I have a STRONG SUSPICION that the overwhelming amount of both Democrats and the GOPe/RINO had no knowledge ( fore) or input/approval into this action.

Also, the “empty safe” and his “prosecutorial misconduct” comment leads me to believe POSSIBLY Trump was tipped off and set a trap of his own.

The Democrats- I can easily see many of the “non radical” elements in total shock/awe and disbelief and realize the monster is now out of control. The GOPe/RINO- The G/R class lives in the realm of “controlled opposition” ( that’s their income stream). The left just showed them in no uncertain terms that they will do anything. This will tell the G/R class that when they no longer need “controlled opposition” because the left is now the DICTATOR- they will then become a threat and eliminated.
Do not be surprised to see a LOT of people all of a sudden have both a wake up call and a reality check.
Some of this surprise and outrage is very likely genuine. ( obviously not all)

Have to admit, the reporting of an empty safe had me wondering if Trump was tipped off. I mean, who has a safe in their house in which they keep nothing at all?
I have many safes in my house. Some of them have things in them, others do not.
Lots of people who have a safe, don’t have anything in it. If the safe has been there a long time/from a prior owner, typically, they just cost too much money and are too heavy to easily remove and dispose of unless you absolutely have to. So they just sit there, empty.
Not just empty, but it was a brand new safe, for which they brought a special safe-cracker.
I suspect one indictment of Trump ha already been prepared over the records act, and it didn’t really matter whether they found anything yesterday or not. The boxes they grabbed are going over to other prosecutors in NY state and Fulton County as well as the J6 investigators. You have to assume that all efforts to get Trump are working together, and federal prosecutors are working with the state level ones to grab material housed in another state they could never grab themselves.

The POTUS is the end all final absolute authority on classification. ( there is no other and POTUS doesn’t have to ask permission) This is not something another President can revoke or undo either.
Regardless of what they found, all Trump has to do is “”say” he declassified it and the case is moot. (people who have never had security clearances may not understand how this works)
There is no lawful requirement for documentation, following a process or anything else.
So, they are not going to indict on this because even if they bought off a judge to start an indictment- this case ( based on the classification of documents against POTUS) is stillborn.
Yet they did it- that’s what leads me to believe this is a fear induced knee jerk reaction with a tight group of people for “something” because no prosecutor in their right mind would do this specific case.
There is a requirement for documentation – on the declassified documents, themselves. There are consequences for not marking classified information properly. That would have to be where their hope lies.
He may not be prosecuted over classification. That as too murky, as you say. No, they will prosecute over an archive violation and possibly a 1001 for lying to investigators from the Archives. All they have to prove is he retained records that he told Archive investigators that he doesn’t have.

Yes, there are regs for the proper marking of classified material. But if Trump “declassified” the material, the regs no longer pertain to it. There are almost certainly no laws against having possession of unclassified material that’s improperly marked as “classified.”
He’s probably thinking that if they can raid an ex-president to keep him from running, they can do it to an ex-governor, too.
It’s just a defense of Democrats. See specifically his last line about the J6 hearings, which begs the question that the hearings are legitimate in the first place (they’re not).
It’s possible that a random neural misfire actually also got him thinking about how a firebrand Republican administration (stop laughing, it could happen 😛 ) in the future could use the FBI in a similar manner against Democrats. Not that the tactic was wrong regardless of the perpetrator and victim (it is, pure “banana republic” bull droppings), but that he and/or his “team” could be targeted similarly.
Far from being a tweet of support, Cuomo is setting up the FBI to be the fall guy (the raid may “undermine any future investigations & legitimacy of the January 6 investigations”) should the Dems’ efforts fail to prevent Trump from running. He’s worried the raid may have been a mistake by the Dems, he is not condemning it for its effect on our political process or the harm it will do to our institutions, and showing no outrage on principle. He’d be perfectly happy if it was productive and harmed Trump.

Still, Cuomo does seem to recognize the potential for danger in these actions. McCarthy did. His statement was ok, IMO. He recognizes the limits of his current power to do jack squat until the next Congress is seated. He basically said this is bad and the AG needs to get ready for a hostile Congress. We shall see.
Personally, I would advise zero cooperation at this point. No unanimous consent requests, contest every action, pull out every parliamentary procedure to halt the ability of Congress to function. He probably won’t do that.

