Minnesota Officials Sue DHS to End ICE Surge

Minnesota Officials Sue DHS to End ICE Surge

Basically Minnesota: “Pay no attention to the man behind the curtain!”

Yeah, um, you don’t get to enforcement of federal law.

On behalf of Minnesota, Minneapolis, and St. Paul, Minnesota Attorney General Keith Ellison filed a lawsuit against the Department of Homeland Security to end the surge of ICE agents.

“This operation is driven by nothing more than the Trump Administration’s desire to punish political opponents and score partisan points—at the direct expense of Plaintiffs’ residents,” Ellison wrote in the lawsuit. “Defendants’ actions appear designed to provoke community outrage, sow fear, and inflict emotional distress, and they are interfering with the ability of state and local officials to protect and care for their residents.”

In other words, “Pay no attention to the man behind the curtain!”

The lawsuit comes after an ICE agent shot and killed Renee Good after she tried to run him over.

Here are the allegations:

  • Violates the Tenth Amendment
  • Violation of Equal Sovereignty Under the U.S. Constitution
  • Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Violation of State Law and City Ordinances
  • Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Excessive Force
  • Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Warrantless Arrests Without Individualized Assessment of Immigration Status
  • Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Defendants’ Decision to Conduct Border Patrol Enforcement Action as if the Agents Are Near the Border
  • Administrative Procedure Act, 5 U.S.C. § 706(2)(A) – Arbitrary and Capricious: Revocation of 2021 Sensitive Locations Policy
  • Unconstitutional Retaliation in Violation of the First Amendment
  • Violation of the First Amendment – Viewpoint Discrimination
  • Ultra Vires Executive Action in Excess of Constitutional and Statutory Authority Conferred on the Executive

Ellison claimed that the surge of ICE agents “has resulted in tangible harm to the state of Minnesota and its people, as well as the cities of Minneapolis and Saint Paul.”

Do I need to do a deep dive into this lawsuit? Ellison spits out the usual leftist talking points: racism, mean tweets, excessive force, etc.

The lawsuit does not mention the amount of fraud people have discovered in the Somali population and the illegal aliens involved in the schemes.

Ellison also did not mention the numerous dangerous illegal aliens caught by DHS.

Fox News’s Bill Melugin described it as “the most disturbing list” he’s ever seen.

Ah, so feckless Ellison, who couldn’t see rampant Somali childcare scams right in front of him, is getting all hot and bothered about FEDERAL immigration actions?

Supremacy clause, anyone?

This is a fat distraction from the Somali scams, failed Minnezuela gov’t, and an attempt to take away from the outstanding successes in Venezuela by PRESIDENT Trump, not to mention grasping at the rim of the toilet bowl the Dem socialist party is swirling down….

SCOTUS ha opined that States have nothing to do with immigration, so of course the Feds are legally there

Too bad that dropout couldn’t keep his finger off the trigger. It’s going to be that much harder to deport the people we actually need gone.

There is no 1st Amendment right to obstruct law enforcement.

No, there isn’t. I don’t think even Ellison is claiming there is, though I suppose I shouldn’t put it past him. I haven’t read the brief but my guess is that he’s claiming the enforcement effort in MN is happening only because Trump doesn’t like the governor’s speech. Which, even if true, would in my opinion be hunky dory. The people being arrested are being arrested for their own offenses, not for the governor’s speech.

Here’s an idea, how about MN and it’s political subdivisions cooperate with ICE? Just spit balling here but couldn’t all this surge of immigration enforcement into MN have been avoided if MN simply honored ICE detainer and otherwise turned over to ICE the criminals the local and State LEO arrest who are illegal aliens? /S

Seriously though that seems to be the first question to posed by any responsible Court and would IMO undermine their claims. Sometimes things are simple.

Lol. These leftists don’t give a crap about the 10th amendment.

Several people smarter than moi have already correctly analyzed that these angry, greedy, power hungry leftist raise such a violent ruccus to defend illegal aliens for raw political power. Period.

Raw political power from the money these illegals scam from tax payers; raw political power from no-go zones enforced by mercenary antifa terrorists paid by those scams; raw political power from inflated census numbers provided by illegals for representation in congress; raw political power from a loyal block of voters beholden to the democrats who provide all manner of ways for these illegals to suck off the gubmint teet – paid for by you & me.

I wish I could say we can vote our way out of this, but it appears we are at war. Prepare accordingly. It will get far worse than karen in a car attempting to murder a LEO. They will not hesitate to murder you too.

All the flags of a group itching for confrontation are waving. I kinda hope that these geriatric Karens, confused kids and mean Democrats make an attempt towards me.
