Election Interference: DOJ/FBI Carpet-Bombed Subpoenas An Attempt To Freeze Political Opposition In Runup To Midterms

If Trumpworld and conservative world and Republican world legitimately were deserving of carpet bombed subpoenas regarding January 6, it would have been done a year ago, not now in the runup to the 2022 midterms. It’s reminiscent of the 2013-2014 prosecutorial attempt to freeze the Wisconsin conservative movement.

In recent days, the U.S. Department of Justice has served upwards of 40 subpoenas on people affiliated with Donald Trump’s 2020 campaign, many of whom continue to associate with or support him.

The reports were first aired by Steven Bannon, and confirmed at least in part by attorney Harmeet Dhillon:

The NY Times and other mainstream media have confirmed (with glee) the large number of subpoenas, including phone seizures:

Justice Department officials have seized the phones of two top advisers to former President Donald J. Trump and blanketed his aides with about 40 subpoenas in a substantial escalation of the investigation into his efforts to subvert the 2020 election, people familiar with the inquiry said on Monday.

The seizure of the phones, coupled with a widening effort to obtain information from those around Mr. Trump after the 2020 election, represent some of the most aggressive steps the department has taken thus far in its criminal investigation into the actions that led to the Jan. 6, 2021, assault on the Capitol by a pro-Trump mob.

The subpoenas themselves are extraordinarily broad, seeking communications with dozens of people. So one subpoena to one person actually implicates dozens of people. Redstate published one of the subpoenas, along with the threatening cover letter:

Assume, for the sake of argument only, that such subpoenas were proper and necessary to investigate alleged crimes associated with the January 6, 2021, Capitol Hill riot. That’s a big assumption, but it proves the point, which is why now, some 18 months later?

If these subpoenas were so necessary to the investigation, why did DOJ/FBI wait a year and half until we are in the thick of the runup to the midterms?

These subpoenas are a big freeze not only on Trumpworld, but conservative and Republican worlds. When people know that dozens are being subpoenaed by the feds regarding hundreds of people or entities, people stop talking to each other and engaging in perfectly lawful political activity out of fear that they will be next. Lawful political communication with the wrong person could find you on the receiving end of a DOJ subpoena and FBI home visit, or as just happend to Mike Lindell and others, being confronted on the street or in public by FBI agents.

It’s a way to shut down a political movement without having to arrest, indict, or prosecute anyone.

We have seen this tactic before, in the 2013-2014 “John Doe” investigation in Wisconsin where a Democrat prosecutor froze almost the entire Wisconsin conservative movement through subpoenas and police raids to obtain documents and electronics. The Wisconsin Supreme Court eventually shut down the investigation, and later legislation changed the law to stop future abuses, but not before the damage was done. I discused the tactics and impact in this interview:

What happened in the John Doe abuses in Wisconsin was a trial run for what DOJ/FBI are doing now. It’s an attempt to freeze the political movement opposing the Biden administration and Democrats.

What DOJ and FBI are doing in the runup to the 2022 midterms is not legitimate. It’s election interference. If Trumpworld and conservative world and Republican world legitimately were deserving of carpet-bombed subpoenas, it would have been done a year ago, not now.

Question for Professor Jacobson: What should either those being subpoenaed, or the right in general, do about this?

The fact recipients are requested not to disclose the subpoena or their compliance with it, on pain of interference with enforcement of the law strikes rather an alarming note.

Keep silent, and do as you’re told, or else face charges.

    That’s why “warrant canaries” were invented. They’re very valuable, but you have to set them up BEFORE you need them.

      Do you know whether removing the “warrant canary” public disclaimer following receipt of a national security letter or similar government request has been successfully prosecuted as effectively giving notice to the subject of the letter? Do such letters ever specifically address and prohibit removal of such disclaimers?

    How can this be remotely Constitutional? There must be case law on that to the effect that such a provision could only pass muster if under the most dire, exigent circumstances, e.g. with a violent felon under investigation about to flee or commit another crime.

      It is “Constitutional” but is often abused and exercised as an intimidation tactic.

      Properly done ( yes, I know abuse is not the “proper” use), a subpoena can only be truly enforced in secrecy when meeting the extremely high bar of the usual risks ( impeding investigation, destruction of evidence, flight and so forth) TO A LEVEL THAT TRUMPS THE 1st AMENDMENT RIGHT.

