Wisconsin Governor Will Defy Supreme Court ‘Conversion Therapy’ Ruling

Democratic Gov. Tony Evers said he plans to ignore a clear Supreme Court ruling and keep in place Wisconsin’s administrative fiat prohibiting counselors from helping gender-confused kids.

While raising an LGBT pride flag over the state capitol building, Wisconsin Gov. Tony Evers said he plans to defy a Supreme Court ruling on so-called “conversion therapy.”

On Monday, the Democratic governor shared his support for protecting “trans kids” and, in particular, keeping on the books a regulation that effectively bans counselors from assisting gender-confused and same-sex attracted kids.

“Let me be clear: I have no intention of repealing the ban on outdated and dangerous practice of conversion therapy on kids, period, end of story, and no questions,” he said to applause.

The rule did not pass through the legislature after committee hearings, mark-ups, and open debate.

Rather, Evers issued a regulation that prohibited the practice. While the Wisconsin Supreme Court allowed the regulation to go into place in 2025, legal experts say it should fall now that the nation’s highest court ruled against a similar prohibition this year.

In the Chiles v. Salazar case, the Supreme Court ruled against Colorado’s prohibition on counselors helping minors with their same-sex attractions or gender confusion.

By an 8-1 vote, the Supreme Court ruled that the ban amounted to viewpoint discrimination, as Legal Insurrection previously reported.

The same logic could be applied to the Badger State’s regulation, according to an attorney for the Wisconsin Institute for Law and Liberty.

“The statewide rule is materially identical to the law that the U.S. Supreme Court just held violates the First Amendment,” Luke Berg told Wisconsin Public Radio in early April. “So if anyone were to sue against that statewide rule, it would likewise be held unconstitutional.”

He further explained the law: “It bans counselors who have a different view — and clients who want counselors who have that view — to help people who struggle with this, and don’t want to struggle with it, from getting the help that they want.”

Berg’s group ultimately did sue the state in mid-May to challenge the regulation.

His fellow attorney Rebecca Furdek said Evers’ administration ignored a request to change the rule.

“When we notified the Evers administration of this fact, we were met with a blatant refusal to follow the Supreme Court holding, along with inflammatory, baseless rhetoric accusing WILL of ‘bullying’ children and Wisconsinites,” Furdek said, according to Wisconsin Public Radio.

“However, Wisconsin counselors have every right to provide Christ-centered talk therapy to the clients who seek them out for that type of counseling.”

Reporter: How about therapy for normal kids to encourage them to become trans?

    Governor Wallace a true visionary when it came to State’s Rights. I’m so happy Governor Evans finally got in step with the racist past of the demonrats.

Well, gov, why not just create your own nation? Then you can handle the lawsuits, criminals, replace all federal funds you can no longer get – you know if you selectively deny some laws, might as well deny all and pay your own way.

I have known a number of transsexuals and absent coercion, they favor any form of therapy that helps. In other words, a person who has suffered childhood trauma and as a result has dissociative identity disorder or multiple personalities, should be able to try any therapy that person wants to try.

Most will want to try a different therapy, but the point is they need help and they believe they should be able to try any method they believe will help.

Speaking with them, I have heard that bilateral stimulation also known originally as EMDR can help quite a bit with the memories of the trauma that caused the injury underlying their conditions. Typically, some type of traumatic event causes these issues and fetishes. It typically will not eliminate the interest in the fetish, but it will help dealing with every day, life by helping fuse personalities, and just generally making a person more comfortable in his skin.

Honestly, there should be no statute of limitations for anyone who has caused such a trauma to a child. The lifelong struggles these folks have are profound.

It is really sad to see someone struggle so constantly at even the basics of life.

It also makes me sad when I see someone like Milo Yiannopoulos being criticized for things that he has said about his experiences and condition and his thoughts about it, Much of what he was criticized for several years ago, made perfect sense if you have had such an experience. Those who heard what he said simply did not understand exactly what he was saying. They completely misunderstood him. It’s really very sad.

Society owes them so much because we failed them. When they were young they were not protected. Either their family let them down or someone let them down. And let them be victims of crimes. These are crime victims who have suffered serious injuries from the from the crimes against them. I wish they would reveal their abusers, but so few do. And I understand why. But I wish they would reveal their abuser so we can start jailing the son of a bitches. And every time a school tries to enable the transition, instead, they should be trying to figure out who the hell abused that child and put that person in prison.

