DOJ Wants to Try Kilmar Abrego Garcia on Human Trafficking Before Being Deported
“This defendant has been charged with horrific crimes, including trafficking children, and will not walk free in our country again.”
The DOJ told the Associated Press that it wants to try alleged MS-13 member and wife beater Kilmar Abrego Garcia on human trafficking charges before America deports him.
From the report:
“This defendant has been charged with horrific crimes, including trafficking children, and will not walk free in our country again,” DOJ spokesperson Chad Gilmartin told The Associated Press.
Gilmartin made the statement hours after a federal prosecutor told a federal judge in Maryland that the U.S. government plans to deport Abrego Garcia to a “third country” that isn’t El Salvador. But Justice Department attorney Jonathan Guynn said there was no timeline for the deportation plans.
Guynn acknowledged the government’s plans during a hastily planned conference call with Abrego Garcia’s attorneys and U.S. District Judge Paula Xinis in Greenbelt, Maryland. Abrego Garcia’s lawyers had filed an emergency request for Xinis to order the government to take Abrego Garcia to Maryland when he is released in Tennessee, an arrangement that would prevent his deportation before he stands trial.
Gilmartin made the announcement “hours after a federal prosecutor told a federal judge in Maryland that President Donald Trump’s administration plans to deport Abrego Garcia to a country that’s not his native El Salvador after he’s released from jail in Tennessee.”
Abrego Garcia landed back in America on June 6 to face these charges.
A federal grand jury in Tennessee indicted Garcia on human trafficking charges under 8 U.S. Code § 1324.
The charges were filed on May 21.
Kilmar Armando Abrego Garcia, as detailed further below, used his status in MS-13 to further his criminal activity. Over the course of the conspiracy, the co-conspirators knowingly and unlawfully transported thousands of undocumented aliens who had no authorization to be present in the United States, and many of whom were MS-13 members and associates. The co-conspirators also worked with transnational criminal organizations in Mexico to transport undocumented aliens through Mexico and into the United States.
The filing says these people came from El Salvador, Guatemala, Honduras, Ecuador, Mexico, and other places. The conspirators allegedly smuggled the people into America through Texas.
Yes, the indictment states the people included MS-13 gang members and associates of the gang.
In April, The Tennessee Star discovered the Tennessee Highway Patrol (THP) detained Abrego Garcia on suspicion of human trafficking in December 2022.
THP contacted the FBI.
The FBI told the THP to release Abrego Garcia and the passengers, which it did.
Then last month, the DOJ spoke to a prisoner in Alabama about possible connections to Garcia regarding the allegations.

Any chance we learn the identity of the FBI officials who ordered him and the other passengers released?
NO!
“This defendant has been charged with horrific crimes, including trafficking children, and will not walk free in our country again.”
Now do the FBI personnel who let him walk free in our country the first time.
I’m not part of the legal profession so I can dispense with the niceties of presuming this man to be innocent. I believe he has committed those crimes and should rot in a federal prison for the remainder of his days.
What I lament is that democrats have thrown all common sense and human dignity out the window to spite the Bad Orange Man.
There are certainly victims here that suffered tremendously and I would imagine those scars to be permanent.
For them, justice delayed is justice denied.
And this is where the Dems have gone so off the rails: what about the victims?
They love to talk about victims and use them to bully others into compliance with their ideology. But when there are victims of that ideology… crickets.
Van Hollen’s best bud should have let himself be deported rather than become a tool caught between the administration and congress.
BTW will Van Hollen be a character witness on his behalf.
He’s shown himself stupid enough to do it.
I can understand the reason to drive a stake in his “Maryland Dad” reputation
Especially right before midterms. Oh yeah, I went there.
of course he should first serve time when found guilty then be deported
otherwise he’ll be back in no time
why? just deport him to Sudan, that would be worse punishment that being in any US prison
And don’t deport him to some prison.
Just drop him off in the middle of the jungle or a desert. No compass, no map, no electronic devices, and enough water to last a week. Then say goodbye.
Some would say that one reason is the statutory prohibition on convicted felons entering the country. Should a Democrat win the White House in the foreseeable future, his felony conviction would make it more difficult (but not impossible, sadly) for him to be allowed in legally, at least on a temporary basis. But, even if a felony conviction completely forecloses a more permanent entry, he could always be pardoned by that future Dem president. So, I’m with you. Why go through the expense of trying him on a felony charge when the government already has a deportation order that bars his from future reentry?
To provide the GOP with a future campaign talking point:
“The Dems didn’t want this now convicted human trafficker removed from the country.”
Without the conviction, the Dems would just brush off the claims of trafficking as “allegations.”
Death sentence for multiple offenses possible?
Would love to see DNC and Rachel Madcow reactions.
Along with idiot District Puke “judge” that demanded the return of this freak.
“Oh, you want him returned? OK. Here’s his indictment for death-penalty crimes. Thanks for helping us make that happen.”