      That’s first like the “highest of high” and second subject to an individual trier of fact and their decision.

      Prosecutors know this and will put the language in there knowing 98% of the people don’t have the knowledge or the resources to challenge it or even want to.

      Personally I do not believe what I have seen on these would pass legal muster by a fair judge- but no one has tested it yet

Those corrupt FBI agents need to be indicted if there is ever going to be any hope of cleaning up the Bureau.

    I believe that we need a Federal Department of Internal Affairs with the full power to investigate and prosecute misbehavior by federal agencies and agents. The inspector generals are nothing more than toothless bureaucrats who are extremely limited (as in basically no real authority at all).

    They should shut down “federal law enforcement,” all of it. And make the various departments turn in their firearms and sell any ammunition they’re holding on the open market.

      – Stomping on people’s Constitutional 1A Right when they oppose the seditious and treasonous party is acceptable to you?

Aside from the aforementioned freezing problem, this looks a lot like an effort to gather up any evidence of 2020 election fraud and hide it behind a “continuing investigation” wall, presumably to be destroyed at a later date. Somebody out there might have real evidence and is waiting to reveal it at a more politically opportune time, best to get control of it now. Why else ask for evidence of fraud in an election whose official narrative is there wasn’t any fraud?

    Honestly, this is really a good thing when looked at objectively.

    First, it shows the real truth that the left is in no way confident they will get away with the effort to steal 22 and 24 ( these are not the actions of confident people)

      Agreed. The plan here seems designed to:
      1. Obscure and delay the scope of the ‘get Trump’ effort across multiple fronts
      2. Disrupt Trump world and the populist right in general shortly before the midterms
      3. Act as a sort of spoiling attack towards the r base and populist right movers and shakers
      4. Intimidate and dissuade folks from commenting, writing articles, funding, campaigning for populist right issues or candidates
      5. Add another series of cuts to DJT trying to get them add up to the proverbial death by a thousand cuts in the feint hope of killing off DJT’s viability as a candidate

          I don’t think they can (If they could use overwhelming force I believe they already would be doing it) and THATS what gives them the real sense of urgency.

    What’s there to explain? It’s a TV station, not some official communication. How are the FBI, the Attorney General, presidents past and president, or the operator of certain voting machines, responsible for an error made by one TV station, and its subsequent correction? Ask the TV station what happened; but it doesn’t have to answer you, because it is not responsible to you and is entitled to report whatever it damn well likes.

        Since the TV station is “reporting” a situation and not an “official source with the authority to speak” – everything on that TV is considered “hearsay” and has virtually zero probative value even if it could be used.

        Plus, all they have to say is it was a system error- cause unknown and that would end it.

It is much worse than even a broad attempt to intimidate and silence the political opposition. The DOJ/FBI complex (if that’s a term) has clearly targeted all attorneys representing Team Trump in the most vicious, overreaching, unprecedented and un-American way.

From Michael Cohen to Rudy Giuliani to Sydney Powell to Jenna Ellis, and more: the message is being sent loud and clear that if you, as an attorney, represent DJT or his businesses, you will be targeted by criminal proceedings, including being SWATed by armed FBI storming down your door. Unfortunately I’m waiting for the first family dog to be killed, or worse.

Can you even imagine what that must be like to have your door broken down in the predawn by armed agents for the “crime” of giving legal counsel to a President or ex President?

Any communications with your client will be swept up, perused by hostile government prosecutors, and selectively leaked. Your reputation in the legal community will be ruined.

They are directly attacking the right to counsel, without which there is as a practical matter no due process, or rule of law. And the silence of the co opted organized bar (ABA, Civil Liberties Union, State bar associations) is absolutely deafening. Our legal institutions are failing us at the moment their expertise, and courage, are needed the most.

The highest elected office holding GOP ‘leader’ has had little or nothing to say about any of the DOJ/FBI Gestapo tactics over the last 18+ months.

Every GOP Senator should be loudly denouncing these unconstitutional tyrannical abuses of power every single day. But, instead, we hear crickets.

