Newly Released Fauci Diary Exposes a Major Deception … and a Striking Obsession

Kentucky Republican Sen. Rand Paul’s relentless campaign to prove that former National Institute of Allergy and Infectious Diseases Director Dr. Anthony Fauci misled the public throughout the COVID pandemic made him Fauci’s greatest nemesis.
Although more than six years have passed since the deadly virus reached U.S. shores, most Americans still remember Fauci’s daily briefings and seemingly nonstop appearances on cable news. He quickly emerged as the “face” of the pandemic.
After years of digging, Paul may have finally found what he’s been looking for. His latest release of pandemic-related documents included portions of Fauci’s COVID diary from the earliest days of the crisis. Paul claims, “What he wrote privately and what he told the country are two different stories.”

In a nine-part thread on X, Paul highlighted the most relevant entries. The first, dated January 26, 2020, exposed a serious disconnect between what the director actually believed — that the virus did not originate from the wet market — and what he was leading the public to believe.
Paul wrote: “Fauci writes in his diary: ‘Now we know the market was not the source, it was the amplifier.’ That is January of 2020. The wet market was already off the table in his own private notes.”
[It’s worth noting that Fauci still appears to believe the virus had “jumped from animals to humans.” He simply didn’t know how.]

Less than a week later, on a now-infamous call with 12 prominent virologists, only two had “concluded it was natural.”
Fauci wrote: “The rest felt that deliberate insertion was possible.”
In other words, 10 of the 12 virologists, or 83.33%, believed the virus may have been genetically engineered.
[Note: According to the National Institutes of Health, deliberate insertion “refers to the intentional, man-made addition of specific genetic material, mutations, or molecular features into a viral genome using laboratory biotechnology.” It is a direct form of genetic engineering.]

Yet anyone who publicly suggested that the virus may have resulted from gain-of-function research or leaked from the Wuhan Institute of Virology was derided as a conspiracy theorist and, incredibly, even called a racist.

Fauci is scheduled to testify before the Senate Homeland Security and Governmental Affairs Committee on Wednesday, where he will be pressed for answers on some of the newly released information. In an appearance on Fox Business News last week, Paul said he “will make sure Fauci answers for his dangerous decisions and the consequences they had for millions.”
Still, anyone hoping that Fauci will face justice for any of his deeds will likely be disappointed. On his last day in office, former President Joe Biden issued Fauci a full, unconditional, preemptive federal pardon. But it will be fun to watch him squirm as he explains the latest batch of documents.

If history is any guide, anyone who shows up for a Senate hearing knows it will be a performance art by blustering Senators aimed at both fundraising and maintaining the illusion of differences in political philosophies.

So someone who is a lawyer can tell me if I am right but my understanding is that if he is questioned about anything covered by the pardon he is not allowed to take the Fifth since there is no danger of self incrimination due to the pardon. So he has to answer and any proven lies would be a new crime not covered by the pardon. Rand Paul is gonna have fun with this.
Everyone has a right to remain silent. You don’t lose your rights because you have a pardon, you can only lose your rights if you’re tried and convicted for a crime. Also the 5th Amendment specifies a right to “not bear witness” against oneself. Because you can never know what of what you say may be used against you, you can’t be required to say anything even if what you say (or might say) may appear to exonerate you or seem to be entirely “innocent.” Also, if he’s under oath then there’s always the potential to be held liable for lying to Congress. A subject can refuse to answer questions based on the threat of perjury alone.

In olden days, a defendant would trade a guilty plea or testimony for a reduction in charges and/or sentencing, or even for complete immunity. This was a two-way agreement between parties. A citizen can voluntarily surrender any of their rights. But nowadays, prosecutors impose grants of immunity and then claim the grant imposes an obligation to give testimony, effectively removing the right to remain silent from a subject without the required due process (charge, trial, conviction for a crime). This is an inversion of propriety, as the subject at no time willingly surrenders his right to remain silent. Obviously, I believe this tactic to be unconstitutional.
“This precedent dates back to 1896 and the Supreme Court decision in Brown v. Walker. In his majority opinion, Justice Henry Billings Brown found that if a “witness has already received a pardon, he cannot longer set up his [Fifth Amendment] privilege, since he stands, with respect to such offense, as if it had never been committed.” Brown cited cases dating back to English law and the Aaron Burr treason trial as supporting that conclusion.
A second Court decision, Burdick v. United States (1915), added another dimension to the question. George Burdick, a newspaper editor, published an article alleging misconduct at a customs house. I know the precedent. It’s clearly wrong. The Constitution stipulates that only “due process of law” can strip a person of his rights. SCOTUS says that clause refers to a judicial process, meaning loss of rights can only be accomplished via conviction for crimes. (A pardon from a governor or POTUS is an executive function.)
Note also that Brown refers to a 5th Amendment “privilege” (a clue to where this court’s head was at, which shall go unmentioned in this gentle company). What about one’s (1st Amendment) right to freedom of speech which must include the right to not speak? Or the Ninth Amendment’s declaration that there exists rights that weren’t enumerated? The Ninth Amendment was specifically adopted to prevent what these courts did – seize upon an enumerated right in order to create and maintain a presumption that other rights do not exist. Also, the right in the Fifth Amendment is a right against bearing witness against oneself, not about a right to not speak. These are not the same things. (For instance, the Miranda warning says “anything you say can and will be used against you.” It does not mention “self-incrimination” or even a right to not bear witness against oneself. It refers to speech in general, and the warning really means what it says, because an arrestee cannot know that anything he might say won’t be used against him. So the warning states, “You have a right to remain silent,” period.)
And what about the legal exposure to perjury? This threat is outside of any earlier pardon. The subject has a new found purpose for not bearing witness in a manner that can be used against him as the foundation for a charge only indirectly related to the matter for which the pardon was granted.
What I’m saying is that these actions and decisions are inconsistent with what is protected in the 1st, 5th, and 9th Amendments, and completely ignores the implications of testimony under oath.
Consider the hypocrisy here, that a person pardoned from a crime he did not commit can find himself stripped of a constitutionally-guaranteed right without the benefit of having his situation reviewed by a (guaranteed) jury and can further be punished for attempting to exercise his rights, and he can be treated the same way even if he refused to accept a pardon. It is simply illogical, never mind the fact it flies in the face of the plain language of the Constitution. Does my view limit the power of government, and deny to it the ability to gather what it may consider necessary testimony? Yes, it does. Is it not the purpose of the Constitution to constrain government authority?
You may be new here and not familiar with my comments. I often argue from first principles, as I believe not only is our system corruptible, but the corruption started before the ink was dry on the Bill of Rights. I was influenced by the writing of Lysander Spooner, who was of this mind, and pointed out in his works judicial hypocrisy dating to the founding up until his time (in the mid-19th Century). If you only read one book by him, read An Essay on the Trial by Jury, a book that should be required reading in all public high schools, but it is not for reasons a reading will make obvious.

Yes, Fauci is still exposed to State prosecution(s) and is susceptible to civil suits as well. The pardon applies only to federal criminal law.

I didn’t get the vax. I actually forged a vax card to use in case I needed it for travel etc. Yay me on all that. But I have friends who during this era and since have taken their own lives. The suicide rate went through the roof.
