New Mexico Governor Effectively Suspends 2nd Amendment Under “Emergency” Decree

People who warned that Covid lockdowns and restrictions were the gateway drug toward abolishing the 2nd Amendment and other rights deemed ‘right wing’ were dismissed as conspiracy fearmongers. As with so many other things, those ‘right wing conspiracy theories’ have come true.

During the worst of the Covid lockdowns in 2020 pushed by the Trump administration, many states and localities issued emergency orders restricting civil liberties and constitutional rights, often in completely irrational ways. We covered a lot of those cases, particularly the negative treatment given church services compared to other gatherings. And of course, BLM protests were give a complete pass.

A lot of the emergency orders started off short term, then were renewed. ‘Twenty days to stop the spread’ became 20 months. Republican Governors who fought back, like Brian Kemp (GA) and Ron DeSantis (FL- “DeathSantis”), were excoriated by the media and Trump administration, while Governors who capitulated like Kristi Noem in South Dakota, escaped scrutiny. Democrat Governors, particularly in California and New York, were flush with hubris and power.

Courts were hesitant to get involved because the courts traditionally took a permissive attitude towards government efforts to control infectious disease. But it was inevitable that emergency orders unrelated to Covid or the spread of infectious disease would be used to curtail other civil and constitutional rights.

The Democrat Governor of New Mexico Michelle Lujan Grisham just issued an emergency order on gun violence:

The Emergency Order  effectively suspends the 2nd Amendment, and faces pushback even from local law enforcement:

New Mexico Gov. Michelle Lujan Grisham on Friday issued an emergency order suspending the right to carry firearms in public across Albuquerque and the surrounding county for at least 30 days in response to a spate of gun violence.

The Democratic governor said she expects legal challenges but was compelled to act because of recent shootings, including the death of an 11-year-old boy outside a minor league baseball stadium this week.

Lujan Grisham said state police would be responsible for enforcing what amount to civil violations. Albuquerque police Chief Harold Medina said he won’t enforce it, and Bernalillo County Sheriff John Allen said he’s uneasy about it because it raises too many questions about constitutional rights.

Violating the constitution seems to be the entire point of the emergency order, she’s daring a court to stop her:

I missed in the law where that says a state can ignore the Constitution because the vulnerable government is worried about losing power. I did find the opposite.

    In a police state, the constitution is just a suggestion. And warm to all the republican politicians, lawyers and hack pundits who ignore or even support the democrats lawless targeting of a political opponent they just don’t like, helping to pave the way for this.

    Neither the executive order of the governor nor the various departments and agencies of the executive branch of the state government have the authority to supersede Article II, §6, Right to keep and bear arms, of the New Mexico State Constitution:

    No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons.  No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms.

    My reading of that is that open carry is a right guaranteed and protected by the state constitution. While concealed carry is not guaranteed and protected, it can be enabled by appropriate legislation. They certainly cannot impose civil fines upon citizens for exercising their constitutional rights.

    The governor does not have the constitutional authority or the implied power to suspend the state constitution.

    Lawyers, in what particulars am I mistaken?

      Almost no rights, constitutional or otherwise are absolute. They can be subject to reasonable regulation. Whether this governor has the authority to unilaterally suspend them is a different story. Of course, authorities in a police state can do pretty much what they want. Kinda why maybe some should be a little more vocal resisting this decay.

          It’s a side issue because this doesn’t appear to be what’s happening (at least not legitimately) but in general what you’re saying is incorrect. Even fundamental rights can be regulated if there is a compelling government purpose and the means are the least restrictive alternative available.

Tell me, what is “reasonable” in your book? Rest assured, the governor of New Mexico believes her suspension is “reasonable” to fight some nonsensical public health emergency.

          I’m not condoning what the governor did. I’m just relating to you the general legal principle. If you don’t like it, take the matter up with the S. Ct.

You can’t refer to some general reasonable standard or the standards of the community when the community is split 50/50 between praising police or lighting them on fire, or your learned experts can’t define what a woman is.

        Yes, the Supreme Court can be wrong. The “reasonable regulation” standard is hogwash. And we’re paying for it.

          No way am I going to defend the S.Ct. but what we’re going through now is a painful transformation into a police state not a misapplication of bad precedent.

