Walz Threatens to Deploy Minnesota National Guard Following ICE Shooting
“Well, I said this yesterday. We’ve never been at war with our federal government.”
Minnesota Gov. Tim Walz responded to the shooting that left one woman dead in Minneapolis.
An ICE agent shot and killed a woman who allegedly tried to run him over.
I know I’m late to this, but the clips I found are too short. I needed to transcribe the press conference to make sure I don’t give you guys out-of-context content.
Did Walz imply that Minnesota is at war with the federal government? Sounds like it:
Well, I said this yesterday. We’ve never been at war with our federal government.
Yes, Walz threatened to deploy the Minnesota National Guard against DHS and ICE. It’s a “heads up” that they might be mobilized:
They have a dual mission. There’s there’s the federal mission, when they’re under Title 10 orders, and then they’re under Title 32 orders, and this Warning Order. There’s nothing officially been done yet. If I am to activate them as the Commander in Chief of the Minnesota National Guard, I will issue the executive order to the Minnesota National Guard, and then they will be put in state duty status. And as you’ve seen over the last few years, that could be flood prevention, that could be after a wind blowing storm up in the north, up in Bemidji, or it could be COVID or George Floyd response. In this case, again, it doesn’t necessarily change the mission. They’re there to protect Minnesotans. They’re there to serve Minnesotans. I think the thing that is so challenging in the moment we’re in is we don’t see a desire to work with us on public safety.
Walz also repeated the lies that the 2020 George Floyd riots were mostly peaceful:
They’re not here to cause the hassles to you or what we saw today, the tragedy, having them at the ready to make sure, because when we see these types of things happen, and we saw it after the murder of George Floyd, there’s folks that want to cause chaos. There’s the disruptors in it, and why the vast majority of those protests were peaceful expressions their First Amendment rights. There were those that destroyed property and put people at risk. The National Guard is there to make sure that peaceful protests are able to be done and that those that want to do the destruction are stopped from doing that.
Walz said he hopes America has its “McCarthy moment” regarding the immigration raids across the country. He obviously means Joe McCarthy, who birthed “McCarthyism,” which means causing fear due to unsubstantiated accusations and public shaming.
I’m not saying that’s what is happening, just explaining what Walz means. It’s odd, though, because what he said next sounds like advice he should be taking himself:
And so look, I want to be very cautious here, because Donald Trump will make this about me. He will make this about politics. This is about public safety, and this about normalcy.
To Americans who are watching this, if you’re in Portland or you’re in LA, or you’re in Chicago, or you’re wherever they’re coming next, stand with us. Stand with us. Against this, this. This was so so preventable, so unnecessary, and I don’t know, I hope maybe we’re at the McCarthy moment.
Do you have no decency? Do you have no decency? We have someone dead in their car for no reason whatsoever, and and I, I don’t, I don’t want to be right about this, but I said, if they do this, they’re going to create a chaotic situation where someone innocent is going to get killed. And they did it, and now we hear more political rhetoric.
Enough. Enough is enough, and so to Minnesotans, don’t take the bait. Do not take the bait. Do not allow them to deploy federal troops into here. Do not allow them to invoke the insurrection act. Do not allow them to declare martial law. Do not allow them to lie about the security and the decency of this state. And let’s let this investigation play itself out. Let’s make sure we protect our neighbors. I encourage you to use your first amendment rights and all of your constitutional rights, but do so in a peaceful manner.
Yes, let’s let the investigation play out, even though you literally just said you have someone dead in their car for no reason.

If he actually activates the Guard and orders if to interfere with ICE/CBP operations he will have crossed the line into insurrection. Time for him to go.

If Tampon Tim orders the Guard activated to quell the riots and stop the interference with government operations then that’s fine. Anything else will have him end up in prison.
A district court judge will immediately order him released.

Can’t Trump just federalize the NG?
Not just because he wants to. But if the state calls it out to join an insurrection, then he can certainly federalize it and order it to point its guns in the other direction.
Pretty sure you are wrong about that. The Guard is no longer solely a state militia but a component of the United States armed forces, just under a different Federal title. Some states, such as New York, actually have a completely separate state force (New York Guard) that actually exists outside the DoD framework. The state governor can activate NG units to perform missions inside the state or for other states but the President can nationalize them regardless of what the governor wants, or else Eisenhower wouldn’t have been able to do what he did in Little Rock. The President can’t nationalize them to perform missions that conflict with Posse Comitatus, as recently affirmed by the USSC, but Trump could do in MN exactly what Eisenhower did in Arkansas – nationalize the MN Guard and have them inventory the.contents of their barracks until Tampon Tim and Frey Boy come to their senses (if that’s possible)
The statute authorizing him to federalize the guard specifies the circumstances in which he may do so. That means he can’t do it just because he feels like it.
And you know that those specified circumstances can be interpreted to cover damn near anything. And that some obscure judge will interpret differently.
Interpreting the statute is the domain of the judicial branch. In this case judges are required to give great weight to the president’s opinion, but not infinite weight. If it’s a close call the judge is supposed to decide for the president, but if it’s clear to the judge that the circumstances don’t fit what the statute requires then he can and should find against the president.
The statute says “if this happens”, not “if in the president’s opinion this happens”. It does not give the decision to the president. If Congress meant to do that it could have, but it chose not to.

