Report: Capitol Police Exonerate Officer Who Shot Dead Ashli Babbitt
NBC News: “A memo from the commander of the Capitol Police’s Office of Personal Responsibility says ‘no further action will be taken in this matter’ after the officer was exonerated for use of force.”
Hot on the heels of Friday’s story from Reuters that destroyed the “insurrection” narrative Democrats and the media have pushed about the Capitol riots comes a report from NBC News with an update on the U.S. Capitol Police department’s internal investigation into the January 6th officer-involved shooting death of Trump supporter Ashli Babbitt:
The Capitol Police officer who fatally shot Ashli Babbitt outside a door of the U.S. Capitol during the Jan. 6 riot has been formally exonerated after an internal investigation, according to a department memo obtained by NBC News.
The officer, whose name has not been released, opened fire on Babbitt as she and a mob of other Trump supporters tried to forcefully enter the Capitol.

A memo from the commander of the Capitol Police’s Office of Personal Responsibility says “no further action will be taken in this matter” after the officer was exonerated for use of force.
The Capitol Police did not immediately respond to a request for comment. A lawyer for Babbitt’s family declined to comment.
As of this writing, NBC News has not released a copy of the memo.
Back in April, President Biden’s Department of Justice announced they had closed the investigation into the fatal shooting and would not be pursuing criminal charges against the officer, citing “insufficient evidence to support a criminal prosecution.” Here’s a quick recap of their findings:
The U.S. Attorney’s Office for the District of Columbia’s Public Corruption and Civil Rights Section and the Civil Rights Division, with the Metropolitan Police Department’s Internal Affairs Division (IAD), conducted a thorough investigation of Ms. Babbitt’s shooting. Officials examined video footage posted on social media, statements from the officer involved and other officers and witnesses to the events, physical evidence from the scene of the shooting, and the results of an autopsy. Based on that investigation, officials determined that there is insufficient evidence to support a criminal prosecution.
[…]
Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber. Acknowledging the tragic loss of life and offering condolences to Ms. Babbitt’s family, the U.S. Attorney’s Office and U.S. Department of Justice have therefore closed the investigation into this matter.
Though neither the Biden DOJ nor the Capitol Police department are pursuing charges against the officer, that doesn’t mean this chapter of the Capitol riots is closed.
In May, the attorney for Ashli Babbitt’s family announced they were suing the Capitol Police and had plans to sue the officer involved in her death as well:
The attorney representing the family of Ashli Babbitt, the woman shot and killed by U.S. Capitol Police during the Jan. 6 riot at the Capitol, plans to sue the agency for more than $10 million and has already put officials on notice, demanding accountability for the slain Air Force veteran.
“Right now, we have no accountability — zero accountability — they give no explanation to justify the shooting and they do not even identify the officer. That is what they do in autocratic countries, not in the United States,” said Terrell N. Roberts III, a Maryland-based attorney.
[…]
Mr. Roberts, the family attorney, told The Washington Times he’ll sue the Capitol Police under the Federal Tort Claims Act, which generally requires a notice of six months before filing a lawsuit.
The family will also pursue claims against the officer who shot Babbitt.
According to the Air Force Times, Babbitt “was a security forces airman who achieved the rank of senior airman, or E-4, while on active duty.” They also noted that she “served more than 12 years in different parts of the Air Force.” Babbitt was 35-years-old at the time of her death.

Of course they do
Nothing to see here
Just a female War Vet…
Has there ever been another time when an unarmed woman was fatally shot and we haven’t even been told the name of the man that shot her?
Actually, there was the case of the lady with her kid in the car who was driving in circles in DC and refused to stop for a checkpoint(?) that the cops and feds put about 1000 rounds into her car. There was pretty much no investigation of that and the MSM was never interested in the story at all … because Barky was occupying the Oval Office at the time and they would never think of criticizing anything done under him. That was another really weird event that was just immediately disappeared by a press that had no desire to see any dirt fall on the dems and the dems not interested in looking into it, themselves – for obvious reasons.
Dems war on women marching along as usual.
The suckers in America continue to believe the lies they’re fed that it is the repubs who hate women.