        It’s a bit of both: we are fast moving towards a police state, mostly because of a setting aside of the words of the Constitution, some of which is due to bad precedent set by the Supreme Court.

          This has been happening in Portland, where they got rid of the po po, let stuff turn to crap, and now we have a bunch of unaccountable private security operations to clean-up/control the mess. This, IMHO, is just a step or stage to having American Oligarcies.           It’s S.Ct. precedent. Standards vary depending on the right involved . Fundamental rights are subject to strict scrutiny. But my only point was that rights are not absolute. Feel free to pretend the precedent doesn’t exist and the standards don’t apply if that makes you feel better. It’s really irrelevant my comments on the newly expanding police state anyway.

          The constitution says the right to keep and bear arms shall not be infringed. It doesn’t say exactly what that right consists of, or what constitutes an infringement. That’s for the courts to say. And the courts have said that reasonable regulation does not infringe the right. That there never was a completely unfettered right; that the right that must not be infringed includes the provision for reasonable regulations.

          Consider the freedom of speech, which may be regulated as to time, place, and manner, and sometimes even as to content, but not as to viewpoint. The courts say that’s what this freedom always was, and thus allowing such regulations does not abridge it.

          It doesn’t. See, the abuser gets to define the meaning of the Protection from Abuse Order – The Supreme Court (agents of the Govt.) took it upon itself to hold that it, and it alone, is the final say on what the Constitution says (i.e., the government will define how limited it is, which is, not at all.) Thus, no one can simply read the document recognizing their rights, because now you have to read 1 million pages of Supreme Court precedent in order to understand what it says. And of course, the govt. will treat a document designed to restrict it as an Etch-A-Sketch. This leads to people like Milhouse walking around in confusion as to what “keep and bear arms” and “shall not infringed”, ala Slick Willy and his vague definitions of “is”, a slight of hand designed to 1) take clear language and make to “vague” so as to 2) permit the party restricted by the document (govt. by way of courts) to interpret it.

        There are no rights. There are a set of privileges which can be enforced with a gun. Our bill of rights exists because we have the 2A. Those who don’t understand that are ignorant or fools.         As in the 4th… reasonable. At the time, I don’t think the Founders could ever have envisioned to total extent of a future totalitarian state. Yes, they had seen what the British could do and well knew the weaknesses and shortcomings of man. The 18th century had far more in common with the past thousands of years than the late 19th and 20th centuries. Even Orwell would be shocked.

    I missed the part of the Constitution of the United States that states the citizen’s rights granted under the Constitution of the United States can be abrogated and denied the citizens simply because an “Emergency Health Decree” was issued by an elected official under the public health laws of New Mexico or any other state for that matter. But I guess since the citizens of this country rolled over when it was happening during the pandemic they are now conditioned to allow government officials to do the same for any other thing. Disgusting. Simply disgusting.

    And if it were truly that easy to ban guns from a city why haven’t other democrat governors/public health officials done the same. Should be a hands down win for democrats in places like Chicago that’s experiencing a bloodbath of gun violence with no end in sight.

    There are fast ways to legally stop her before the courts can even think to act, file against her surety bond for “practicing medicine without a license” and each count is for every person living in the county that is legally able to carry a firearm. By her declaring a “public health emergency” she has stated that she, regardless of any medical professional behind her, is acting a medical professional but has no license or training to do so. Burn her to the ground.

    Nope, that should be the Feds operating under USC 18 Sections 241 and 242; they should bust her, anyone connected with her that assisted in the drafting and implementation of this order, and anyone who attempts to implement it. The text of that Code states:

    “If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

    If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

    They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.”

    Arresting and jailing someone based on this arbitrary and capricious ukase of the governor would be considered to be kidnapping, and per the above, subject to the death penalty. Enforcement should be immediate and thorough.

    If anyone actually believes that the SwampState that is our current US government would do literally ANYTHING about this, I have a large bridge for sale in Brooklyn. Cash only, small non-consecutive bills please.

      DOJ pretty much is going to be forced to charge her, even if they may sympathize.

    The state police work for Grisham. They are her personal stormtroopers. During Covid, when local law enforcement refused to arrest people for violating her dictates, the state police came in and did it on her orders.

