Trump DHS to Place Stricter Time Limits on Student Visas

DHS to begin placing stricter time limits on student visas

The Department of Homeland Security is set to begin placing stricter time limits on student visas in an effort to reduce the number of “forever students” lacking federal oversight.

The department announced in a Thursday press release that student visa holders will be capped at four years of permitted residency in the country. Current visa holders will have four years from when the new rule takes effect, which will be 60 days after it is published in the Federal Register.

Students requesting additional time to complete their studies must request an Extension of Stay (EOS) from U.S. Citizenship and Immigration Services, which DHS says will shift “oversight from university staff back to federal authorities and subjects applicants to biometric vetting, background checks, and fraud screenings.”

Other changes include reducing the departure grace period from 60 days to 30 days and setting limits on students wishing to change academic programs.

The changes come in response to an increase in what DHS calls “forever students,” or students “perpetually enrolling in courses to avoid departure.”

“For nearly half a century, the outdated ‘duration of status’ system has compromised national security and created an environment ripe for immigration fraud,” DHS Secretary Markwayne Mullin explained in a statement. “For decades, foreign students have been admitted into the U.S. indefinitely, allowing thousands to abuse our immigration system by perpetually enrolling in courses to avoid having to leave the U.S.”

“By implementing clear, finite limits on these visas, the United States is reclaiming its ability to properly screen, vet, and monitor individuals within our borders,” he continued. “This final rule ensures that foreign students remain focused on their primary purpose: completing their studies and returning home.”

In addition to students enrolling in courses to extend their graduation date, and by extension, their departure from the country, many students also overstay their visas outright.

How long before some obscure federal district judge issues a national TRO on this?

Actually, waiting four years for vetting is outrageous.

The vetting should take place after each school year is completed.

If the alleged student is a troublemaker, kick him out!
