Men in Women’s Bathrooms – CriticalRace.org Report Highlights Coming Title IX Battles
After SCOTUS ruling on Title IX and girls sports, expect protecting female private spaces to heat up. “No woman should be forced to change in front of a man — this is not and should not be controversial,” said Kemberlee Kaye.
CriticalRace.org, launched in February 2021, is a research group focused on Critical Race Theory (CRT) and its variants, such as Diversity, Equity, and Inclusion (DEI), with unparalleled and authoritative interactive databases documenting the racialization of education, covering over 700 institutions, and cited over 185 times by other media. We are expanding beyond the databases, including using our data to track how schools are rebranding and masking DEI efforts to evade recent court rulings and administrative restrictions.

The Supreme Court recently ruled that states could restrict girls’ school sports to girls, citing a number of legitimate government concerns about letting boys who claim to be girls into girls’ spaces – including safety and privacy – the court recognized that Title IX protects girls school sports. But that’s just part one in what will be an ongoing legal battle which does not in itself resolve whether schools must preserve girls’ privacy and safe.
Which brings us to bathrooms and similar private areas, which already is under investigation by the U.S. Department of Eduction:
Today [June 17, 2026], the U.S. Department of Education’s Office for Civil Rights (OCR) opened an investigation into Buncombe County Schools (the District) in North Carolina. OCR will determine whether the District violated Title IX of the Education Amendments of 1972 (Title IX) by allowing biological men to access girls’ restrooms.
A concerned parent reported to OCR that girls in the District are being forced to share their female-only restrooms with biological men. This alleged exposure not only compromises girls’ right to equal access to education opportunities and programs, but it also puts female students in potentially unsafe situations.
Courts have split on whether school must allow students to use bathrooms that align with their “gender identity.” It’s a legal fight that is ongoing, but with the SCOTUS ruling will heat up.
CriticalRace.org recently analyzed the practice in higher education of forcing girls to share bathrooms with boys finding that 12 of America’s most prestigious universities are putting men in women’s bathrooms. Findings by school at bottom of this post.
An analysis by CriticalRace.org has found that 12 of America’s most prestigious colleges and universities have installed all-gender bathrooms on their campuses, intended for use by all students, including transgender individuals. Five of these universities belong to the prestigious Ivy League conference.
Stanford, Carnegie Mellon, Dartmouth, Columbia, UC Santa Barbara, Brown, Cornell, the University of Pennsylvania, Florida State, Villanova, Stony Brook, and California State Polytechnic Humboldt have been confirmed to offer bathrooms designed for use by all genders, including transgender students and faculty.
Many of these universities also provide students with maps showing the locations of all gender-inclusive bathrooms and locker rooms on campus, with several institutions offering more than 50 such facilities.
Stanford, Columbia University’s Medical School, Carnegie Mellon, UC Santa Barbara, Cornell, the University of Pennsylvania, and Stony Brook all provide maps for students showing the locations of all-gender restrooms, with the University of Pennsylvania offering more than 10 multi-stall facilities. Cornell and UC Santa Barbara each have over 40 all-gender restrooms on campus, including single-stall facilities.
The universities clearly state that transgender and non-binary students are welcome and supported in these spaces. They also note that some facilities, such as multi-stall bathrooms and locker rooms, may be used simultaneously by students of different genders.
Brown University states decisively that they “[support] all people in using the restroom and locker room that aligns with their gender identity.”
Carnegie Mellon says that they have recently taken the initiative to build “restrooms designed with everyone in mind, including caregivers and children, people with limited mobility, and transgender, intersex, nonbinary and gender-expansive individuals.”
Stanford stated that while they currently have single-stall inclusive restrooms, a new construction project is underway to “designate multi-stall restrooms with enhanced privacy features as gender-inclusive restrooms.”
Legal Insurrection previously reported on the initial push for gender-inclusive bathrooms at Harvard in 2023, when the Harvard Undergraduate Queer Advocates launched a petition calling for the construction of additional facilities.
“The petition was kind of born out of a simple idea that folks deserve to have access to restrooms that they feel comfortable with and that they feel safe in,” stated the LGBT group.
The question of how safe students feel using restrooms shared with individuals of the opposite biological sex remains a topic of ongoing debate.
In 2023, Fox News reported that a transgender woman had showered alongside four high school girls in a Wisconsin locker room, raising legal concerns about the privacy and dignity of the freshman girls exposed to male nudity.
In February 2025, a registered sex offender who identifies as a transgender woman was accused of lurking in a women’s locker room in Fairfax, Virginia, an incident that has raised additional concerns about the safety of gender-inclusive locker rooms.
Existing crime data has raised concerns among critics about the potential implications of gender-inclusive bathroom policies. In 2023, a study by the Correctional Service of Canada reported that 44% of transgender women inmates had been convicted of sex-related offenses. As a result, some parents, who may pay upwards of $80,000 in tuition, could find themselves uneasy with the idea of their son or daughter sharing a bathroom with individuals of the opposite biological sex.
To address these concerns, President Trump signed an executive order titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” on January 20, 2025. In the action, the President acknowledged efforts to “permit men to self-identify as women and gain access to intimate single-sex spaces and activities designed for women,” and rescinded a Biden-era directive that “[required] gender identity-based access to single-sex spaces.”
“Invalidating the true and biological category of “woman” improperly transforms laws and policies designed to protect sex-based opportunities into laws and policies that undermine them, replacing longstanding, cherished legal rights and values with an identity-based, inchoate social concept,” states the executive order.