    “Shall not be infringed” is not the only relevant clause. Equally important is “the right”. What is that right, which shall not be infringed? That’s the part that isn’t absolute. There isn’t and never was an absolute right to carry any kind of weapon, anywhere, at any time, and under al circumstances. Thus there can be regulations that don’t infringe it. This order clearly is not one such.

      Actually, it DOES say what the right is. It is the right to KEEP and BEAR ARMS. To KEEP is to own an object, in this case ARMS or weapons. To BEAR said ARMS is to carry them. The clause says absolutely everything it needs to and there is no ambiguity about it. But, if someone wants to disagree, I’ll happily shoot them.

      It went totally under my radar, first I’ve heard of it. I imagine there are a few places in New Mexico that wouldn’t have taken this lying down, but Gallup is a heavily Indian town, and the rezzes out here still haven’t even de-masked. I’m sure the folks in Taos, Sante Fe, and Las Cruces would have bleated, “Thank you, Ma’am, may we have another?”

If you are going to suspend the constitution, to address crime, wouldn’t it make more sense strip the criminals of the right to privacy? Search all the known criminals, stop their cars, search their homes and businesses.

Permitted gun owners are not committing crimes.

    It’s like she said, she can’t arrest every criminal. We don’t have the manpower or the facilities to hold them. So instead, she’s going after the one group that has proved to be the most law abiding in the state…. concealed carry holders. It won’t save a single life and may cost lives in the end but the gun grabbers don’t give a shit about those dead kids… they will happily climb on top of their corpses to cheer when the governor attempts to disarm everyone but the criminals.

As a resident of South Dakota, Gov Noem did not capitulate. Originally she was going to declare an emergency for COVID and our legislature warned her she could not do it. If she did she’d be impeached. Each community did it’s own thing. She acted the hero later, but she originally was on board with shutdowns.

I think it is way past time for legislation allowing for the immediate removal of politicians either State or Federal who pass or decree something they know they have no power to do. This chick even admitted it.
Be careful of this one. “Health Emergency” has been floated as being a tool to use for Climate Nonsense to force draconian measures on all of us.

This is not quite accurate — the lockdowns were enacted by the governors of the states, as President Trump left those decisions up to them.

    They were indisputably part of the executive branch. Trump stood on the stage with them how many times giving public briefings and taking questions? Trump selected and appointed Birx to his adhoc ‘Covid Taskforce’.

    Trump did many good things in office. His administration’s Covid response wasn’t one of them. You are downplaying Trump himself scolding and deriding Sweden which didn’t lockdown and going after both Kemp and DeSantis very publicly for ‘opening back up too quickly’.

    Finally Trump could have directed his Administration to intervene in lawsuits filed against the States and Cities who went full totalitarian in violation of our Constitutional rights; forbidding congregations from religious worship, attending weddings and funerals or even going to see your dying family members in a hospital or nursing home. He chose not to do so, instead, at best, he stood back and allowed the Fauci fascists to run wild trampling our civil rights. Not his best moments.

William Jacobson is engaging in some revisionist history. The only governor who didn’t lockdown was Kristin Noem, whereas every other governor, including Kemp and DeSantis, locked their states down. They may have been among the first to reopen, but they locked their states down. And that was only after many people in both parties around the country refused to go along with the totalitarian BS of the Trump Administration (yeah, I’m a Trump supporter who blames Trump for the COVID nonsense) to shut down over a virus, something that was never done in human history.

          No, it isn’t. As I’ve said, I have been consistent on this issue. I don’t engage in what should have been done, I’ve been saying since the beginning Trump should have staked his entire presidency going against the nonsense recommendations from Fauci. And I was saying states shouldn’t shut down over something they can’t see, hear, smell, taste, or touch. You know, the way you’re supposed to identify what you’re fighting against. And I don’t know how you acted during all of that time, but I didn’t wear masks (in fact, I got arrested for not wearing a mask but it was called “trespassing”) and I will never get those vaccines and even told my wife she could quit her job because they were forcing her to get it.

          It matters b/c some who should have known better in positions of leadership and political power persisted in the lockdown, mask mandate, made up 6ft social distance, close schools, send employees to work from home BS long after it was apparent that it didn’t do diddly squat.

          It matters b/c those most responsible for the creation, implementation of the federal Covid actions and policy still refuse to accept accountability for their clear failure. It indicates they haven’t learned from their errors, reject personal accountability and refuse to apologize for their failure.

