New York Passes Sanctuary State Bill, Blocks Police From Cooperating With ICE

Have fun, New York. We’ve witnessed the decline in Virginia from similar laws.

New York state legislators officially granted the state sanctuary status.

Local law enforcement cannot cooperate with ICE. The legislation bans ICE agents from public places. Agents cannot wear masks. From The New York Post:

The measure, which was significantly ratcheted up from Hochul’s original proposal that largely only went after specific localities, like Nassau County, that have cooperation deals dubbed “287-g agreements” with the feds.

The bill passed Thursday bans those agreements and goes a step further — prohibiting all “informal cooperation,” such as a local cop calling ICE if they believe they have an undocumented migrant in custody.

“If it looks and it smells like the 287-g agreement, then it’s part of what this law would say is not permissible,” Assembly member Catalina Cruz (D-Queens) said during debate in the chamber.

Insanity:

  • The so-called “Bivens Act”, allowing people to sue ICE agents should they violate their constitutional rights like by entering their home without a warrant.
  • Barring most public employees, like civilians at a law enforcement agency, hospital workers and DMV staff from any interaction with federal immigration authorities without presentation of a judicial warrant.
  • Creating an “Office of Immigrant Trust” within Attorney General Letitia James’ office, with the ability to enforce provisions of the bill, including going after local governments that don’t comply.
  • Banning all federal law enforcement officers from wearing masks to conceal their identity.
  • Preventing local governments from granting zoning variances for immigration detention centers without a six-month public comment period.

We’ve seen how these “progressive” antics have worked in Virginia, especially Fairfax County.

Republicans lashed out at the bill, especially Assemblyman Matt Slater.

An illegal Venezuelan murdered Sheridan Gordan, one of Slater’s constituents.

The Biden administration released the Venezuelan into the country in 2023:

“I have to go home to my district and talk to the Gorman family, who recently lost their daughter to a tragic situation,” Slater (R-Dutchess) explained on the Assembly floor.

“When you hear what they have to say, they talk about a system that had failed their family. And I am not convinced that the changes here rectify or correct the systems that they have identified in that tragic case,” he said.

Border Czar Tom Homan already threatened to sue and an ICE surge if the law passed.

“What’s going to happen with places like New York and [if] people pass ridiculous legislation not to work with us, we’re going to flood the zone,” Homan said at a border security expo. “You’re going to see more ICE agents than you’ve ever seen before. So, congratulations.”

We all know Homan means business. He quickly took care of matters in Minnesota.

In April, DHS dropped New York crime statistics due to the state not honoring ICE detainers:

As of December 1, New York’s failure to honor ICE detainers has resulted in the release of 6,947 criminal illegal aliens since January 20. The crimes of these aliens include 29 homicides, 2,509 assaults, 199 burglaries, 305 robberies, 392 dangerous drugs offenses, 300 weapons offenses, and 207 sexual predatory offenses. As of December 1, 7,113 aliens in the custody of a New York jurisdiction have an active detainer. The crimes of these aliens include 148 homicides, 717 assaults, 134 burglaries, 106 robberies, 235 dangerous drugs offenses, 152 weapons offenses, and 260 sexual predatory offenses.

Welcome to the further Balkanization of America. The rise of “nation-states” within the borders of the US. I didn’t coin the term as I first heard it uttered by Gov. Newsom. The Dem controlled states are all using the same cookie cutter laws.. lock step. The only difference is the competition to see which states can exact the most laws the quickest. Frankly, these elevate those states to “no-go” zones.

Cut the entire State off from federal LE grants and any federal LE investigatory assistance. It’s not “interference,” it’s just refusing to help, right?

    Yep. No Federal LEO partnership of any kind. Definitely no ‘antiterrorism’ funding. Since they don’t want to work with DHS which ICE works for go ahead pull the Customs agents out of the airports and seaports. Put the Coast Guard to securing the harbors to prevent any unauthorized traffic to these closed ports. Set up flash traffic control points to board EVERY commercial vehicle, obviously that includes passenger trains, busses but not ferry b/c they’re shut down since CG safety mission can’t be performed as they are securing the approaches to all ports. Select every tenth passenger vehicle entering the TCP for elevated scrutiny until a baseline is established.

    Let that marinate for a couple months then if there’s no surrender by NY then golly …the SEC gonna have tell the exchanges and the financial firms to activate back up relocation plans as SEC personnel will be pulled from NY and any other ‘sanctuary State’ so instead of NJ the Financial Firms and Exchanges gonna need to look at TX or FL. Sucks about the loss of NY State tax revenue, oh well I’m sure the leadership of NY will adjust.

This part is definitely not legal. The rest of it has some suspect materials, particularly for those not in state/local law enforcement.

Since the State of New York has functionally left the Union, it strikes me that 1) Federal law enforcement should “informally” investigate any New York officials who had anything to do with this for possible fraud and theft of US government funds and prosecute wherever possible, 2) that no more US government funds be sent to New York, and 3) if you are a cop of any kind in New York, it is time to get the freep out of there and go to another state where you are appreciated.

That’s fine, If the state of New York feels that it doesn’t want to cooperate with ICE or ICE agents then the federal government needs to withdraw any and all federal state aid where it relates to local law enforcement and local law enforcement agencies. No need to fund law enforcement with US taxpayer money if they aren’t going to cooperate with the feds. That is all.

So states are not allowed to enforce federal law, but it’s fine for them to basically nullify. Makes sense /s

New York is a failed state. I’m glad I left – fifty-one years ago.

This is a form of pseudo-legal secession. It should be considered prima facie evidence of insurrection justifying the immediate arrest of Hochul and the entire state senate and legislature. And the AG and anyone else with any power in the state.

I say this as someone who was born in NY state and still live there. Seeing my state try to subvert the rule of law is disgusting.

Sounds like a blatant first amendment violation of every police officer in the state.

Pull all Federal funding from NY, they want to only abide by some Federal rules but not all let them go without.

Why are those who create this law (legislators, governor, AG) as well as those implementing it not being prosecuted for giving “aid and comfort” to persons in the country illegally? They are as guilty of this as are those providing food, housing, employment, and warning of ICE enforcement activity.

The G has handled these people with kid-gloves for a longtime, and this is why things are like they are. Since they don’t like ICE and HSI anyway, then give them a good reason for that dislike. “Book ’em, Dano.”
