Trump Directs FEMA to Play ‘Key Role’ in Responding to Potomac Sewage Spill Disaster

Legal Insurrection is continuing to follow the news related to the massive raw sewage spill from the Potomac Interceptor rupture.

This crisis illustrates the predictable consequences of neglected maintenance and questionable spending priorities by DC Water, resulting from political and managerial choices that prioritized image and amenities over core infrastructure, with downstream Maryland communities bearing the public‑health impacts.

We also took a look at DC Water’s 9,900% error in reporting E. coli levels after the spill, which reported 242,000 MPN/100 mL as 2,420 and may have ultimately been the result of the agency’s emphasis on diversity, equity, and inclusion programs, rather than concentration on mission priorities (e.g., technical competence and accurate, safety‑critical testing procedures and interpretation).

During my last report, I noted that the Potomac Interceptor release is poised to become the largest sewage spill in U.S. history.  The release is not anticipated to be fully contained for weeks.

Given the serious nature of this crisis, and its potential to cause serious harm to human health and the environment, it is no surprise that President Donald Trump is planning to bring in federal assistance and directs the blame for both the incident and the ineffective response at the party that has been in charge of bureaucracy responsible for the region.

President Donald Trump said Monday that FEMA will play a “key role” in the response to a sewage spill in the Potomac River, criticizing Democrats for their response to the disaster.

The collapse of a sewer line in Montgomery County, Maryland, last month spilled more than 200 million gallons of wastewater into the river. DC Water recently completed a bypass to temporarily reroute wastewater back into the sewer system, although local officials say it could take another 10 months to repair the pipe.

In a Monday afternoon social media post, Trump accused Maryland Gov. Wes Moore — a Democrat — of “gross mismanagement,” calling the spill “a result of incompetent Local and State Management of Essential Waste Management Systems.” He also attacked Moore for his role overseeing the rebuilding of the Francis Scott Key Bridge in Baltimore, which collapsed in March 2024.

“While State and Local Authorities have failed to request needed Emergency Help, I cannot allow incompetent Local ‘Leadership’ to turn the River in the Heart of Washington into a Disaster Zone,” Trump wrote on Truth Social, adding: “The Federal Government has no choice, but to step in.”

Maryland Gov. Wes Moore (D) then responded that Trump was at fault for the Potomac waste spill.

“The President has his facts wrong—again. Since the last century, the federal government has been responsible for the Potomac Interceptor, which is the origin of the sewage leak. For the last four weeks, the Trump Administration has failed to act, shirking its responsibility and putting people’s health at risk,” Ammar Moussa, a spokesperson for Moore, told The Hill.

“Notably, the president’s own EPA explicitly refused to participate in the major legislative hearing about the cleanup last Friday. Apparently the Trump administration hadn’t gotten the memo that they’re actually supposed to be in charge here,” Moussa added.

The discharge of nearly 300 million gallons of raw sewage into the Potomac (and possibly more) is a massive public health and environmental emergency, and the governors of the affected states (namely Maryland and Virginia) should lead an aggressive, highly visible response. This volume of contamination threatens drinking water intakes, exposes residents to waterborne illnesses, and puts aquatic ecosystems and wildlife at risk.

Local businesses that depend on clean water and a safe, attractive riverfront. Restaurants, outfitters, marinas, hotels, and other travel-oriented businesses now face cancellations and financial pain, while the tourism industry in the Chesapeake region could suffer from images of a polluted, unsafe river.

Instead of leaving the public narrative to bystanders posting cell phone videos on social media, the governors should have been front and center at the spill sites and briefing rooms from day one: explaining risks, coordinating with utilities and federal agencies, demanding rapid infrastructure fixes, and making it clear that protecting communities and ecosystems along the Maryland and Virginia shores is their top priority.

However, they are not. So perhaps our Secretary of State would be willing to take on another role?

And in terms of the involvement of the Environmental Protection Agency (EPA), administrator Lee Zeldin had this to say:

At no point in the lead up to today had DC Water or the state of Maryland requested EPA to take over their responsibilities, and EPA has continued to offer its full support to state and local leaders from the onset. We are ALWAYS ready to lead and assist with our exceptional agency team!!

One last point: I review the Sierra Club X-posts. They, like many other environmental groups, exist only to support the Democrat agenda and woke priorities. Hence, there is plenty of TDS, but no mention of the Potomac Interceptor rupture and the millions of gallons being released into sensitive habitats.

In the end, 300 million gallons and a year-long remediation may be the best-case scenario.

Can someone please explain how the Federal Government is responsible for a sewer system that runs through Maryland and DC? How can a state governor get away with misinformation like that?

    Wes Moore gets away with it just like Tim Walz gets away with it, like Pritzker gets away with it, like Newsom gets away with it. That’s how. The East coast, the Midwest, and the West coast insurrectionists are stage 1 of the Plan, those bases have been covered.

    Side bar: Democrats want federal “interference” only when it’s( literally) their sh** that needs to be cleaned up.

    In a piece of good news, DC Water found over $500 Million to spend on DEI initiatives. Not sure how that fixes water and sewage pipes but at least the bureaucracy knows white man bad

    Hey, slow your roll. Gov Moore is a member of the MD Football Hall Of Fame, War Hero, Oxford Grad, his grandfather was run out of SC by the KKK and a bunch of other notable achievements. What have you done?

Competent governance isn’t sexy, it is methodical. Routine maintenance is boring and vastly underappreciated. Often the public gets upset at the relatively slight inconvenience caused by temporary closures. Much easier and far more flashy for Governors and Mayors to hold press conferences or signing ceremonies for whatever new boondoggle program is the current hotness. It’s like the quietly competent guy/gal at the cubicle farm who nobody pays attention to until the retire or absent for extended time….then there’s no office supplies, the copier is on the fritz, the billing is fouled up, the interface between creaky legacy software and new applications shuts down, the vendors don’t get paid ….suddenly everyone realizes that boring Bob/Barbara was a key employee they overlooked and took for granted.