          Of course it’s arm chair quarterbacking. We were not privy to things going on behind the scenes. Much of what occurred would have happened one way or the other. Looking at it in a vaccuum, and acting as it would reveal something about the next event, is like playing a board game.

      Enough was known very early on that Trump (and Pence—he had his own role to play) could have refused to go along with the “experts.”

    Here’s the difference, chris: DeSantis locked down our state in the very beginning, and we were all on board with that, at that point. We didn’t what we were dealing with, and it was all a bit scary. Heck, I wore a mask I dug up from an old paint thing to wear to Publix (a grocery store). I am not an alarmist by any stretch, but no one knew much at first. Right?

    And DeSantis never butted in when we all decided to heck with that crap and went about our business without masks, ignoring signs on doors telling us to mask up. He was not a tyrant, not even when he had the original lockdown in place. And he backed off it very quickly, too, and then signed EO’s ensuring that no Floridian could be fined, arrested, or jailed for flouting local blue area “rules” and “ordinances,” etc.

    DeSantis got it right. Noem had her own legislature stop her from acting on her tyrannical impulses. AND she allowed blue areas to impose all manner of covid crazy from masking and “allowed” business capacity to even ticketing and jailing “offenders” of whatever crazy these places dreamed up.

        DeSantis did lock the state down at first, and none of us actual Floridians had a problem with it. I live in Florida, and I did not wear a mask or social distance or whatever after about March/April of 2020. I did have to wear one in October of that year at the DMV, but you are out of your mind if you think we Free Floridians experienced the plandemic as people did in other states.

        DeSantis was originally going by what the Trump-Fauci-Birx triumvirite of tyrannical evil dictated, but he quickly realized they were out of their damned minds and doing everything completely wrong. At which point, DeSantis switched gears and opened the state back up, ensured our schools were open (to in-person teaching), that no Floridian could be fined, arrested, or jailed for defying local dumbass mandates, and pretty much kept our state FREE. There’s a reason we call ourselves Free Floridians: we ARE free, and we stayed free because we have an incredible governor.

        You keep whining, but you would be hard-pressed to find a fair-minded Floridian who faults DeSantis for his initial caution. It lasted months, and as data rolled in, he responded quickly and correctly. Honestly, I thank the good Lord every day that I lived in Florida through the plandemic. There is literally no governor of any state who got it more right on every score.

Things to note:

1) Note the silence. Granting that the Democrats control both houses of the New Mexico legislature and there will not be even a hint of impeachment. However there are Republicans in that legislature, and a statewide Republican party and this news has been out for over a day. And as best I can find, not one freaking Republican there has stood up to defend the Constitution and Bill of Rights. For some reason I am reminded of the Whig Party in the late 1850’s. That way lies interesting times.

2) Impeachment being out, it is important to know that from what I can find in a quick search that the right of recall is solely limited to county and local officials and state officials cannot be touched by the citizenry between elections. Recall is not possible.

3) That [2)] might be a factor in the Democrats choosing to do this in New Mexico,

4) There are reports that there will be a lot of people filing in court Monday. It must be noted that the suspension of the Constitution [ Don’t you just love the Democrat Governor’s statement that her duty to uphold the Constitution is “not absolute”?] is at first only for 30 days. Discussion by those involved in the case indicate that they intend to delay things in court till the 30 days expire, rendering that particular legal action moot. Then, with precedent, Governor Grisham can either renew, or redeclare, or expand the state of emergency repeatedly. There are other Amendments in the Bill of Rights.

5) Keep in mind that the Federal courts from the Supreme Court on down are extremely reluctant to take cases that could have a final decision that opposes the Left. They will delay as long as possible, even with the precedent of the post-Katrina seizure of guns in New Orleans being knocked down by the Supreme Court and the Department of Homeland Security budget afterwards where it was made illegal by statute for the government to seize private firearms without specific probable cause. The Grisham barring of carrying would be easily an extension of similar illegal actions under both the Supreme Court ruling and the DHS statute. If they will rule. You know that the Democrat DOJ will be fighting it being heard tooth and nail.

