Prosecutor Who Went After the McCloskeys Pulls No-Show for Murder Trial Forcing Judge to Free Killer

Prosecutor Who Went After the McCloskeys Pulls No-Show for Murder Trial Forcing Judge to Free Killer

“Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.”

Kim Gardner, the left-wing circuit attorney in Missouri who aggressively went after the McCloskeys for defending their home from a BLM mob, failed to have anyone from her office appear in court for a recent murder trial.

The judge let the killer go. Why are people putting up with this?

Elliott Davis reports at FOX 2 in St. Louis:

Judge drops murder charges after no show of prosecutor from St. Louis Circuit Attorney’s office

St. Louis Circuit Attorney Kim Gardner is under fire after a judge drops murder charges against an accused killer.

The unusual move came after the prosecutor from Gardner’s office, who was assigned the case, didn’t show up to court. Now the chairman of the St. Louis Aldermanic Public Safety committee wants to call Gardner in front of his committee to explain the incident.

Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.

The judge noted in his order that the prosecutor who was assigned to the case was on maternity leave for three months and said the office hadn’t replaced her.

The judge sharply criticized Gardner’s office for the mix up saying, “The Circuit Attorney’s Office has essentially abandoned its duty to prosecute those it charges with crimes.”

A spokeswoman for Kim Gardner admitted a big mistake was made saying in a statement: “Upon review of our internal policies and procedures regarding Family Medical Leave, we have determined that corrective measures are needed to further prevent any future repeat occurrence of the incident in question.”

Here’s a video report:

As you can probably imagine, the family of the murder victim is pretty upset.

KSDK News reports:

‘Kim Gardner is a poor excuse for a prosecutor’: Family of murder victim outraged after charges dropped, suspect freed

Family members said they haven’t heard anything about the case from anyone other than homicide detectives.

Moore’s sisters say Gardner’s inaction on their brother’s case is inexcusable and they learned the suspect was free from the I-Team even though state statute requires prosecutors to keep victims’ families informed of the developments in their loved ones’ cases.

“Why was it so hard to pick up the phone to call to let us know what was going on?” asked Cierra Moore, Randy Moore’s oldest sister.

Our investigation also found the number of cases getting dismissed since Gardner took office just five years ago has doubled.

And re-filing the charges in this case offers little comfort to Brandy Veasley, another one of Randy Moore’s sisters.

“Kim Gardner is a poor excuse for a prosecutor,” she said. “It’s not fair.

Just a reminder from the Washington Examiner, emphasis is mine:

2016 was also the year the city elected Kim Gardner as circuit attorney for St. Louis, the first black top prosecutor for the city. Gardner’s campaign was heavily financed by left-wing billionaire George Soros as part of his broader strategy of placing Democrats who vow to reverse “tough on crime” policies in top law enforcement positions.

Every progressive DA with those fingerprints on their campaign should be voted out of office, ASAP.

The Dems don’t play by the Marquess of Queensberry Rules, why should we? The Ds are evil, having no qualms in pounding us with kidney punches and with punches below the belt.

For too long we’ve been entirely too decent in what is a fight-to-the-death. Pols like Mittens Romney don’t have fire-in-the-belly; there are far too many Rs who are just useless.

First off if you think any of your words hurt these people you’re wrong. They say that they hurt them so that they can get rid of you but they don’t care what you have to say. Second off what’s the point of fighting these people if you’re just going to end up becoming them? If you’re not different from them why the fuck should I fight on your side and not fight both of you? I don’t want the world to become a conservative version of SJW‘s anymore than I want SJW‘s. Why do you?

Antifundamentalist in reply to pfg. | July 22, 2021 at 8:39 pm

As I have explained to my children: Ad hominem attacks do not add to the conversation. They are often employed as a distraction technique by people who either have nothing of value to add, or who are attempting to derail or distract from the valid points being made in an arguement. When people do this, you should always treat them with disdain and suspicion because they are trying to distract you. Just because “they call us names” doesn’t make it okay. Not taking part in meaningless name-calling makes you better than those that do it.

