Former Baltimore City State’s Attorney Marilyn Mosby Found Guilty On Two Counts Of Perjury

Former Baltimore City state’s attorney Marilyn Mosby has been found guilty in federal court on two counts of perjury related to alleged false statements made in order to withdraw money from the city’s retirement fund (in order to buy property in Florida, apparently!).

Mosby, you may recall, is the Soros-backed Baltimore state’s attorney who made a complete clown of herself with her bizarre mishandling of the Freddie Gray case. Mosby was also a “decarceration” advocate who lost her bid for reelection amid rising violent crime in Baltimore and ongoing questions about her judgement, competence, and character.

The latter three qualities (or lack thereof) all appear to have played a role in the recent guilty verdicts handed down for perjury and in upcoming trials related to making false claims on mortgage applications.

Fox News reports:

Former Baltimore City State’s Attorney Marilyn Mosby has been convicted on two counts of perjury by a federal jury.

The federal jury reached the verdict Thursday, finding Mosby guilty of perjury after she falsely claimed financial hardship during the COVID-19 pandemic in order to withdraw money from the city’s retirement fund, prosecutors announced.

. . . . Mosby faces a maximum sentence of five years in prison for each of the two perjury counts. U.S. District Judge Lydia K. Griggsby hasn’t scheduled a sentencing hearing.

. . . . Mosby received her full salary of $247,955.58 in 2020, which is the year she claimed financial hardship and withdrew the money from her retirement accounts, according to federal prosecutors.

The trial was delayed in February after Mosby’s entire defense team quit.

. . . . Mosby also faces two counts of making false mortgage applications in a pending federal case, which relates to the purchase of two Florida vacation homes. A trial date hasn’t yet been set in that federal case.

If convicted of making false mortgage applications, Mosby faces a maximum prison sentence of 30 years for each of the two counts.

    True. However, the admissions practice you note is not limited to just BC.

    AA admits are also conducted with similar outcomes at Georgetown and Notre Dame Law as well as many other Catholic Law schools.

She committed perjury, but she ALSO, through that perjury, STOLE a boatload of money from the government.

How are there not theft and fraud charges to go along with the perjury.

    Did she actually steal the money, or only try to? Could explain the lack of embezzlement charges.

    Stole? No. It came from her retirement account. As described it might be an early withdrawal from a qualified retirement plan that normally attracts ordinary income tax plus a penalty of 10% of the withdrawal. Alternatively, the withdrawal might have been a loan from the plan (making her crime perjury on a loan application). This has no tax consequences, but the borrower’s take home pay is reduced as the loan is paid back via payroll deduction.

      She is entitled to take a hardship withdrawal from her 401k and if 59 1/2yrs a lid the 10% penalty. The IRS is pretty specific on what constitutes a hardship (medical expenses etc) and vacation property purchase isn’t one of them which is where perjury comes in. I didn’t see what she claimed the hardship was but I bet it wasn’t real estate speculation.

      I think committing perjury is pretty much a one way street to being disbarred but for one of the victim class who knows. I bet she never sees the inside of a jail, though.

    I bet she was not exactly truthful with them. When they found out what the actual deal was a collective “hell, no” from everyone not wanting to be involved in that was made. Everyone deserves a trial and representation before the court. Few want to risk disbarment, however.
