FL: Man Arrested For Allegedly Driving Into A GOP Voter Registration Tent
There were no injuries reported
Gregory William Loel Timm, 27,has been arrested in Jacksonville, Florida as a suspect involved in an incident in a Walmart parking lot. According to reports, the suspect is believed to be the person who plowed into a Republican voter registration tent in which volunteers were registering people to vote.
Hours after a van plowed through a Republican Party tent where volunteers were registering voters, Jacksonville police arrested a 27-year-old man on two counts of aggravated assault on a person over 65 years old, criminal mischief and driving without a license.
The Jacksonville Sheriff’s Office identified Gregory William Loel Timm as the person behind the wheel of the van that struck the tent set up the parking lot of a Walmart Superstore at the corner of Atlantic and Kernan boulevards about 3:50 p.m. Saturday.
Timm is accused of pulling up, driving through the tent and striking their tables.
“It happened so quickly,” said Nina Williams, a volunteer. “I just barely got out of the way.”
Lt. Larry Gayle said after driving through the tent, the driver, now identified as Timm, stopped, took a video and “flipped off” the people who were inside the tent before driving away. Investigators have been monitoring social media to see if the video shows up.
No injuries were reported. One of the volunteers provided photos of the older brown Chevrolet driving away.
“We don’t know if this is politically motivated,” Gayle said.

While the motive is as yet unclear and little is known about the suspect, the Duval County GOP believes it to have been politically motivated.

Another reason to carry….
Speaking as a vet who is licensed to concealed carry (and does), I don’t think this attack is a reason to carry. I have read a dozen or so reports about this, everyone says the attack happened without warning. There was no opportunity to draw your carry piece and stop the attacker. That leaves you with unattractive option of shooting at the back of a retreating van. That gets YOU arrested along with the driver. You would no longer being in imminent danger, and your justification for shooting across a Walmart parking lot would be gone.
Sounds like you need more training. Not target practice. Training.

Tell us, oh vet, what makes you an authority over other vets and experts and why should people listen to you over lawyers who know the law better than you?
When he jumped out of the van, after attempting to run people over, and raised his hand, you would be well within the bounds of reason to think he had a weapon. And that would be justified self-defense.
But, yes, if he remained in the van and sped off, you would be hard-pressed to justify* shooting at the vehicle (though a policeman in some jurisdictions would be legally allowed).
(* In the law’s eyes. My personal feelings about it are otherwise – but irrelevant to your fate at the hands of a prosecutor and jury.)
Actually in principle a policeman would have less justification than an ordinary citizen. But it all depends on state law.
Tennessee v Garner abolished the Fleeing Felon rule for state actors, unless the felon is dangerous, and letting him flee endangers the public. But since it was decided under the fourth amendment, it does not apply to private actors. Which means that in those states (if any) where the old common law rule is still in force, policemen may no longer shoot non-dangerous fleeing felons, but ordinary citizens may.
However many states have of their own accord abolished the rule except for policemen, so in those states an ordinary citizen can’t shoot even a dangerous fleeing felon, let alone one who isn’t dangerous. I understand your comment to refer to such states.

Generally we would not. Some cops are less professional than most, and do engage in such speculation, but in the majority of cases we see exactly what we’re seeing now: politicians speculate while the police refuse to do so.

A bit of muddling, I think. Because “cops” and “politicians” overlap in the very top ranks. So you would see politicians dressed in police uniforms tossing about phrases like “hate crimes” and “terrorism”. The same ones who would counsel “caution” with those words if the wrong race/religion were the seeming perpetrator.
It’s not “clearly” anything until evidence of the motive emerges. We may think and speculate it’s politically motivated, but the police can’t do that. They have to maintain open minds until there is evidence. Don’t worry, the evidence will soon be in, and yes, it will probably show exactly what you and I suspect, and then the police will say so.

I’m living in the real world, in which I observe that police regularly refuse to engage in such speculation, even when everyone around them is doing so. No, it doesn’t always happen like that; some police are unprofessional enough to join in the speculation. But most of the time they don’t.

Given that that the volunteer in the tent were over 65, I’d say the district attorney needs to upgrade the charges to attempted murder.
While I understand the reasoning behind the police only charging aggravated assault, it can be reasonably argued before a grand jury. A one and a half ton van moving at 15 to 20 miles an hour versus senior citizens. The reasonably foreseeable reasults would be death.
While I am assuming facts not yet in the public domain, as a reasonably coherent adult I would have no problem returning a true bill on those grounds. Even without the introduction of the civil rights violations.

No those were the original charges. And I doubt the detectives have completed their investigations yet. However if this piece of excrement goes to trial on the standing charges it would be prudent for the Governor to have a serious conversation with the DA.
