Last week, a New York Times report confirming the Obama Administration’s FBI and DOJ spied on the Trump campaign confirmed the worst fears and suspicions of those following the endless and thus far, fruitless crusade to prove some kind of Trump/Russia collusion.
Sunday, Trump said he would ask the Department of Justice to investigate “whether or not the FBI/DOJ infiltrated or surveilled the Trump Campaign for Political Purposes – and if any such demands or requests were made by people within the Obama Administration!”
Monday, Trump did just that. The DOJ has granted the Inspector General broader authority to “include any irregularities with the Federal Bureau of Investigation’s or the Department of Justice’s tactics concerning the Trump Campaign,” said WH press secretary Sanders.

The Department of Justice will allow Congress to review highly classified requested documents relating to the FBI’s investigation into the Trump 2016 campaign in conjunction with the White House and other agencies, White House press secretary Sarah Huckabee Sanders said Monday.
“Based on the meeting with the President, the Department of Justice has asked the Inspector General to expand its current investigation to include any irregularities with the Federal Bureau of Investigation’s or the Department of Justice’s tactics concerning the Trump Campaign,” Sanders said.
“It was also agreed that White House Chief of Staff Kelly will immediately set up a meeting with the FBI, DOJ, and DNI together with Congressional Leaders to review highly classified and other information they have requested,” she continued.
President Donald Trump met with Director of National Intelligence Dan Coates, FBI Director Wray, and Deputy Attorney General Rod Rosenstein Monday afternoon to discuss Congressional requests. Conservative lawmakers have pressed the DOJ for weeks to turn over highly classified documents relating to the FBI’s 2016 investigation, particularly to discern abuse of power or the use of a confidential informant to infiltrate the campaign.
The suggestion or even concern that the FBI may have been used against a presidential candidate has been dismissed by our self-professed intellectual betters as little more than conspiratorial kookery, and yet…
It was briefly mentioned in the NYT report that the espionage revelations (though the NYT referred to the FBI’s spying as ‘informing’) were being tossed out ahead of a damning yet-to-be-released IG report. If they thought the final IG report would be damning before, it’s probably not going to get any better with greater authority to dig deeper into the FBI’s Crossfire Hurricane.

UNLIKE the Mueller ‘investigation’, which is purely political, where leaks are to be expected, Sessions has appointed John Huber from Utah to work as DOJ prosecutor with IG Horowitz, THIS investigation is criminal, not political- no leaks.
Give the benefit of the doubt to Sessions, allowing him to avoid key responsibilities and events, after his actions of the past year? That’s a losing strategy.

If all of this is true and the Ds were trying to deprive Trump the opportunity to run an effective campaign, would Trump have any sort of legal action against the people involved. For example doing that would be a direct interference with Trump’s constitutional rights of free speech and to petition government for a redress of grievances. I’m sure other violations could be addressed. And the officials would not be able to hide behind the Federal Torts Claim Act and therefore get immunity.
I remember a case called Bivens in the early 1970s that said such a complaint could go forward even though Congress did not have a federal counterpart to section 1983.
And if state officials involved, for example, election officials in the very blue states, Trump could sue them directly under section 1983, and they too would not have immunity because depriving a citizen of statutory and/or constitutional rights is never within the scope of an official’s duties.