Twelve top colleges and universities across the US — including Columbia University in Manhattan — are expanding the number of all-gender facilities on their campuses amid the ongoing debate over transgenderism, a conservative advocacy group has found.
The all-gender designation opens intimate spaces like bathrooms and locker rooms to anyone regardless of their biological sex, warned Critical Race Training in Education, an offshoot of nonprofit Legal Insurrection.
“Our research continues to reveal the depravity and institutional capture of higher education,” CriticalRace.org managing editor Kemberlee Kaye told The Post.
“These are no longer places where ideas are debated, where intellectual furtherance exists, instead, they’re dangerous and hostile to the point that women are not guaranteed single sex safe spaces to shower or use the facilities.”
The study singles out five Ivy League schools — Brown, Columbia, Cornell, Dartmouth, and the University of Pennsylvania — along with UC Santa Barbara, Cal State Polytechnic Humboldt, Carnegie Mellon, Florida State, Stanford, Stony Brook, and Villanova.
Some of the schools named and shamed by CriticalRace.org boast more than 50 all-gender facilities on campus, and make clear that they are open to transgender and non-binary individuals.
Stanford, for example, has opted to “designate multi-stall restrooms with enhanced privacy features as gender-inclusive restrooms.”
The study raised safety concerns about not desigating female facilities exclusively for biological women, citing a 2023 study by the Correctional Service of Canada that found 44% of transgender female inmates had convictions for sex-related offenses.
“No woman should be forced to change in front of a man — this is not and should not be controversial,” Kaye added.
Legal Insurrection founder William Jacobson, a professor at Cornell Law School, hinted the colleges could face complaints over the all-gender facilities and even a loss of federal funding.
“No decision has been made but certainly we are investigating potential Title IX violations,” Jacobson told The Post. “This raises significant Title IX issues and possible violations, particularly in light of the recent Supreme Court interpretation of Title IX regarding boys in girls’ sports. ‘Gender identity’ does not override female rights as a matter of federal law.
“Female spaces are being invaded in the cause of gender identity.”
On Tuesday, the Supreme Court upheld state level restrictions on biological males competing in girls’ sports even if they are transgender.
Under Title IX of the Education Amendments of 1972, schools are bared from getting federal funds if they discriminate on the basis of sex.