He said once the Republicans are in power, they’ll investigate, and the DoJ should retain everything. But as near as I can tell, he completely lacks the authority or ability to enforce that until after November.
I’m not sure how that actually helps anything, or why we should expect anything to have actually been preserved come November, short of arrogance on the FBI’s part.

This isn’t the time to parse the words to extract deep meaning revealing anything. It speaks volumes that Cocaine Turtle refused to offer his opinion. That’s what is important. But there are others who should have offered their support who still haven’t. Also, the DOJ has yet to explain themselves too.
Your implied assumption is that the DoJ wouldn’t seek to cover their tracks absent McCarthy’s statement.
The bottom line here is, as tough a pill to swallow as it is, the minority party in Congress doesn’t have much leverage to force anything. That power rests with the Committee Chairs which Pelosi and Schumer control. We can all stomp our feet and scream till the cows come home but it won’t impact that reality.
The most we can expect is non cooperation from the minority party. They have lots of parliamentary options to slow and halt Congress from doing anything. That’s the course of action I advise.
From a budget bill to naming a post office to confirming promotions for Military Officers to any unanimous consent request to the passage of a resolution honoring some kid’s battle with cancer; block everything. Eat up the legislative calender. Seek recognition in the Senate and refuse to yield the floor via a coordinated speaking filibuster until the next Congress convenes.

The DOJ couldn’t care less what McCarthy or any House Speaker does next year. The power to prosecute is exclusively with the Executive Branch. The House can do nothing except request things and make meaningless findings of contempt – which only have meaning if Garland is willing to prosecute himself.
The House has the power to impeach people like Garland. Whether they have the cojones to do so is another question.

I proposed a course of action that is far more aggressive than any in my lifetime and even that, which is at the very limit of what McCarthy and r in the minority could do would be an indirect effort.

When the fed tax code allows anywhere from 24% to 37% of the financial costs of SALT to be removed it is much easier for SALT to rise and remain high. Absent the subsidy it becomes much more difficult because much more of the consequences are borne by the folks who allowed these high SALT to come into existence.

It was just capped, not eliminated, and the standard deduction is pretty damn high now. If it cost you tax money, then you probably own quite a bit of property in a place that you should look to sell away from.

I think there’s another possibility here. Trump tried to declassify documents right before the end of his term. My guess is that there is a smoking gun among those documents, that is VERY problematic for the dems, and that they suspect/know that Trump has a copy of that document. Trump ordered a bunch of documents declassified, the bureaucracy dragged its feet. The swamp can claim the document was never declassified, such that Trump’s copy is a problem. Because the document is classified, they never need to disclose the search warrant (the description would be classified and under seal.) The dems win, they get the document back, create the impression that Trump committed a crime, and never need to admit why they are willing to go so far out of norms. How does Trump get to fight back? Unless he wins the presidency, he doesn’t have declassification authority, and even if he gets to produce the document, would he do that, which would absolutely destroy the country he loves?
As the unitary executive the President, during their term of office, has the power to declassify. Could he do that verbally in an empty room aka no witnesses? Sure.
The real question is would anyone believe that? As a follow on why not simply create a memoranda for record listing the docs declassified, sign it and date it? That is too easy to do and would provide a better basis to support his assertion re declassification. The absence of such a memoranda would be viewed in a negative manner.
Better yet make several certified true copies of the memoranda with witness signatures from the ODNI or other high ranking person in the WH with the appropriate clearance and stash them off site so they are available just in case a scenario like this occurs.
Hell make copies of the damn docs in question, which would now no longer be classified. Release them and the memoranda if the bureaucracy plays shenanigans. Put it all online.

Cuomo just realizes that, as the designated sacrificial lamb, should the Dems need to detract public attention from some future scandal, he would be first in line for an unannounced visit from the FBI.

I would dearly love to see the probable cause documentation which this warrant was based on and of course the warrant itself.
Somehow I suspect that the warrant was as general as “Go search Trump’s house for anything we can use”.
