A federal grand jury in Alexandria, Virginia, indicted Comey on Thursday on charges believed to stem from Comey’s testimony to the Senate Judiciary Committee in September 2020 about the FBI’s investigation into links between Trump’s 2016 presidential campaign and Russia. Prosecutors sought the indictment just before a Sept. 30 legal deadline that would have put criminal charges out of reach because the statute of limitations would have expired.
The Justice Department issued this press release:
Today, a federal grand jury has charged former FBI Director James Comey with serious crimes related to the disclosure of sensitive information.
The indictment alleges that Comey obstructed a congressional investigation into the disclosure of sensitive information in violation of 18 USC 1505.
The indictment also alleges that Comey made a false statement in violation of 18 USC 1001. Comey stated that he did not authorize someone at the FBI to be an anonymous source. According to the indictment that statement was false.
“No one is above the law,” said Attorney General Pamela Bondi. “Today’s indictment reflects this Department of Justice’s commitment to holding those who abuse positions of power accountable for misleading the American people. We will follow the facts in this case.”

An indictment is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

It should be. But holding it in Alexandria, with a Biden-appointment judge, is not going to lead to an ideal outcome. This judge has gone after Trump officials in the past. So what is DOJ thinking here?
They don’t have many good options. Trial in Northern Virginia is better than DC. Odds aren’t good that he will be convicted but the good guys have to try and keep putting the pressure on.
Perhaps he will commit perjury, or other crimes will be discovered, and he will be tried on them as well.
Not optimal but better than just giving up and not exposing his crimes. Just having to go through the prosecution might well deter other bad actors.

One of my comments re HRC is that a prosecutor as part of decision to indict has to include the probability of obtaining a conviction. I stated that one of the reasons Hillary was basically immune from indictment was because the jury pool in DC or NY was so solid democrat that it was impossible to get a conviction with that jury pool .
Its the same issue with Comey along with the factor that northern virginia/dc hates Trump.

If you recall, he told subordinates to only accept orders that came from himself to prevent Trump from issuing lawful orders directly. This was mutiny and encouraging insubordination (asking subordinate officers to refuse orders that come directly from the POTUS).

So the judge that has been assigned the James Comey case goes by the name of Michael Nachmanoff. He was appointed as a federal judge by Joe Biden. But the plot thickens. Nachamanoff was given his first job out of law school working for the eastern district of Virginia by James Comey in 1995-1996. And then hired back again by James Comey once again in 2002 after working in a private practice didn’t work out well for him. You can’t make this shit up. It’s right there on the Internet just open your eyes and look. Nachamanoff worked for / with Comey! This is a massive conflict of interest, and he must recuse himself immediately!
