VA Gov. Spanberger Won’t Honor ICE Detainer for Illegal Alien Accused of Murder

The Virginia governor demanded that the Department of Homeland Security obtain a judicial warrant.

Virginia Gov. Abigail Spanberger faces criticism after saying she won’t honor an ICE detainer for the illegal alien accused of murdering a woman at a bus stop.

Spanberger to DHS: Get a warrant.

Abdul Jalloh, 32, allegedly stabbed to death Stephanie Minter, 41, at a Virginia bus stop.

He previously faced “rape, malicious wounding, assault, identity theft, contributing to the delinquency of a minor, assault, and pickpocketing” charges.

Jalloh, an illegal alien from Sierra Leone, entered the U.S. in 2012.

The government issued a final removal order in 2020!

Spanberger’s office claimed the governor “firmly believes that violent criminals who are in the United States illegally should be deported by immigration enforcement.”

The governor demanded that the Department of Homeland Security obtain a judicial warrant.

Bill Melugin reminded Spanberger that ICE only needs to receive a warrant if the illegal alien is a federal judge finds probable cause that they committed a federal crime.

Nick Minock of WJLA, who always does an excellent job, released a video:

So right now, ICE lodges detainers. Those are notices to local jails saying, “Hey, we want to come pick up this individual so we can proceed with immigration consequences.” It might be deportation, might be something else, but Virginia Governor Abigail Spanberger is now requiring ICE to take the extra step to overcome an extra hurdle by going to a local criminal judge to get a criminal warrant, an order for the local sheriff to hand over this individual, who has more than 40 charges against him, an arrest record of more than 30 arrests to get the local sheriff to hand over that individual to ICE. The Fairfax County Sheriff simply could choose to hand this person over to ICE, but Spanberger is saying that ICE should get a signed judicial warrant instead.

DHS accused Spanberger of protecting a murderer.

“ICE does NOT need judicial warrants to make arrests,” DHS pointed out.

ICE lashed out at Spanberger, too:

After this criminal alien serves his sentence for MURDER, Governor Spanberger will release him back out onto Virginia’s streets, saying that ICE needs a signed “judicial warrant” to detain him.

This is asinine and legally illiterate. ICE is empowered by federal law to detain illegal aliens, and state officials like Spanberger are REQUIRED to honor ICE detainers.

Only a month into being governor, and she’s protecting illegal alien murderers. Disgusting.

Michael LaRosa, former spokesman for Jill Biden, couldn’t even believe Spanberger’s position.

“This is completely backwards, unacceptable, and tone deaf for a Democrat in today’s political environment, unless you hail from the Mamdani wing of our party,” LaRosa wrote on X.

LaRosa gave Democrats some advice: “Because right now, if this is true, it fuels a very concerning narrative about the Democratic Party at the wrong time and feels highly disqualifying for any future 2028 VP vetting. This stuff won’t be forgotten (Willie Horton) in 3 years …. and thus far they haven’t been very impressive with the reactive comms, allowing the GOP to brand her nationally, and way too soon in the two months she’s served as Governor.”

He’s not wrong.

If true this is quite the PR debacle by Gov Spanberger. Nobody in the d/prog coalition but tiniest sliver of utter nut job lefty extremists would have been willing to condemn her for allowing ICE to nab this guy!. It could have been spun by her as ‘the exception that proves the rule’. Instead it demonstrates she is in fact one of the extremists and not at all a moderate as she claimed. Especially relevant since tax and spend fiasco in the first weeks of d/prog taking control in VA.

      Well if by ‘her voters’ you mean the 44% ish of the electorate that votes d/prog in lockstep no matter the candidate then yeah. However I suspect the actual Indy/swing voters who got suckered by her ‘I’m a moderate’ claims are not happy with what’s going on in VA. Not very moderate to back raising and implementing dozens of tax hikes or refusing to let the Feds take custody of this guy. Add in the continued movement of Men towards the GoP and especially ‘black’ and ‘latino’ Men and eventually they offset the AWFLs making campaigns more competitive.