CommoChief in reply to Antifundamentalist. | July 23, 2021 at 9:56 am

Ok, sure. We don’t have to respond with name calling, but we can’t pearl clutch either.

If you wake up to find yourself in an illegal gambling hall, forced to play in a crooked dice game with loaded dice….you don’t have to keep playing because it’s polite.

Killing the crupier, grabbing your money and running for the door is an acceptable option under the circumstances.

Antifundamentalist in reply to Antifundamentalist. | July 23, 2021 at 4:50 pm

Pearl clutching is about as useless as name calling. You will get no arguement from me on that point. It’s not about “being polite” either – The point is keeping things relevant and keeping the discussions concise, relevant and on point – don’t give the opposition anything to hide behind or use as a distraction.

CommoChief in reply to Antifundamentalist. | July 24, 2021 at 11:41 am

          AF,

Perhaps simply be willing to recognize that the ad hominem name calling is the end of reasoned debate and the prelude to violence.

Reason, debate and discussion having ended, then it’s an appropriate time to employ more direct methods of persuasion; force.

In a sane society, she would be held to account but we live in a society taking a knee to totalitarianism.

Exodus is the agenda: They want to drive opposing voters out of these cities and states.

Better to rule in hell than be out of power. I watch year after year as Seattle and Washington have descended into madness and all the while the elections have gotten less and less close and the ruling party has become worse and worse.

You get what you vote for.

Do you really believe this dumbass was elected by electorate and not a voting machine?

    nordic_prince in reply to txvet2. | July 22, 2021 at 4:11 pm

2020 should have sounded the klaxons that with rampant election fraud, you can’t just sit there and smugly pronounce “Well, you get what you voted for.”

They can cheat with impunity, and nobody – not D, not R, NOBODY – does a damn thing about it… because they ALL have a vested interest in not upsetting the apple cart.

We the People are screwed, and it’s increasingly looking like there is but one remedy to end this long train of abuses and usurpations.

      txvet2 in reply to nordic_prince. | July 22, 2021 at 8:17 pm

What evidence do you have the Republicans are also engaging in rampant election fraud? Every suspicious election result I hear about benefits the Democrat candidate, not the Republican.

        Ever hear of “RINOs”?

They talk a lot, but when push comes to shove, the Rs have the spine of a jellyfish.

The Swamp is equal opportunity, non-partisan. Just as many Rs as there are Ds.

The reason why election reform/voter integrity legislation never goes anywhere is because neither side actually WANTS to change.

Why would that be, do you suppose?

Milhouse in reply to randian. | July 23, 2021 at 10:41 am

What evidence do you have the Republicans are also engaging in rampant election fraud? Every suspicious election result I hear about benefits the Democrat candidate, not the Republican.

That’s not true. There have been some notorious cases of fraud by Republicans. There was the congressional election in NC that was actually overturned because the Republican was caught red-handed. And just last month it appears there was major fraud in the R primary on Staten Island, which may result in a similar outcome.

Danny in reply to randian. | July 24, 2021 at 2:58 pm

What evidence do you have of rampant election fraud at all?

Neither side is doing it, I support election integrity measures hopefully they will assuage your fears but that is what those are a solution to.

2020 Republicans won nearly every swing district and in GA won a plurality of the vote while narrowly winning a set of swing state despite the fact that the popular vote favored Biden by 7 million votes.

Following the election when Trump decided not to accept defeat and his message to the people of Georgia was the state election was rigged (which means don’t vote) Republicans reacted to that message by refusing to vote turning over control of the senate to Joe Biden who is appointing judges at a higher rate than Trump did.

Want to hand them future elections to empower them more keep beating the fraud claims.

I hear that someone seems to have forged the mommy-prosecutor’s signature onto the documents for charging in this case — while she was out on leave.

Call me George, ’cause I am kinda curious as to WHY someone would do that.

That is a crime. Each signature is a seprate crime.

    CommoChief in reply to Capsaicin_Addict. | July 22, 2021 at 5:13 pm

Supposedly the Attorney who was on maternity leave had her electronic signature forged onto 28 cases all while she was on leave. She is said to have resigned this morning.

stevewhitemd in reply to CommoChief. | July 22, 2021 at 8:37 pm

There’s a lot of questions there.