Sadly, if her skin color had been different – there would have been riots across the USA and people yelling “all cops are bastards” (ACAB). ACAB has been the rallying cry of the defund police maniacs. This is a clear example of the neo-racism. Progressives will not raise their voice to object to the killing of an unarmed white person.
Progressives have unleashed an undeclared war on people with white skin. This neo-racism is cleverly masked as “anti-racism”. Media and Dem Party are enablers of the neo-racism.
Disagree, but only partially. To these people, the black cop can’t do any wrong, by definition. To the Capitol Police and those carrying out this sham “investigation” Ashli Babbitt was just asking to be murdered from the beginning just due to her presence, and the cop was just doing his duty as Praetorian Guard to Empress Pelosi.
Black cop shoots white person = “We’ve investigated ourselves and found we did nothing wrong.”
Black cop shoots black person = “We’ve investigated ourselves and found we did nothing wrong.”
White cop shoots white person = Crickets
White cop shoots black person = Instant riots across the country.
The family should declare Ms Babbitt identifying as a black, transgender, overweight drugged-up thug with a rap sheet.
Pelosi literally – literally – has a hitman in her employ. How many other people has she had killed that we don’t know about.
Speaking of completely sh-t:

Naw, she just borrows Hillary’s.
Some, Select [Black] Lives Matter
Ok, so the ones who exonerated the trigger puller are now accessories to murder. Hopefully someday all these filthy bastards will be brought to justice.
Such complete and utter BS We all saw the videos (and noticed the cops who were standing at the door with the protesters, milling around) and know that this is the worst sort of attempt at a whitewash.
The people who conducted this “investigation” are now accessories after the fact and deserve to be thrown in jail for unreasonable long periods of time. If our society still had any self-respect left they would be doing that time at hard labor, too.
As for the unnamed cop who somehow deserves anonymity for some unknown reason … we know all about him, too. But the MSM likes to continue to pretend that his name hasn’t been out there – which takes us back to that time with the anti-Trump traitor at Homeland Security who the MSM was so up in arms about keeping anonymous, as they lied about who and what he actually was …
*the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber.*
Please note the double negative. If the investigation *HAD* shown the officer was justified in shooting an unarmed woman, it would say “the investigation revealed evidence that at the time the officer believed it was necessary…” and then detailed the evidence that Ashli presented a lethal threat to the protective detail. Since there was no evidence that Ashli was a threat, they have to dance around the point.
Simple explanation: A CP officer with an employment history of less-than-perfect actions decided with no warning to shoot an unarmed protester/rioter at point-blank range and to the (apparent) shock and surprise of his fellow officers. Rather than admit it, the Capitol Police quickly closed ranks, protected the officer’s identity, and passed off a pre-determined outcome to an ‘investigation’
All white juries found white Democrat Klansmen not guilty as well.
Ashli Babbitt was murdered. Now she was murdered by our government!
Very true.
Some rioters are more equal than others.
She was not armed.
She was not resisting arrest.
She was not a career criminal. (She was an U.S. Air Force veteran.)
She was not attacking anyone.
She was an unarmed woman.
At most, she was trespassing.
She is shot dead. No media outrage. Hardly a peep from the media. No release of the officer’s name. No riots in her name. No looting in her name. Not a peep from supposed police brutality activists. No politicians crying crocodile tears at her casket. No murals or statues to her memory. No media stories to turn her into an icon.
Double-light-years-apart standards.
How did the officer know she wasn’t armed?
She was in the process of committing a crime, breaching a barricade which was being smashed by Trump supporters
She was ft away from the officer how do you know what her intent was after breaching the barricade?
Given the volatile situation and the multiple injuries to law enforcement, and the criminal actions going on I don’t have much sympathy
By your reasoning, police should be able to shoot any unarmed person for trespass or breaking, even before entering. We should start applying this to everyone, even those of color.
Mark311 – Police should be judge, jury and executioner. As long as their target is white.
Remember, only black lives matter. Yeah – we’ve been told countless times – don’t dare say all lives matter.
“How did the officer know she wasn’t armed?”
Seriously – are you a moron? A sadistic moron at that?