From the Communists’ point of view Walz’s call for a civil war was a bone-headed own-goal. It makes him look like the Confederate firebrand he is.
The smart play would have been to let AG Ellison indict the ICE agent on phony charges. That may yet happen, but now such a move would look like another desperate Confederate stunt after Walz’s blunder.
Nevertheless I believe Walz’s gambit moved the US significantly closer to civil war – and we have the Supreme Court’s recent moronic decision to thank. Now any Napoleon wanna-be from Federal district judge to Governor on down to county assistant dog catcher can declare himself/herself Commander in Chief of the US armed forces – and it would create a legal mess that could require months or years to resolve. In their eagerness to give Trump a black eye the SC moved the US dangerously closer to open armed conflict.

In PDX the ACLU Karen’s were getting very aggressive in using their cars to harass agents. In any sane world local PD would have cuffed and stuffed them but PDX PD was just allowing it. Because it’s been allowed, they have further pushed the envelope to see how far the ICE agents desire was to avoid being the guy who pops one of them.

Tim Pool raised a good point last night reviewing some of the video. She really did try to run that agent over. Her wheels were pointed in a direction in line with that agent when she started to accelerate. The main reason she didn’t run him over was because her wheels spun out, resulting in her just shoving the agent to the side instead. Not that this matters to lefties and their narratives but a good point to use on the fence sitters and the open minded.

I will look at the video again. My viewing so far has resulted in it being a questionable shooting. Probably one that the agent skates on, but questionable. It looks like he could have stepped back out of the way, although I understand that legally he has no requirement to do so.
OTOH, this was one of those split second decisions. If the wheels were pointing towards him, it puts it in a different light.
The phrase I heard that neatly sums it up is “lawful but awful”. There were several off-ramps to this shooting that could have prevented the loss of life. None of those off-ramps were taken.
If she didn’t block the road, no death
If the officers didn’t approach her car to detain the driver, no death
If she didn’t refuse to get out of the car when ordered, no death
If the other officer didn’t approach the car to assist in her detention, no death
If she didn’t decide to upgrade to felony eluding law enforcement by driving away, no death
If she didn’t assault the other officer with 3,000 lbs of heavy metal, no death
If the officer in front didn’t react by drawing and shooting her in the head, no death
The key aspect of all of these off-ramps is that in all of them, the officers were permitted to skip all those ramps as part of their duties. And she was obligated to take all of those off-ramps to stay within the law.
The President should send in Army/Marines to Minneapolis to protect Federal law enforcement agents from paid protesters. The Supremes in their National Guard ruling pointed out the President t has that authority. Use the example of President Eisenhower sending in the 101st Airborne to Little Rock after federalizing the Arkansas NG and ordering them to stand down. Then if antifa/paid protesters riot declare martial law and arrest them, detain them and deny them bail.
1. SCOTUS didn’t exactly say that, though they came close. Still, that is where this is heading.
2. Martial law is not an option in the USA, except in a county where the courts are unable to function, so there is literally no other option than to let the military administer justice until a court is available to take over from them. That is not happening anywhere in the USA as of now.

I do believe that we are no longer in “law enforcement” but actual declared unconventional warfare. You can not have declarations of Global Ji made on US soil, mobilization of Left Protest Industrial Complex on US soil, activist US judges perverting your belief in our system without acknowledging there is warfare.

I would expect a declared State of Emergency before attempting to declare martial law. There still is a functioning government in Minnesota. It doesn’t function well, but it exists.
No, martial law is simply not an option. The constitution does not allow it. Even when the courts are closed, nothing in the constitution allows martial law, but the Supreme Court has held that in such a case there’s no other option. The law has to be maintained, and if the courts can’t do it then someone has to. Since in such a case the military is the only force that can do it, it’s permitted to until such time as the courts are back in business and can take over again. As soon as a court opens its doors the military no longer has any excuse to do what the constitution forbids.
See what FDR did during WWII. He and the local governor of Hawaii declared Martial Law after Pearl Harbor. California declared Martial Law for a period of time post Pearl Harbor. Martial Law is a government tool to tamp down riots and unchecked lawlessness. Mayors and State government implement curfews all the time. It’s when the federal government steps in that they call it Martial Law.
And the Supreme Court held that what FDR did was unconstitutional and unlawful, and every act that the military administration in Hawaii did was invalid.
What is Gov. Numbskull’s plan? Have the MN National Guard start a war with Ice?
Walz is doing this as a deflection from the scandal involving Walz and Frey. They think the scandal will go away if their lackies in the media push this long and hard enough.
