Sheriff Sues Woman for $1 Million After She Allegedly Falsely Claimed ICE Detained Her for Two Days
“These allegations are serious, but they are not supported by evidence,” Sheriff Dale Schmidt says. He is seeking millions in damages to clear his name.
A Wisconsin sheriff filed a defamation lawsuit against a Chicago-area woman who claimed immigration officials detained her for almost two days, both at ICE facilities in Illinois and in the Badger State.
In reality, Sunny Naqvi allegedly was hanging out at a hotel and even going to the spa, according to evidence presented by the law enforcement official.
Dodge County Sheriff Dale Schmidt also released extensive evidence on Friday that debunks claims by Sunny Naqvi, who claimed to be a victim of unlawful ICE detention.
The county sheriff’s office has maintained since the ruse began last month that it never held her in detention, despite her claims. Naqvi’s allegations were also quickly amplified by left-wing politicians in Illinois.
Naqvi originally claimed she spent two days in detention after flying into Chicago’s O’Hare airport on March 5, following a trip to Turkey, as Legal Insurrection reported last month. The woman, who lives in a Chicago north suburb, alleged that DHS brought her first to the Broadview Immigration and Customs Enforcement facility just outside of Chicago and then took her to another location in Wisconsin.
Those claims began to fall apart, as even left-leaning news outlets challenged her account. Supporters pointed to cellphone data, which allegedly showed her in the various locations – but that was faked, too, Sheriff Schmidt says.
He said that she used “widely available tools that allow a user to set a false location, causing apps like Find My, Snapchat, or Google Maps to display a place the person is not actually at.”
The lawsuit also names Cook County Democratic Commissioner Kevin Morrison, who boosted Naqvi’s claims. At the time, Morrison was running in the Democratic primary for the 8th Congressional District, a race he lost.
Ten other unidentified individuals are also named as defendants. Schmidt seeks $1 million in damages against each of the defendants.
Sheriff Schmidt defended his agency amidst the unfair criticism.
“Video footage, license plate reader data, and timeline analysis confirm her travel from Illinois to Wisconsin occurred near the end and after the alleged detention period and was not the result of law enforcement transport,” his office stated in a fact sheet.
“These allegations are serious, but they are not supported by evidence,” he said. “We have reviewed the records, we have established the timeline, and the facts are clear—this did not happen. Our responsibility is to ensure the public has accurate information and confidence in the integrity of law enforcement.”
Naqvi’s account drew skepticism from the beginning, especially after the Department of Homeland Security released photos showing her leaving a Customs and Border Protection holding area at O’Hare Airport after about an hour, on her own accord.

The company she claimed to work for also said it did not employ her.
The liberal Chicago Tribune also reported that Naqvi previously served two years on probation to end accusations that she falsely accused someone of sexual harassment.
Legal Insurrection pointed out last month that her sister used a telltale line of hoaxers when pressed for verification on Naqvi’s claims.
“She doesn’t want this to be about her. This is about everyone illegally detained,” Sarah Afzal, her sister, said as questions were raised.

I’m skeptical of the lawsuit’s chances. She never named the sheriff as having done anything wrong to her. She defamed ICE by falsely claiming it wrongfully arrested her and brought her to the Dodge County jail. But even supposing her story to have been true the sheriff would have had no reason to suppose holding her was unlawful. If asked why you held this woman he would simply say ICE brought her to me and asked me to hold her; I naturally assumed she was lawfully in their custody. Therefore her lie did not defame him.
As for ICE as an agency, it can’t sue her. If she had named individual agents, or given enough information that they could be easily identified, then they could sue her, but she didn’t. She just spun a false story to cover up a weekend with her boyfriend, whom her family probably didn’t know about.
Yeah this is unlikely. Also the damages would be difficult to prove.
I don’t think that there is actually expectation of winning, and even with a win, there would be no money collected. This is the “Trump trend” of Make the bastards think twice before shooting off their mouths

I was going to comment on the lack of anything in the story linking to any actual defamation. I have, so far, only found one story that actually makes the connection, and then not obviously.
The key is here:
So, one of the claims she made was that the sheriff (the guy suing) and his office detained her as part of this strange plot against her. Then, her attorney (and lefty running for office, natch) called the sheriff a liar for denying it. Yes, her (and his) lie did defame him.
I think this is a great way to go after these folks, since it appears judges and juries won’t throw her in the slammer where she claims to have been for false claims.
The sheriff might not prevail, but he is helping to put these liars on notice.

Defamation of whom? ICE can’t sue for defamation no matter what anyone says about it. And she never accused the sheriff of taking her into custody.

Tawana Brawley’s big mistake was in identifying Steven Pagones as one of her imaginary rapists. Had she stuck to her initial vague statement that the rapists were all white and at least one of them was a policeman, Pagones could not have sued her when her lie was exposed.

Even if the lawsuit is dismissed… the legal process is punishment… She deserves it.
It sur would be nice if the articles/posts about this incident would state on what grounds he is suing. And I don’t mean “defamation.” I mean, what defamation. I got it figured out from the NY Post article (which Ace of Spades was a good enough blogger to post). But not even that article says “He is suing because she claimed to have been unlawfully detained in his jail.” Nor even “And Morrison is included because he called the sheriff a liar.”
Why not actually write that out, instead of some breathless bit full of information irrelevant to the actual suit? Because he can’t sure her for lying about ICE or CBP.

That she falsely claimed to have been detained in his jail is not defamatory, and it’s not about him. To defame him she’d have had to claim that he personally knew she was being held unlawfully, and was personally involved in holding her unlawfully.
As for calling him a liar, did she personally call him that? In so many words?
Morrison has a clear pass on actual malice. He was speaking on his client’s behalf, and believed what she told him.
Not his client, but still. He says he believed her, which is enough to combat actual malice.
It certainly is about the office he holds.
How is that relevant? The office can’t sue for defamation. Only he personally can, for any knowingly false and defamatory statements that she or Morrison made about him. But she didn’t say anything about him; merely saying that she was held at his jail is not about him and is also not defamatory; and on top of that he’s a public figure so to sue Morrison he’d have to prove that he knew it was false,
I’m wondering what her immigration status is, and if Secretary Rubio is on the case on having her deported.
All the reporting since the beginning of the story has said she is a US citizen.

Other reports say that she stayed at the hotel and got the spa treatments for free. Who paid for them? Why was she at the hotel in the first place hanging around? Unless there is more to the accusations and story I doubt the lawsuit will go anywhere.
No one gets free spa treatments or free food. Either she paid for an all-inclusive package, or her boyfriend was paying.
Someone was and it would be interesting to see who and just who concocted the entire story she rolled with.
Like Tawana Brawley, she concocted the story to cover up spending time with her boyfriend. Her family probably didn’t know about him.
The left has made it a practice to destroy (metaphorically) anyone or anything that involves itself with ICE, or any immigration control efforts. Many cities, counties and even states have prohibited custodial institutions from holding ICE detainees, even when ICE is paying good money for the beds. Some small jurisdictions have had to trim staff and/or reduce services to cover the loss of the ICE revenue.
By making the claim –false claim it turns out — that she was detained at his jail, she set the stage for the entire department to become a target for the anti-ICE hysteria. The MSM broadcast the claim that she was “illegally detained” at this jail setting the stage for problems for that department. The the denials were met with statements impugning the sheriff’s integrity.
The case will be tough to prosecute if the sheriff cannot provide some negative outcome to him or his department as a result of the false claim.
The reputational cost is sufficient. Nobody reads retractions. God forbid anyone takes responsibility for their own actions.
It has to be to him, not to the department. Government departments can’t sue for defamation.