You think a police officer can shoot someone if he cannot tell if a person is armed?
Did she brandish a weapon? No.
Was she in the process of using physical violence against another person that could reasonably be construed as an imminent threat of causing death or serious bodily injury? No.
Police officers do not get to shoot people for simply committing a crime. Do they get to shoot drunk drivers? Do they get to shoot jay walkers? What about people parked in front of expired parking meters?
Just feet away? That makes it OK? No weapon? No demonstrated intent to harm another person? Some one gets too close to a cop and its OK to shoot them? Really?
A cop can shoot someone because they do not know someone’s intent? So a cop walks up to s traffic stop. What’s the intent of the drive? Who knows? Let’s shoot him so we will never need to find out.
Oh, and no warning. No “Halt!” Just a shot into the side of the neck.
Are you really this sick and slavish to government authority?
Also at the time she was shot, she was engaging in the extremely threatening behavior of……sticking her head through a window and looking around.
Also, note that there were several armed officers right in front of her that did not see her as a threat, but the one off camera in another room, who appears to not have had a clear shot did shoot.
Why protect his identity if he was completely justified? Well here is one theory. What if he was ordered to shoot by….say a high ranking congress critter who happens to be a Dem?
She was about to step through a broken window that had furniture piled against the other side which she was going to have to negotiate to even get to a standing position. Even when she accomplished that, she was going to walk right into the arms of several armed officers.
As far as the officer, if I were him I would already be prepping for my escape. If I had my guess this guy is probably on the “unfortunate officer ‘suicide’ list” for the near future.
Look around? Hardly she was forcing her way through the gap , there wasn’t time for her to look around.
This isn’t about the officers who were approaching from the rear. They had a completely different perspective. The perspective in question was the other side of the barrier, the one being broken down by Trump supporters.
Well of course his identity should be protected he is a serving officer, who in the course of his duties protecting the capitol building shot and killed a rioter in a highly charged political atmosphere where many are unjustifiably trying to minimize and reduce the events that took place.
Ordered to shoot? Well there isn’t evidence of that so that’s pure speculation.
Exactly jumping through a barricade , In a volatile environment. It’s suprising more weren’t killed.
Suicide list? What exactly are you suggesting? It very much sounds like you are trying to explain away the officer suicides which are directly attributable to the events in the capitol building. Which is why at least one family is suing some of those involved because of the relation between the lived ones suicide and the things that the rioters did.
“there wasn’t time for her to look around”
Because was shot in the side of neck without warning.
You are sick and demented.
Your rationalizations for her murder are not compelling.
@mark311 — ask yourself, would you be making excuses for the officer if the officer were white and the victim was black ?
Deep down, you know you would go after the officer if he was white. And you would attack the government if they tried to hide his identity.
This is the problem with Progressives – hypocritical double-standards and an inability to recognize that racism against whites (or any other person based on their skin) is STILL racism. But no, progressives commit racism under the banner of “anti-racism” and think that makes it all okay.
Just as some of the worst atrocities in the world have been committed by people professing to act under the guise of worshiping God – Kendi and the other race-baiters have brainwashed people like you – Mark – into thinking that racism is all good – as long as it is directed against the race de jure.
The shooter needs doxxing. I think after that, things will take care of themselves wink wink nudge nudge.
And yet Lon Horiuchi is still enjoying retirement.
I wonder if his services are still used now and then? 1099 tax filing and all that.
And, why is he still alive?
He has been doxxed. I don’t know what the policy is at Legal Insurrection so I won’t name him or where he lives, but it’s not hard to find out.
Last time I checked there is no actual proof that the name released is actually the officer that fired the shot, so I would be careful about repeating it.
He is either a murderer or is covering up a murder.
With the court of Leftist opinion being against Conservatives and the rally Ashlii never had a chance to be avenged
Twelve years -e4?
Air Force rank advancement is extremely slow. It’s not uncommon for Airmen to plateau in rank around e-4 to e-5.
It’s still not even possible to be an E4 in the Air Force at 12 years. They kick you out at 10. She was a reservist for at least part of, if not all of her time in service.
