Rep. Jayapal Admits Talking to Foreign Govts. About Getting Oil to Cuba
Jayapal also said that America kidnapped Venezuelan dictator Nicolas Maduro.
On Monday, Rep. Pramila Jayapal (D-WA) briefed her constituents on her trip to Cuba.
Breitbart News posted a snippet of Jayapal complaining about the oil embargo and President Donald Trump threatening tariffs on any country that sends oil to Cuba.

In January, Trump issued an executive order threatening tariffs on any country supplying fuel to Cuba. This was this January, just a few months ago, and oil shipments from Venezuela, that’s where Cuba had been getting its oil, were halted after the US operations to kidnap Nicholas Maduro.
Since January, only one Russian tanker of oil has made it to Cuba. In fact, it landed just a couple of days before I landed, and one tanker has enough oil basically, for 10 to 14 days of Cuba’s oil means. So it’s a very limited amount of time. Now, Russia has said they’re going to send another tanker. I was in conversations with the ambassadors from Mexico and some other places, and I know other countries in Latin America are trying to figure out how to get oil there, but it is a crisis beyond imagination.
Just this past Friday, on May 1, Trump signed a broad executive order that widens sanctions and allows for new penalties similar to what we have for Iran and Russia, against foreign banks and firms that are dealing with Cuba, and it also reinforces the ban on US tourism. I have called these sanctions an economic bombing of the infrastructure of Cuba. It is illegal. It is against the war. We were talking about this, in Iran, obviously, to bomb the infrastructure of any country, that is against international law. This is essentially doing the same thing. It is bombing the infrastructure of Cuba with economic sanctions that essentially ensure that the infrastructure collapses.

It’s true that President Donald Trump told Cuba no more oil or money in January.
It’s also true that Cuba’s infrastructure has collapsed for months. Jayapal has repeated the Communist regime’s talking points, claiming sanctions have prevented officials from repairing the infrastructure.
I wonder how the Cuban leaders live in luxury, though. Why not use that money to fix the decades-old, crumbling infrastructure?
Easy answer: Communist leaders don’t care about the regular people.
Even without the sanctions, why would anyone invest in Cuba? Secretary of State Marco Rubio provided a lesson on communism to a journalist in March:
What do you mean an economic deal? Look, Cuba’s economy needs to change, and their economy can’t change unless their system of government changes. It’s that simple. Who’s going to invest billions of dollars in a communist country? Who’s going to invest billions of dollars in a communist country run by incompetent communists, which is even worse than communists. The only thing worse than a communist is an incompetent communist.
Jayapal gushed over her trip to Cuba, lavishing praise on Cuban dictator Miguel Díaz-Canel and other officials.

For what? Congressmen and women talk to foreign governments, ambassadors etc all the time. Why they would listen to her is a mystery but I’m not sure she did anything illegal.
Listening is fine. Trying to influence them, and in particular trying to “defeat the measures of the United States” is not. If the Logan Act is valid, then it’s a crime. If the act is invalid, then it’s just wrong.

Jayapal comes out of a district set up so as to guaranty the election of the most extreme leftist who cares to run. I predict Seattle’s current mayor–who is both astonishingly stupid and astonishingly leftist–cycles into this district whenever Jayapal decides/is forced to leave it.
Hopefully, the DOJ will charge her for trying to conduct foreign policy in a manner contrary to the President’s foreign policy and oust her.

