Minnesota Officials Sue DHS to End ICE Surge
Basically Minnesota: “Pay no attention to the man behind the curtain!”
Yeah, um, you don’t get to enforcement of federal law.
On behalf of Minnesota, Minneapolis, and St. Paul, Minnesota Attorney General Keith Ellison filed a lawsuit against the Department of Homeland Security to end the surge of ICE agents.
“This operation is driven by nothing more than the Trump Administration’s desire to punish political opponents and score partisan points—at the direct expense of Plaintiffs’ residents,” Ellison wrote in the lawsuit. “Defendants’ actions appear designed to provoke community outrage, sow fear, and inflict emotional distress, and they are interfering with the ability of state and local officials to protect and care for their residents.”
In other words, “Pay no attention to the man behind the curtain!”
The lawsuit comes after an ICE agent shot and killed Renee Good after she tried to run him over.
Here are the allegations:
- Violates the Tenth Amendment
- Violation of Equal Sovereignty Under the U.S. Constitution
- Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Violation of State Law and City Ordinances
- Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Excessive Force
- Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Warrantless Arrests Without Individualized Assessment of Immigration Status
- Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Defendants’ Decision to Conduct Border Patrol Enforcement Action as if the Agents Are Near the Border
- Administrative Procedure Act, 5 U.S.C. § 706(2)(A) – Arbitrary and Capricious: Revocation of 2021 Sensitive Locations Policy
- Unconstitutional Retaliation in Violation of the First Amendment
- Violation of the First Amendment – Viewpoint Discrimination
- Ultra Vires Executive Action in Excess of Constitutional and Statutory Authority Conferred on the Executive
Ellison claimed that the surge of ICE agents “has resulted in tangible harm to the state of Minnesota and its people, as well as the cities of Minneapolis and Saint Paul.”
Do I need to do a deep dive into this lawsuit? Ellison spits out the usual leftist talking points: racism, mean tweets, excessive force, etc.
The lawsuit does not mention the amount of fraud people have discovered in the Somali population and the illegal aliens involved in the schemes.
Ellison also did not mention the numerous dangerous illegal aliens caught by DHS.
Fox News’s Bill Melugin described it as “the most disturbing list” he’s ever seen.

No, there isn’t. I don’t think even Ellison is claiming there is, though I suppose I shouldn’t put it past him. I haven’t read the brief but my guess is that he’s claiming the enforcement effort in MN is happening only because Trump doesn’t like the governor’s speech. Which, even if true, would in my opinion be hunky dory. The people being arrested are being arrested for their own offenses, not for the governor’s speech.
OK, I haven’t read the brief, and I haven’t got the time or the patience to do so right now, so maybe somewhere in there there’s something to explain how this can be. But on its face, all of the listed complaints seem like utter bullshit.
I especially love “Unconstitutional Retaliation in Violation of the First Amendment”. That is a real thing, and I do think the Trump administration has been guilty of that at times, but in my opinion it’s completely inapplicable here. Even if Trump had openly announced that he would retaliate against a state governor for his protected speech by enforcing the law in his state, it seems to me that that would not be unconstitutional. Enforcing the law is the president’s duty, though he gets a lot of discretion about where and when and how to do so. It would only be unconstitutional if he were having people arrested based on their speech, not that of the governor of the state in which they happen to be hiding.
This will be laughed out of court.

I understand a similar private case is going before a Brandon-appointed district judge once associated with a Soros institute. Watch for a TRO to be overturned on appeal.
Here’s an idea, how about MN and it’s political subdivisions cooperate with ICE? Just spit balling here but couldn’t all this surge of immigration enforcement into MN have been avoided if MN simply honored ICE detainer and otherwise turned over to ICE the criminals the local and State LEO arrest who are illegal aliens? /S

Tom Homan has stated on media that if MN officials would allow ICE into the jails, arrests of the illegals they are looking for could be handled quickly and safely. That’s the simple solution but the Democrats want to have their public spectacle and propaganda. Not to. mention that this frivolous lawsuit adds insult to injury to taxpayers. If only Walz, Frey, Ellison, and Omar could be arrested and in the latter case, deported as well.
Why only in the latter case? If you’re fantasizing about deporting US citizens, which you already know is an impossibility, why not fantasize about deporting all of them? She’s no less a citizen than they are. There’s no credible claim that there was any flaw in her naturalization.

It doesn’t matter what their claims are. Feds have exclusive jurisdiction over immigration. That was the whole thing with Arizona and SB 1040 back under Obama. Only the Obama administration was claiming and won exclusive jurisdiction so they could refuse to enforce the law. Trump gets to use that to enforce the law. Sucks for democrats and illegals.
So do you contend the Trump Admin will go to the nearest Federal Judge and that Judge will immediately dismiss the claims and that’s ‘all she wrote’ everybody agrees the issue is settled (again) and goes away? I don’t think that’s very likely.
Legally correct or not (FWIW we agree the WH can absolutely do what they are doing to enforce immigration law) there is also a PR/propaganda struggle going on with this issue. There are Federal Courts who will entertain these nonsense claims. There’s a very real possibility some ideological TDS Federal Judge issues some sort of initial ruling to halt the operation that ultimately gets reversed but gums up the works while it exists.
That is exactly what should happen. Whether it does depends on how corrupt that judge is. Honestly, I don’t even know if the state has standing to file this.

Excellent point. ICE roundups are occurring “in our streets” because certain States are preventing ICE from doing their work outside of public view. But that’s the point of non-compliance, yes? Dems want theater and all their streets are stages.

ICE activities in MN and other states are following Congressional Law that has been in place for many Presidents. No such lawsuits have been placed by states against the Federal Government until now.
If Federal Judges back the states over ICE then it is clear the Judges are corrupt. The problems will be getting Judges that will properly handle cases given to them. The Judiciary in the USA has been showing it is corrupt and Congress is doing nothing to fix it.