6) In an earlier thread here at LI involving the threat by the Federal government to make the northern border of Texas a replacement for the international border with Mexico and restrict the hostile foreign invaders from leaving Texas and going to Leftist areas [there is also Supreme Court precedent preventing the government from barring travel between states] I noted that action will push some people right up against lines you don’t want to push people to. The Left successfully claiming the right to void the Bill of Rights at will strikes me as pushing a critical number of people over those lines. If it happens it will me most untidy.

Not correct. Apparently the Governor signed a declaration that “gun violence” and “drug use” were public health emergencies in New Mexico. And it was Patrick M. Allen (Secretary of the New Mexico Department of Health) that promulgated and signed the decree imposing the firearms restrictions.

Of course, the two were probably in cahoots with each other and colluded for this outcome but it was Allen not Grisham that imposed the restrictions.

    Grisham encouraged every municipality in the state to use the riot control act (which was used in the public health order) to “fight gun violence” in her executive order. The public health order that followed listed restrictions that came straight from the riot control act. That was ABQ specific and presumably, other municipalities could formulate their own orders.

    A distinction without a difference. In Allen’s declaration, he states that he was directed by the Governor to do so. And Grisham sure has been owning the decision; note her statements “explaining” her actions.

I am more concerned with her stating she can operate outside of the confines of the law. The question should be … is it constitutional? … but the Left says “let’s do it anyway until someone else stop us.”

The COVID tyrannies that popp;ed up all over America were un-Constitutional and about as un-American as anything. They were illegal, in and of themselves.

That said, this new idiocy from the commie in New Mexico has nothing to do with any actual emergency contingencies. This is clearly illegal from the very start because have nothing to do with “health” and cannot be any sort of “health emergency”, whether someone believes that our officials take on tyrannical superpowers in emergency situations or not.

Guns are not a health issue and everyone in the world knows that. All the officials involved in coming up with and carrying out this insane policy are the worst sorts of criminals that society can suffer under and they all need to be excised from free society and put away where they cannot affect anything ever again. This is the WORST sort of abuse of official positions and the punishment for this sort of action needs to be extreme and merciless. Seriously.

      Watch the psychological/psychiatric medical wing of our medical institutions gravitate into attaching a variety of mental maladies to anyone besides government sanctioned private/government gang activity interest in firearms.

      Doesn’t matter. “Public health” and to a lesser extent, “public safety” have been identified by tyrants as backdoor passwords to the constitution, and until they get severely punished for it, they’re going to keep doing it.

The only real question is:

When are people who so flagrantly abuse governmental power in such extraordinary ways going to be held liable for their crimes and put away for the decades they deserve (at the very, very least)??

This is the question that will determine how much life this nation has left in it.

Politics attracts the worst sociopaths, along with dizzy narcissistic women. The old early Victorian period attracted the best leaders – landed gentry of the highest education and moral principle who had the leisure and honor to rule.

If the constitution, state or federal, and the rights that they recognize, are not absolute, then certainly an executive order or emergency order of a governor carries even less weight. So disregard her order just like she disregards the Constitution and the oath that she took. This is not about controlling guns for public safety, this is about the government wanting to monopolize the use of force. All uses of force from guns to Pepper sprays to clubs to knives to using your own fists in self defense. If the problem were guns, she could use her executive powers to strip the firearms from the police, possibly the National Guard and private security including her own. It’s not about the gun, it’s about their fear of the populace. Notice I didn’t say fear of the voters, because they can always fortify a few of those.

The first point of resistance must be the law enforcement officers of The state, who no longer have qualified immunity, and should be held civilly liable for any civil rights violations that are premised upon this executive order. Any law enforcement officer that is actual police and not a stormtrooper, will publicly declare that they won’t enforce these unconstitutional acts.

So to get this back on topic. Everyone here does realize this is a test case for step 2 in turning the US into a police state. If you don’t believe that this is approved at the highest levels of the current administration then I have some beach side property in New Mexico that I want to sell you.

This is just the next trial balloon. If they can get away with this one, the next will be someone like Gov. Hair Gel locking down an entire state. Then next comes the Feds.

We will be lucky if this only leads to another Ruby Ridge incident.

I wonder if this will backfire as well as Klintoons AWB 94 that created 20 million new AR15 owners? The thing with these sociopaths is that THEY always want to be the ONE who gets all the credit.