The GOP will probably take the House and may take the Senate, but how much difference will it really make? I’m not optimistic with the likes of McConnell and McCarthy in charge. If history is any indication we’ll only see a temporary throttling of our descent into rule by a lawless, extremist, and radical leftwing regime that can no longer be voted out of power.

    Merely taking the House can make a huge difference in a way that the Democrats truly fear. The Rats know we are at the end of an economic cycle and a recession looms. They know a bad recession spells death for the President’s party in 2024. They can only stave off recession by ever escalating reckless federal spending. A GOP House can’t do much else, but it can cut off the spending spree. A GOP House and even a 1 vote majority in the Senate can hold the line much better.

    We will never be able to conclusively prove that level of fraud because of the secret ballot. The only thing provable is they changed the rules, often illegally, in ways that facilitate fraud.

      They changed the rules in a way that should be actionable-the rule changes violated the Constitution’s requirements that the laws governing state elections for president come exclusively from the states’ respective legislatures, and not from their governors, secretaries of state, election commissioner, judges, etc. The electors of every state that violated this requirement should have been rejected, leaving neither candidate with sufficient electoral votes to win, throwing the election to the House of Representatives.

      Was there fraud? Almost certainly. Can it be proven? Doesn’t matter! The matter of “fraud” has been a red herring, distracting attention from the demonstrable and obvious lawlessness that ruled the 2020 election.

    Close but let me take you closer- part of it is conversational semantics versus legalese.

    Proof and evidence are different and not interchangeable.

    They are more like a “ballot” cures and becomes a vote

    Evidence becomes “proof” once it is vetted and tried.

    The left KNOWS the election was stolen ( they did it) and thus “proof” exists and they always have known this.

    They want to know what EVIDENCE these people have which may be used later.

    That’s why all the talking heads pick their words carefully and stalled the INVESTIGATIONS because “investigations” yield EVIDENCE which is vetted and tried thus becoming PROOF.

    They cut off the “proof” at the roots ( evidence)

    Now they realize there is a strong chance they will lose and some of this “evidence’ may wind up becoming proof and then out comes the gallows.

The idea that the seat of the federal government can subpoena citizens of the several states would have made the Founders apoplectic. The reason the Executive branch has US Attorneys throughout the country is a hat tip to federalism. If a New York resident is suspect, then a grand jury of his peers is empaneled in New York. I can’t imagine grand jury duty in Florida would have result in enough brain dead progressives showing up to indict Donald Trump. But in DC…

The Supreme Court should once and for all put a stop to the residents of Washington D.C. having outsized subpoena power over the entire country.

The problem with these brain dead morons running the country and Justice system is this: the only thing these raids have accomplished is to steel our resolve to vote these communist authoritarians out of DC and do everything non-violently possible to remove and defund all the unconstitutional “alphabet” agency’s.

The receipt of this letter proves I am under criminal investigation, so therefore I must respectfully refuse to testify by asserting my Fifth Am. right. In addition, all of the documents requested would have been passed to me by email, and since Google archives these things forever and I’m obviously under criminal investigation, your subpoena to Google has obviously captured every document requested and more. As to requests for my text messages, I unfortunately upgraded my phone this year and every one of my texts vanished. I’m as upset about it as you undoubtedly are, so when you get the phone company to produce them, please send me a copy.

Leftists on Twitter have assured me–loudly and angrily–that Jan 6 was an insurrection. Apparently the mighty federal government was going to be overthrown by:

1) Mr Haney (old person pop culture reference; if you don’t know it ask your grandparents). (Leftists insist Trump is a dumb huckster, and then in the next breath will declare he’s an evil genius criminal mastermind.)
2) The My Pillow guy
3) A guy wearing a hat with horns on it.

    Yep, dedicated Leftists on Twitter will always lock up in a logic loop if you ask them a pair of questions
    1) Revolting against the US is futile because they have F-15s and you just have AR-15s
    2) The US was nearly overthrown on 1/6 by a guy in a viking hat.

Does what is happening right now tells us civilians that the judicial system is comprised as well??? It seems that you can get a fill in the blank subpoena for whatever you might find then just fill in the blanks–then use it to convict me of any crime you think I might have committed—and then I am required to incriminate myself???.

Dems can read the polls on what people think of what they are doing to our country. Just like the last election they are covering their bets.
