Pro-Life Christian Groups Sue NY AG Letitia James Over ‘Political Witch-Hunt’
James threatened to sue the collective over supposed misleading statements and lies about abortion pill reversal.
Heartbeat International, CompassCare, and a collective of pregnancy help organizations have filed a lawsuit against Attorney General Letitia James to block her from suing them for supposedly misleading and lying about Abortion Pill Reversal (APR).
“This is a political witch-hunt against small nonprofits that have selflessly served New York’s pregnant women and their children for over 50 years,” said Peter Breen, Thomas More Society Executive Vice President & Head of Litigation. “Letitia James should be heralding these charities, not launching outrageously false claims against them under laws that don’t apply to their noncommercial speech.”
Breen added: “We will fight back as long as it takes against Ms. James’ efforts to jeopardize the Christian and life-affirming missions of Heartbeat International, CompassCare, and all similar pro-life ministries in the State of New York.”
A woman needs two drugs to have a drug-induced abortion. Sometimes, a woman changes her mind after she takes mifepristone, the first pill. Progesterone is used “to ‘outcompete’ the mifepristone at the progesterone receptor sites.” It signals to the body to “sustain the pregnancy.”
APR is a way to help a woman reverse any effects of mifepristone and save her baby. The doctor gives the woman a dose of progesterone to counter the mifepristone.
Also, progesterone is a pregnancy-safe pill, filed under Category B with Tylenol.
On April 22, James sent a “Notice of Intention to Sue” to many pregnancy centers “that offer or share information about the APR protocol.” She claimed the centers lie and mislead women.
The collective, represented by the Thomas More Society, filed a complaint against James on April 30, asking for “declaratory and injunctive relief from the latest threatened legal action by” James against the organizations.
The complaint proved that they had done nothing wrong and didn’t lie to women or mislead them.
“For decades, doctors have been prescribing supplemental progesterone for pregnant women at serious risk for miscarriage—but because this safe and long-established practice may actually reverse abortions, ideologues like Letitia James now want to squelch it,” explained Breen. “Ms. James’ Notices of Intention to Sue are a transparent attempt to harass small pro-life charities into silence, targeting her political opponents because of their beliefs, in flagrant violation of the First Amendment.”
The complaint also points out that James has not done anything to those who claim that chemical abortions are safe, especially from organizations that favor her, such as Planned Parenthood.
Heartbeat International has the APR Network, which has physicians or other medical providers who want to help women who change their minds about abortion.
APR Network’s data implies it has saved over 5,000 babies.
“New York State laws protect abortionists and abortion on demand up until birth, stated Jor-El Godsey, president of Heartbeat International. “Now they are targeting those who assist a woman in exercising her right to continue her own pregnancy. It is unconscionable to see the abortion industry and its paid-for politicians go so far as to insist she complete an abortion she no longer wants.”
James and her ilk don’t sound very pro-choice, do they? It’s why I call them pro-abortion.

In any case, mere lying is protected speech. To be unprotected it would have to be fraud, or false advertising, or some such thing, which fails immediately because these groups are not selling anything. (Unlike PP, which sells abortions.)

Its a lawsuit against a group of bodies, I’m unclear on the exact nature of these groups. You may have a point but I cant say for certain on the facts that I’m aware off. Some of these organisations do carry out some medical services but if that’s true for these particular ones I’m not sure. With respect to the legal point i’m not at all sure, id tentatively opine that fraud implies harm and that doesn’t necessarily have to be directly monetary in value or if not you could imply financial harm with costs associates with medical issues or indeed having a child.

I say: Not for the unborn child. I never had strong feelings on this subject until I saw images of my grandson in his mother’s womb months before he was born and he was moving, sucking his thumb, etc.. When he was born, his face looked exactly like it did in the scans. That made me realize abortion attacks actual living children, not just a blob of cells. Since seeing them, I find myself opposed to late-term abortions at all costs, and while I believe early abortions may be allowed, I think it should be limited to first trimester only.

This is purely emotional, it’s not an argument. Nor does it address the issues in relation to what’s being stated and the article.
Aside from the alleged misrepresentation, Ms. James proves the “pro-abortion” side is not “pro-choice.” There is little doubt that her intent is to shut down those providers who are enabling women to reverse their decisions to abort their babies, because the law she intends to use does not apply to non-commercial promotion of the use of progesterone to do so. The very fact the law is inapplicable demonstrates that this is lawfare, pure and simple, and the intent is to harass, disrupt, and economically damage (if not destroy) the providers. She knows the effort will ultimately fail, but convictions (and justice) aren’t her objective.

I’m not clear that this is true, there is a long and troubling history of anti abortion activist being deceitful in the US. Its clearly in the public interest to have people who lie through there teeth about something so serious have legal consequences.

In that demand letter, the AG does not reference the NYS Department of Health or any medical society taking issue with the APR protocol as cited by CPS. Instead, she uses the Business Law, which is for misleading advertising and the such.
So it’s essentially I Say You’re Lying and you have 5 days to prove I’m not. But it’s gonna cost you big time in time and legal expenses if I take this to trial.