Stanford states the existence of “gender-inclusive restrooms” on its Queer Student Resources website, noting that “recently, more and more buildings, residences, and offices at Stanford have added gender-inclusive restrooms,” while including a map of where to locate the said facilities. The university also mentions ongoing efforts to develop “multi-stall restrooms with enhanced privacy features as gender-inclusive restrooms,” where individuals of all genders can use the same facility simultaneously.

Villanova continues to say that the inclusive restrooms can benefit “many different people, including parents with children, people who may require the accompaniment of a caregiver of a different gender, trans and gender-nonconforming people, or people who simply would prefer additional privacy.”

Cal Poly Humboldt
Cal Poly Humboldt hosts the GIRR (Gender Inclusive Restroom Task Force), which “was established in spring 2019 out of a student initiative to increase gender-inclusive restrooms on Humboldt’s campus.” The committee offered several recommendations, which included “the construction of new restrooms and the conversion of select men’s and women’s restrooms to gender-inclusive.”

An idea struck me. If it comes out the way that the Democrats want and males get the opportunity to play peeping Tom in female locker and restrooms; that there would be a counter-tactic. I assume that the males would be disrobing too. What would the male reaction be if the females all point and laugh at his genitalia and comment crudely on his lack of endowment? The more females who join in, the better. Especially if the group includes an ex-girlfriend of the peeping Tom.
That may be a deterrent more effective than Title IX.

Circa 2017, Brad Smith (chief legal officer for MSFT) signed a friend of the courts doc along with a bunch of other tech companies stating that they supported trannies in girls locker rooms and stated that they would be at a recruiting disadvantage if state they operated in were to not have laws allowing this.
In 2018, MSFT Redmond began a campus wide overhaul of all of their buildings to “mondernize” them. This meant creating those terrible open work spaces where you have no privacy and you have to focus over hearing everyone elses phone calls. No offices except for mgrs. I left in 2018, so I don’t know who this shaped up.
My cousin is a commercial construction plumber and worked on it and said they had gone all in on gender neutral locker rooms. I suspect from some of the ones I had seen prior that this just meant private shower spaces- which would afford some protection.
What you have to grasp is- the architecture for these spaces would have been put in motion several years before this. So this is a vision MSFT was already bought and sold on probably around 2015.
This evil is driven by people with money as much as it is driven by our own money heading into NGOs.
Worked last year at a university building that was all but totally renovated. Took note signs in large bathrooms were gender neutral, but at end of project were changed to what should be, separate sex bathrooms.
Also this building had so many 1 person bathrooms any supposed gender issues are negated, many of these of course are as well handicap bathrooms.
Even 25 years ago and before the Culture Marxists pushed this ‘gender bending’ bathrooms were separate.
It’s mental illness or boys wanting to be with girls, not girls so others shouldn’t have to be subjected with this.

There were coed dorms with coed bathrooms at the University of Rhode Island back in the 1970s when I was there. My girlfriend at the time was living in one and when she’d go and shower there were men in there. I wasn’t totally comfortable with it, having a girlfriend that lived in that kind of environment. I wouldn’t be thrilled if my daughter was in an environment like that when she went to college a couple years ago. I don’t know what to say.
Coed is one thing, but we’re talking about trannies here. By definition, trannies are crazier than shithouse rats. You don’t want them around any important decision making because they are mentally unstable. Definitely not around your food or drink for the same reason. And definitely not around children. Good Lord, definitely not around the children. They belong in an asylum.
Such facilities make some feel safe by simultaneously making others feel unsafe. Shouldn’t “feel safe” be a universal constant? No, in the LGBT world, their “safe” is more important than your “safe”.
The one-person bathrooms near the Huntington Beach Pier were mostly gender-neutral, EXCEPT that a couple were women-only, probably because women left them cleaner than men. They are now all gender-neutral.
If you want multi-person bathrooms to be gender-neutral, the stall doors and walls must extend from the ceiling to the floor. NO GAPS.
