of laughter.
2. The flipping of the bird combined with a firm NO! by Grassley.
3. Immediately proceed to the vote.

There is a reason for the Best Evidence Rule. And this is an example. Obviously the letter contains a clue that would exonerate Kavanaugh or discredit Ford. A name.
So I’m guessing Feinstein will use the unreacted letter as the Dem’s next bargaining chip:
“Conduct a thorough (and lengthy) investigation into Ms. Ford’s accusations against Brett Kavanaugh, and maybe in a few months I will turn over the letter.”
Perhaps Mr Kavanaughs first written opinion as an SC Justice should focus on the admissability of redacted documents in a public hearing. 😉

Ford should show up. That’s the Dems only chance. She needs to be sympathetic since there is law to be had on her side. By not showing up she loses the touchy feely vote and the hard facts don’t do her much good since they don’t reach the definition of “facts”.
To that point, this is not a “He said. She said.” It’s simply a “She said.” A true he said/she said is when two parties admit that something happened but they have different stories about what transpired. For example: They both admit when and where they hooked up for a, shall we say, tryst. She says he forced himself on her sexually and he says it was completely consensual.
In this case it’s more like the Lena Dunham and the Campus Republican scenario – Dunham said he violently raped her and it was proven that he was never even there.
The redacted content will be damaging. I’m thinking she may have discussed how the letter could be used to best effect.

I would still like to know why she was at a party with four boys. Girls who did this type of thing when I was in high school were the ones with a “reputation.” There were probably parties of this nature, but she has absolutely no evidence that Kavanaugh was anywhere near her whenever this took place. Clearly, she attended parties that were her and a group of boys, so what was she expecting to happen when they were all drinking? She’s admitting to stupidity, but she sure isn’t providing any evidence of anything else.

As the dust settles I am realizing this hurts women most of all They already have a hard time getting people to believe they were sexually assaulted, and the Democrats just traded that vital “benefit of doubf” for a failed attempt to delay the hearing until after midterms.