Did she “have” her signature forged? That is, did she tell someone in the office to apply her signature? If so, had she read the documents (have to do something in-between nursing the baby) and was okay with this? If she didn’t read them then why apply her signature in abstentia?

Or did she not “have” her signature forged, and thus these are real forgeries? In which case, why is SHE resigning?

    henrybowman in reply to Capsaicin_Addict. | July 22, 2021 at 7:13 pm

What I’m curious about is why whomever it was that went through the trouble of forging her signature because she wasn’t around, didn’t also take steps to scare up a replacement for the trial because she still wasn’t going to be around. Talk about doing a half-assed job.

Another Voice in reply to henrybowman. | July 22, 2021 at 7:51 pm

The signature applied was a password coded electronic one to be used only by the
      signatory.
Did she process the signature off site, as so many are working off site? or Was it authorized by the owner to be shared in her absence? Or was it like so many other things going on in todays tech world, hacked and used by someone else in her department? So many unknowns at this time, but her resignation might mean there is knowing knowledge by someone as to what actually took place during the “Leave of Absence”.

GeorgeCrosley in reply to henrybowman. | July 23, 2021 at 4:06 pm

Whoever, not whomever. You want the subjective case here, not the objective.

MamaMOB in reply to henrybowman. | July 30, 2021 at 10:56 am

      Seeing not sing

Actually other stories are saying that they forged her digital signature on 20 DIFFERENT cases that she was ‘assigned’ to.

As to the why? Because the person doing it is a total moron and is too stupid to actually anticipate what would happen. The lead prosecutor effectively bought her position with Soros money, and from all appearances she’s frighteningly stupid and incompetent. She probably just assumed that the court would just push everything back when the maternity one didn’t show up and nobody would ever know.

I mean dim bulbs have been doing similar things for a while. We had somebody punch their brother’s time card while just left on a vacation without telling anybody. They were both stupid enough to think nobody would actually notice that they were paying a guy that hadn’t shown up for a week. So yes, people this stupid DO exist.

Hi George, because I’m curious about this too.

Looks like Gardner may have yet another problem – a problem of forgery.

https://pjmedia.com/instapundit/463228/

Unfortunately Gardner has seven things which will keep her in power permanently:

1. She has a “D” after her name.
2. She is black.
3. She is female.
4. She has a ton of Soros money backing her up.
5. The Joseph Goebbels media loves her and won’t touch her.
6. Her constituents are stupid and love pain and misery.
7. Even if the proles wised up and decided to remove her, the Communist Party voting fraud machine will save her.

Like Newsom, Cuomo, and a host of other Communist satraps in deep-blue hellholes, Gardner will stay or go only on the say so of the Communist Party.

The only thing that keeps this incompetent psycho in office is voter fraud – automated voter fraud.

The presence of a voting machine at any election poll is de facto fraud.

Your not up to speed on Seattle.

A judge was forced out for slamming the elected prosecutors for letting criminals off easy. I was amazed at the coordinated effort whereby every other judge fell in line with the city’s madness and so the one judge who said you can’t let these habitual offenders “off” was pushed out.

I don’t know if the Seattle prosecutor’s office belongs to Soros or not, but it might as well.

Possibly. But it is undeniable that many people will voluntarily vote for someone like Gardner BECAUSE she is a black racist seeking to undermine the rule of law. White leftists will vote for her in order to virtue signal and “feel good about themselves”. Many black voters will vote for her because she bring the promise of getting sweet REVENGE on hated non-blacks.

In many important ways the “civil rights movement” has become indistinguishable from the KKK of the past. Race-based justice, Bull Connor-style politicians who have black skin, fashionable racial hatred in Hollywood and sports, racist violence – we now have all the evils we thought we got rid of. The NAACP and others have successfully turned the clock back to the bad old days.

JFK once said that those who make peaceful revolution impossible make violent revolution necessary.
Once America devolves into a society where the only recourse is the hollowpoint impeachment, Democrats will have nobody to blame but themselves.