        I think independents are very fluid. They could easily go for Spanberger especially the women depending upon who she runs against just because she is a woman and abortion. They might not care about all the tax hikes if they are well off,

        There is another way I think about this, I’m an independent moderate. I never would have gotten suckered by her moderate claims because she ran as a democrat and no democrat is moderate any longer. They are all whacko left on virtually every issue, This makes me think that made people who claim to be moderate are actually virtue signaling with their status. In no way can a true moderate easily swing between Obama Biden and Trump.

          I kinda agree with you about ‘moderate’ and ‘indy’ being used as camouflage for leftists. I would point out that there’s been several deep dive studies to figure out the phenomenon of Obama voter in ’12 voting for Trump in ’16 and beyond. The estimated number is 8 million of them. Not an insignificant group. They tend to be socially conservative but hold what’s described as ‘progressive’ economic views but I’d call them center/left populist. There’s a great deal of overlap between them and center/right populists.

          I do agree that the remainder of the so called Indy/moderate voters outside this group are leftists who don’t want to call themselves d/prog and virtue signal as morally superior, ‘neutral’ arbiters. IMO the RNC needs to be making a dedicated push with their State Party Nationwide to eliminate ‘open’ primaries, to require voter registration by party affiliation with ‘none/Indy’ disqualifying primary voting and setting the cut off date for registration as Dec 31 of the year prior to the election. They can still vote in the general but not in the party primary. This cuts the opportunity for mischief/shenanigans and helps police the rinos by eliminating primary vote support by d/prog or Indy in the GoP primary.

          Open primaries defeat the whole purpose of parties, Only party members should choose their candidates.

          I myself have voted in the primaries of parties I don’t belong. Example I voted for Obama and against her thighness in the primary although i never would have voted for Obama in an actual election. As an unenrolled I should not have been allowed to vote in the democrat primary.

      The next election for VA governor is in 2029, but she won’t be up for reelection then, because she can’t be. The only way she could get a second term would be to sit one out and then run again in 2033.

      And I don’t think she will be running for president, but as this Michael LaRosa person points out, she would normally be on everyone’s short list for the Dems’ VP candidate in 2028, but this stunt would probably lose her any chance of getting picked for that.

      You can’t, because that statement is a big fat LIE. The constitution says they are NOT required and CAN’T be required. If you arrest a governor for that YOU become the criminal, and a federal court will throw you in prison.

I am still baffled by this “she ran as a moderate” stuff. Admittedly the campaigning was incredibly low key where I am, but her website and literature were full of things I would never consider to be “moderate” positions. Any idiot could have seen she was a doctrinaire DC commie Dem.

That’s garbled and makes no sense. And it’s not what Melugin actually tweeted, which at least makes sense, but is wrong:

She wants ICE to get a judicial warrant – which isn’t possible unless there is suspicion of *FEDERAL CRIME*. Murder, rape, etc are largely state crimes. It’s remarkable how few politicians understand how this works. A federal judicial warrant can only be signed off on by a federal judge if there is probable cause that a FEDERAL CRIME has been committed.

That’s wrong. A federal judge can issue ICE with a warrant for this person if it shows probable cause that he’s here illegally. That would allow it to enter private property to arrest him, even without the owner’s permission. And that would include state prisons. Spanberger is saying if you want to arrest him while he’s in our custody, that’s what you’ll have to do. She’s just virtue signaling, since there’s no question that they can do it if they want to.

As for the ICE statement, it is outright wrong.

What’s actually asinine and illiterate is that statement. ICE knows very well, and whoever wrote this statement has a duty to know, that state officials are NOT required to honor ICE detainers. There is no federal law requiring them to, and Congress can’t make such a law even if it wants to. Federal officials, sworn to uphold the constitution, who don’t know that should not be calling state officials illiterate just because they’re asininely standing on their constitutional rights.

It doesn’t need them to make arrests on public property. If VA releases this guy after his sentence is over, and ICE finds him on the street it can arrest him without a warrant. But to enter the prison and arrest him there, without the state’s permission, it needs a warrant. Ditto if he takes shelter on private property and the owner doesn’t willingly allow ICE to enter; it will then have to get a warrant.
