Hegseth Tells Navy to Review Sen. Kelly Regarding ‘Potentially Unlawful Comments’

“Please provide me a brief on the outcome of your review by no later than December 10, 2025.”

The Defense Department (cannot stop calling it that) posted a picture of a letter from Secretary Pete Hegseth ordering the Navy to review the complaint against Sen. Mark Kelly (D-AZ) by December 10.

From X:

The Department of War recently received information regarding potentially unlawful comments made by CAPT (Ret) Mark E. Kelly in a public video, on or about November 18, 2025. I am referring this, and any other related matters, for your review, consideration, and disposition as you deem appropriate.

Please provide me a brief on the outcome of your review by no later than December 10, 2025.

The investigation stems from Kelly’s participation in a video encouraging service members to defy “illegal orders.”

On Monday, the department announced the investigation.

“The Department of War reminds all individuals that military retirees remain subject to the UCMJ for applicable offenses, and federal laws such as 18 U.S.C. § 2387 prohibit actions intended to interfere with the loyalty, morale, or good order and discipline of the armed forces,” the department wrote on X. “Any violations will be addressed through appropriate legal channels.”

On Tuesday, numerous outlets reported that the DOJ asked the Capitol Police to schedule interviews with the six Democrats who appeared in the video.

The others are:

  • Rep. Jason Crow (CO)
  • Rep. Chris Deluzio (PA)
  • Rep. Maggie Goodlaner (NH)
  • Rep. Chriss Houlahan (PA)
  • Sen. Elissa Slotkin (MI)

All six Democrats have national security and military backgrounds.

“President Trump is using the FBI as a tool to intimidate and harass Members of Congress. Yesterday, the FBI contacted the House and Senate Sergeants at Arms requesting interviews,” Crow, Goodlander, Deluzio, and Houlahan stated. “No amount of intimidation or harassment will ever stop us from doing our jobs and honoring our Constitution.”

Elizabeth wrote about Sen. Ruben Gallego (D-AZ) unleashing a profanity-laced rant against the Defense Department.

Gallego also warned of consequences once Trump leaves office if Kelly is court-martialed.

Hegseth wants attention but he runs his mouth too much. He looks like he wants to be in charge but, instead, he appears petulant. He needs to tread lightly on this lest he play into their hands. This is not the time for drama. It’s the time for command.

When does accountability come into play? The D’s are rarely, if ever, held accountable. And only when they chose to eat their own. The R’s just become a circular firing squad, and don’t want to be seen as bad guys. Its always Lucy saying she won’t pull the ball, and Charlie Brown forever believing her.

You seem to be implying that the SecDef Hegseth is grandstanding. I disagree, he’s directing the SecNav to begin an investigation into public conduct of an individual subject to the UCMJ to determine whether this individual committed an offense through his actions that was ‘prejudicial to maintaining good order and military discipline’ and deliver the results and recommendations for disposition back to him NLT 10 Dec. That’s entirely reasonable and appropriate given that Kelly is not just a Naval Retiree but also a sitting US Senator. This way Hegseth redirects any ‘smoke’ arising from this off his subordinates and onto himself. Seems like good leadership to me with the boss setting himself up in between his subordinates and the inevitable slings and arrows of feigned outrage inbound when consequences are even contemplated for d/prog antics.

The twitter one upsmanship is petty and unbecoming. It is Trump’s style, and Hegseth apparently too.

Grandstanding? Yes, I believe he is, and it makes him look petty. He needs to simply get it done. I can’t disagree with your observation that he’s willing to direct the heat away from his subordinates and onto himself, which is what any competent commander should do, but the way he’s doing it says “Look at me.” Okay, he’s in charge but we know that and he doesn’t need to tell us. Actions speak louder than words. Just do it.

That’s a fair point but without releasing the memo directing the SecNav to conduct the investigation he can’t pull the heat away from them and onto himself at least not in so public a fashion.

Like his political mentor Jefferson Davis, Kelly is a US Senator and military veteran who chose to wage war on the US.

I think it’s funny all the people who were trying to suborn mutiny carefully phrased their crap to be about any future illegal orders the military receives, but are screeching about this – which talks about “potentially unlawful” actions.

Kelly didn’t say anything wrong. Anyone who went through boot camp knows they cant be ordered to break the law.

This is the ‘shiny penny’ that Trump is so good at showing the dems. When they decide to jump on him for it, he shows them another ‘shiny penny’ and they jump on that new shiny penny.

Much ado about nothing.

The repubs should leave it alone.

“Senator Kelly…..Rep Swalwell has said that troops are being aligned to compromise orders given by the Commander and Chief President Donald Trump. What have been your conversations, if any, with Rep. Swalwell? A reminder that you are under oath.”

If he gets a insubordination result hope he loses his military rank and privileges.

This is Seven Days in May stuff.

I’m with Pete all the way!!! Kelly crossed the Rubicon!!!

Mr Gabby Gifford’s cuck has destroyed all credibility with his TDS. Just be recalled to active duty, take the Courts Martial and reduction in rank and go away you pos

Oh, wait. Milhouse hasn’t chimed in on this informing us of the 1st Amendment and how righteous this ass clown is so we should wait to be educated

Two bodies of law, one civilian and one military. On the civilian side, “sedition” (actually, seditious conspiracy) doesn’t apply because it has to include action. As disgusting as those six are, they didn’t take any steps to implement anything.

On the military side, I think (but very much might be wrong) that the courts have held that the UCMJ applies to retirees only if (and after) they are recalled to active duty. So I’ll be surprised if there are any grounds to take action against them under military law.

I have said as much to an outraged military veteran friend who wants them prosecuted, and after a good dozen assurances that I regard those six lawmakers as worthless pieces of shit but that being a worthless piece of shit isn’t necessarily illegal, he at least said that he respected my amateur legal analysis.

But again: They are worthless pieces of shit.

This is a needless witch hunt by overly sensitive petulant ignorant people that have a power complex and a big mouth and want to literally fight against every idea that doesn’t come from themselves.

I believe that all these Dems went over the line. They all should be charged for sedition, but I doubt it will happen in civilian or military court. Dem politicians always seem to skate from being charged of things they have done. If they see a court and get convicted they usually will get no time or community service.