“The judge let the killer go.”

He will be arrested as soon as he kills again.

I pray that such incidents occur more widely and at an ever increasing pace. It is only when these malignant mutants start knocking down our doors that………

Gateway Pundit reported yesterday that the prosecutor who was on maternity leave resigned because her leave actually started before she was assigned to this case. Someone allegedly forged her digital signatures on court documents submitted in 20 cases while she was on leave.

henrybowman in reply to Idonttweet. | July 22, 2021 at 7:19 pm

I’m not following this. The woman was put on leave; they some yutz in her office assigned her a case; then some yutz (possible the same yutz) forged her name on case documents, then some yutz didn’t bother to reassign the case to an active prosecutor for trial purposes… and she resigns?
    What did she do wrong?

Idonttweet in reply to henrybowman. | July 22, 2021 at 11:23 pm

The only thing I can think of is that she doesn’t want to be associated with an office so corrupt that they would forge her name on court documents. From the article:

Kim Arshi began her maternity leave May 10. But her electronic signature
appears on 28 cases in court documents listing her as the lead prosecutor –
even though she was not in the office and did not sign them herself, according
to a source familiar with the cases.

To protect her future career prospects, she didn’t want to be tainted by Gardner’s stench of incompetence and corruption.

I looked up the accused killer and the victim, both are black men. Does anybody think the prosecutor would have been a no-show had the accused killer been a white man?

Looks to me like further proof that the leftists/marxists like this Gardner could care less about black on black crime.

“Does anybody think the prosecutor would have been a no-show had the accused killer been a white man?”

I’m not going to tell you what I think. That’s too dangerous. I’m gonna take CRT and let them tell me what to think.

The University of St. Louis must be proud that they awarded a JD to this woman. Can anyone explain why she hasn’t been disbarred? Does the legal profession have no shame or no standards?

stevewhitemd | July 22, 2021 at 8:43 pm

From the article:

… former prosecutor Jerryl Christmas, who worked for Gardner’s predecessor, thinks otherwise. He’s a spokesman for the organization representing Black attorneys called the Mound City Bar Association. Christmas says the judge didn’t have to release the accused killer back on the streets, but instead could have just continued the case.

Mr. Christmas, sir, I don’t it works that way. The defendant, even an odious gang-banger jugged for murder, is entitled to a speedy trial and to due process at each step of such trial. If the state can’t be bothered to show up, it’s a demonstrable harm both to the defendant and to the rule of law simply to continue the case.

I don’t like releasing suspected murderers, but I like even less violating due process.

stevewhitemd in reply to stevewhitemd. | July 22, 2021 at 8:44 pm

Mr. Christmas, sir, I don’t THINK it works that way.

Now explain the “speedy trial” requirement to the 1/6 “insurrectionists.”

Milhouse in reply to stevewhitemd. | July 23, 2021 at 10:58 am

It’s not just that the state didn’t bother showing up. It’s that the state ignored repeated court orders for discovery. It’s like nobody was reading the judge’s email messages; but he sent a deputy to hand-deliver his latest order and it was still ignored.

Can charges be refiled? This is described as a no-show for a trial, not a preliminary hearing or voir dire. I thought that once the trial starts jeopardy attaches.

part of his broader strategy of placing Democrats who vow to reverse “tough on crime” policies in top law enforcement positions

So, it looks like everything is proceeding according to the plan.

Well it actually says she failed to show up in court. Other stories say that she didn’t show up for ‘hearings’, which I assume are pre-trial.

It sounds like the defense was filing motions that required pre-trial hearings, and the prosecutor simply didn’t show up to those hearings, and the court was sick of their shit.

Theoretically they CAN re-file charges, but the defense will obviously raise the very reasonable objection that they have been denied their right to a speedy trial.

The vile and callous Dhimmi-crat apparatchiks simply don’t care about the safety of law-abiding, taxpaying citizens. Their attitude perennially is that it will be someone else’s father or mother, sister or brother, son or daughter, who will bear the consequences of criminal violence; thus, no need to evince any concern.