    “Therapy” is just therapy. It’s meant to help clarify patients’ minds and make better decisions for themselves. Democrats are against kids getting help in ordering their thoughts and emotions. Doing so doesn’t (or at least shouldn’t) slant in any direction. If you’re guiding a kid in any particular direction, you’re “coaching,” not providing “therapy.”

A patient needs to be able to make an informed decision about life changing treatment.

It appears that in Wis when a preschooler says they want to become a member of the opposite sex, you must believe and you must persuade the victim they can never change their mind.

However, the lawsuits are being filed by the victims of Frankenstein doctors who been butchered.

Not surprising. I would also not be surprised to see Virginia Communists pull a similar stunt and forcibly implement the illegal gerrymandering plan the VA Supreme Court overturned.

      I had in mind the Communists doing something more … direct. We have seen the DC Communists are not above openly threatening US Supreme Court justices (when they are not busy trying to incite a military coup). Just send one of the Communist suicidal crazies after the Va Supreme Court – there is no shortage of killers on the Left hungering for glory – and make it clear there is more where that came from unless the Court bows to the “will of the people” (the media will cover for them, naturally).

      Antifa is the armed paramilitary wing of the Communist Party, and in places like Portland and Seattle it already enjoys quasi-legal status. The problem will only get worse.

Interesting tactic by the Gov declaring he will defy the settled law. Similar chicanery/gamesmanship re 2A in some States following a defeat at SCOTUS. Either we’re all gonna respect the rule of law, including SCOTUS decisions, in good faith without trying another ‘one weird trick’ to get around it or we ain’t. No whining when/if other folks decide which statutes, which SCOTUS rulings or even which Constitutional provisions they will ignore nor the means they choose to ensure their defiance is successful.

This could best be handled by going into the state and arresting the governor and any of his staff that has authority to promulgate these regulations. Charge them as appropriate under “violating civil rights under color of authority.” Send them to a fed prison.

    And then have a #Resistance Federal judge cut them loose immediately, instigating a legal process that could drag on for months if not years.

      Nah, that’s what would happen under normal process but these are abnormal times. Instead detain him as a POW in the ‘insurrection’ and/or ‘resistance’ to be held for the duration of the conflict. Of course that would apply to any members of his Staff and folks in other Branches of State Govt that ‘conspired’ to assist this effort to overturn the rule of law. Such a shame the Trump Admin had to take control of the apparatus of the State Govt in a neo reconstruction effort to ensure that these recidivist radicals are prevented from their desired end goal of overturning our Constitutional order. Probably won’t need Federal Troops occupation to support the decisions of the appointed Potentate of WI. While we’re at it go ahead include MN and put Stephen Miller in charge of both with additional duties across the Midwest as needed, assuming other States don’t absorb the lesson. So…what’s he actually doing here? If he’s just not going to repeal it, not really a huge deal. It’s unconstitutional and can’t be enforced. There are plenty of laws still “on the books ” that are unconstitutional. Pennsylvania, for example, still has a bunch of laws about not being able to do business on Sunday. They’re still published in every year’s new edition of the crimes code, even though they’re not constitutional and aren’t enforced. They’re still there because no one took the effort to get the state legislature to repeal them. Many states still had laws banning abortion after Roe for the same reason. Some even added laws after Roe banning abortion in the event that Roe was overturned. If it’s just refusing to repeal the rule, this is just the governor being a petty, whiny loser and having a press conference to make himself feel better.

If he’s actually going to try to enforce it and punish peole, huge deal. That will not go well for him.

    The statutory ban in Colorado (which is functionally equivalent to the ban in Wisconsin) was ruled unconstitutional by SCOTUS, which (oversimplified) held that the State can’t restrict the counselors who provide it nor the patient access to this counseling.

    In response what Gov Evers is doing here is basically giving SCOTUS the finger. He’s not gonna accept the premise that patients can seek an counselors provide this sort of therapy. Instead he is doubling down by issuing a regulation that mirrors the impact of the statutory ban in an effort to preserve the restriction (and throw a bone to the leftist, woke, AWFL and ‘LGBTQIA2S++ (or whatever else they added this week) coalition to burnish his political record and keep the leftist crocodile from eating him this week.

    Too busy on other threads, and life.

    Evers is not directly defying a court order. No court has yet ordered Wisconsin to allow these charlatans to practice. But it’s inevitable that the courts will do so, and when that happens the state will have no legal alternative but to obey. The governor won’t get a say in the matter.
