Former CIA and NSA Director Gen. Michael Hayden stood by his statement that Sen. Tommy Tuberville (R-AL) should be removed from the human race.

Hayden’s comment comes from one person asking if the Senate should remove Tuberville from his committee due to holding military nominations because of the Pentagon’s abortion policy.
In October 2022, The Pentagon changed its policy after the Supreme Court overturned Roe v. Wade.
The Pentagon would pay for service members’ travel to get abortions plus help Defense health care providers escape states that have strict abortion laws “in order to support the performance of official duties.”
The Hyde Amendment bans the government from paying for abortions except when the mother’s life is in trouble, rape, or incest. It says nothing about travel.
Tuberville announced his intent two months later: “As a result of your [Defense Secretary Lloyd Austin] office’s ongoing recalcitrance to Congressional oversight, effective this morning, I have placed a hold on all further nominees from the Department of Defense until such time as my staff is briefed to my satisfaction on this matter.”
But Tuberville recently made a valid point: “Y’all got the American taxpayer on the hook to pay for travel and time off for elective abortions.”
I don’t want to pay for anyone’s anything, but abortion is at the top of the list!

Your are 1000% correct on that one. Schumer could have shuffled the order of confirmation votes if these confirmations were an actual national security issue or he could have not given the Senate their August vacation and used that time to move the candidates through the process. He knew he had those options and failed to choose either one. Campaigning and fundraising take precedent.
Very few have challenged Schumer on these points, they know that their entire sky is falling argument blows up in their face if they do so.

Hayden had the opportunity to apologize and adjust his position. Instead he dug a deeper hole by a mealy mouthed, transparent attempt to weasel his way out of the consequences by pretending he didn’t write what we all read. He made a poor attempt at humor in an attempt to gain internet likes and validation from leftists, it backfired but instead of admitting his error he chooses to insult our intelligence by pretending he wrote something else.

Hayden should have his secret clearances revoked immediately after showing such bad judgement. This would both humiliate him and cost him in the job market. And, it could be done as a purely administrative move and without a hearing.

It makes sense for DoD to pay for travel etc. They elect what states they send people to, and if they want an abortion in an unfriendly state, pay for travel to the state of their choice. Just like businesses pay for meals when they send you away from home.
Why is there supposedly such a need for abortions among the military, to start with? Unmarried women in service are not supposed to be getting pregnant and should be thrown out of the military in that case. Wives of military personnel should not be seeking tons of abortions. if a wife doesn’t want to get pregnant there are many ways to avoid it – cheaply and easily and available to all. So who are supposed to be getting all of these abortions? Minor daughters?? Well, there would be lots and lots of problems if that is the case.
Maybe it’s the male trannie soldiers who are all looking to get abortions??

Yeah … I’ve heard the stories about women on ships and how many of them got pregnant and some ships even had to turn around. That’s what I heard years ago, at least.
If the WH and the DoD really believe that then they should make the case to Congress and it can be.decided by an up/down vote in Congress on this issue as a.stand alone bill authorizing the DoD to make the payments.
Businesses pay for your meals only if they need you to be away from home. If there is a genuine business need for you to be sent to some city, then of course they pay for your air fare, taxis, hotel, meals, and other expenses. But they don’t send you to some city where they have no need for you to be, just because you want to visit some place in that city for your own private reasons. They tell you that’s what vacation time is for, and that you should take some vacation days at a time when you’re not needed, and pay for it yourself. And that is what this is; you want an abortion, so they pay to send you to some state where they have no need for you to be, but you need to be there to get the abortion you want. That violates the Hyde amendment, at least in spirit if not in the letter.
Military members who want to travel to another state for pregnancy termination purposes can do so by taking leave and on their own dime. The US taxpayer didn’t impregnate them, but under present policy is the one getting screwed. If the member really can’t afford the travel cost (doubtful) there are relief sources such as Navy Mutual Aid and the other services’ analogues for no interest loans or even outright grants that involve no public money.

Huh? Charged with what? Even if he had literally said that Tuberville ought to be murdered, it would be protected speech. Just as it would be if someone were to say the same thing about Biden. The Supreme Court has been very very clear about that,
The UCMJ, has a different interpretation. SCOTUS has always allowed this distinction to exist. SCOTUS has also ruled that retired military remain subject to the UCMJ.
At minimum he could be hit with a violation of ART 88, Contempt towards Public Officials and ART 133, Conduct Unbecoming.
I don’t see how that can be squared with the first amendment, at least as to retired military. UCMJ is allowed to restrict active members’ speech because of the need for discipline, but there’s no way to justify it after retirement. It would be struck down on an “as applied” basis.
Another reason he could be justifiably cooked here is Hayden chose to have his military rank associated with the statement which is going to be viewed as a sufficient nexus to apply the UCMJ. In general even an AD service member can pen a critical public statement when they refrain from using their rank and make it clear their comments are their own and not those of their service branch or DoD while stopping short of contempt.
This wasn’t an innocuous comment about a simple policy dispute. Gen Hayden proposed revoking a US Senator’s membership in the human race. IOW, he views Tubberville as subhuman which at best that’s contempt, at worst he was calling for Tubberville to be killed. Let a court martial panel hear the evidence and decide if his conduct should be punished.
Not according to SCOTUS. They have consistently applied the UCMJ to retiree. One case from a couple years ago about bribery for a retired guy in a contracting scandal. They changed him under UCMJ and SCOTUS upheld the application of the UCMJ.
The problem is it’s an all or none situation with the application of UCMJ. It either is or is not applicable to some classes of retiree it ain’t a buffet line. The DoD has become more aggressive in pushing this as well, for certain things and v certain folks while being lax with others.
There’s nothing in the constitution that would prevent that, so it’s not comparable at all. Here we’re talking about a constitutional right, which can only be restricted if it’s a narrowly tailored measure that is the least restrictive way available to advance a compelling government interest.
And yes, it is a buffet line. That is the whole point of “as applied” challenges. The plaintiff is not saying the law in question is unconstitutional, only that the application is.
Hayden hasn’t been right since he had a stroke.

According to Breitbart, Tuberville has reported Hayden to the Capitol Police. I doubt much will result from this but it is the right thing to do. The feckless powers to be in DC will just sit on their hands.
There is nothing the Capitol Police can or should do about it. His statement was fully protected by the first amendment. Any police action that would have a chilling effect on protected speech is illegal.

I am not a constitutional historian and have never heard this issue discussed. When the framers were drafting the advise and consent process was it their intent that a group of nominees could be confirmed en masse. I realize that the concept of “without objection” was used was it their intent to apply it to nominations. I realize the size of the government and military is much different today and to debate each one can be a very time consuming process.
They are full time exempt employees. I don’t care how much time it takes to do jobs correctly.