Something something Logan Act?
I don’t like her at all, and vehemently disagree with her on pretty much everything under the sun.
However, diplomats talk with members of Congress all the time. It’s part of each of their jobs. The statement she repeated isn’t surprising.
I wasn’t a fan when democrats pulled a similar claim on Jeff sessions, I didn’t support it then, nor now.
It’s no part of a congressman’s job to negotiate with foreign governments, let alone “to defeat the measures of the United States”.
But it is part of a congressman’s job to talk to foreign diplomats, so as to inform herself of their views so can better conduct oversight and legislate on foreign policy matters. And that’s all she seems to have admitted here.
Also the Logan Act is probably unconstitutional.
Sessions was a bit different, since he was the incoming secretary of state and could speak for the incoming administration, and he had a duty to ensure that Russia didn’t take rash actions in the interim that would harm the USA.
It was General Flynn the National Security Advisor that Comey et al saddled with the Logan Act violations and then used FBI interviews to trap him in a misstatement.
It was during Sessions confirmation as AG that the D’s got him to give up oversight of any Russia related investigation due to his speaking with the Russian ambassador as part of his duties on the foreign affairs committee.
Flynn’s comments were no where near a Logan act violation at all, even before considering its possible constitutional issues.

Of course we’ve all seen the videos on how “eating the rich billionaires” would solve America’s financial problems, and their unanimous conclusions that it won’t work. At best, it buys you a couple months of operation, then you’re back in exactly the same morass. Well, the same math holds true in Cuba.
1. The Logan Act is probably unconstitutional. There’s a reason that in more than 225 years it’s never been used. Prosecutors would rather have it in their arsenal to threaten people with than take it to trial and probably have it struck down and of no further use at all.
2. She didn’t actually admit to violating it. If you look at what she said, “I was in conversations with the ambassadors from Mexico and some other places, and I know other countries in Latin America are trying to figure out how to get oil there”. So (at least according to her words) she wasn’t conducting negotiations, just talking to ambassadors and receiving information. That’s certainly lawful for anyone, and how much more so for a member of congress.
3. However if she were to have admitted trying to get other countries to break the embargo and supply oil to Cuba then for what it’s worth that would be “to defeat the measures of the United States”. Even if the Logan Act is unenforceable, acting to defeat the measures of the USA is disloyal, and deserves a censure by the House. Even a congressman has no right to do that.
While O agree with your first point, the Leftists have no problem with the PROCESS being the PUNISHMENT. How about we exhaust her savings (or at least Soros & other Leftys’ monies) on lawyers as they did to Gen Flynn & so many others.
I think you could argue that she is acting as an agent on behalf of Cuba. So, a violation of FARA. Which should definitely get a censure, if not charges.
Also, acting as a foreign agent would seem to be a violation of her oath of office, to at least some degree.
To be an agent of Cuba she would have to be literally taking instructions from the Cuban government, and I’m not aware of any evidence that she’s doing that. Being a friend of a foreign government, and taking actions on your own initiative that you think will benefit that government, is not acting as its agent.
I don’t understand what a Congressman from MI thinks they can do on their own. If she is talking to foreign governments that is legal. If she is somehow negotiating on behalf of the US that is not ok.

It’s not about the Logan Act. It is about a Congressman who has stuck her nose where it doesn’t belong. The punishment should be applied by the House. Speaker Johnson should take the lead on this one and censure her and remove her from all committees and assignments. She can still vote and debate in the well, but just sit in her office the rest of the day.
It seems to me some action should be taken against that nitwit. Let’s try removing her from Congress.

Probably, it’s not like we have anything but a two-tier justice system.
1. It’s probably unconstitutional; no one wants to test it and find out.
2. Nothing she is reported as having admitted to violates it. There doesn’t seem to be any evidence that she did violate it.
Sounds to me like she was acting as an agent working on deals on behalf of the US government — way out of her lane, IOW. Investigate this communist bint and then indict her. Too many of these Democrat bwitches are flying around doing harm.
That is not what she said she did. So unless you have access to some secret evidence, you’re just guessing.

For what kind of conduct? Even if the Logan Act is valid, what she said she has admitted to doing doesn’t violate it.
There is no law against anyone, let alone a congressman, having conversations with foreign ambassadors about matters of mutual interest. So long as you are not trying to influence them, and certainly are not trying to “defeat the measures of the united states”, no law even purports to object.
If you do try to do those things, then you have violated the Logan Act, but that’s of dubious validity. But that’s irrelevant to this topic, since she hasn’t admitted to anything that would violate it.
