Trump Admin Rescinds Biden-Era Mandate on Emergency Room Abortions
I wonder how many women who had an abortion under this mandate actually faced actual life-threatening conditions (not counting ectopic pregnancies because those are deadly).
The Department of Health and Human Services (HHS) and the Center for Medicare and Medicaid Services (CMS) scrapped an abortion mandate under former President Joe Biden, forcing emergency room doctors and non-abortion emergency hospitals to perform abortions even if it violated their beliefs.
Biden’s admin mandate was its interpretation of the “Emergency Medical Treatment and Active Labor Act,” or EMTALA.
The Alliance Defending Freedom (ADF) sued on behalf of the Catholic Medical Association, but will now drop the case.
The media and the left have framed the story as anti-female, twisting it to brainwash people into thinking the administration wants pregnant women to die.
Well, even in states with strict abortion laws, doctors are allowed to treat ectopic pregnancies and other life-threatening conditions.
Unfortunately, the CMS released a vague press release, allowing pro-abortion people and the media to spread fear.
CMS said it would “work to rectify any perceived legal confusion and instability created by the former administration’s actions.”
“CMS will continue to enforce EMTALA, which protects all individuals who present to a hospital emergency department seeking examination or treatment, including for identified emergency medical conditions that place the health of a pregnant woman or her unborn child in serious jeopardy,” according to the press release.
However, if one sits back and actually thinks, it seems to protect pro-life doctors and religious private hospitals.
You cannot get an abortion at a Catholic hospital. As far as I know, Catholic hospitals and medical systems like Mercy don’t even perform vasectomies or tie a woman’s tubes. (If I’m wrong, please let me know.)
It also means a pro-life doctor at a facility that performs abortions isn’t forced to perform an abortion.
In other words…freedom of religion.
All states allow abortion if the mother’s life is truly in jeopardy.
But in this day and age…there are so few instances where it’s hard to justify ending an unborn human’s life to save the mother.

Now end mandatory ER services requirements for non insured/can’t pay. Alternatively require reports on immigration status to ICE. Create a bill and hold the individuals accountable for non payment by withholding govt payments of all kinds and wages garnished. If people want to support the uninsured medical care financially then they can donate to Charity hospitals.
Getting ER admission / treatment for an actual injury or heart attack or stroke or pregnancy gone medically life-threatening is NOT the same situation as (say) treatment for plastic surgery or trans surgery or pregnancy that you just don’t want.
(Yes, I’ve heard the argument that trans treatment & surgery “saves lives” – problem is suicide rates don’t drop post treatment so there’s no good evidence it actually does that. You want to reduce the size of your schnoze or increase the size of your headlights or remove your joystick so as to feel better about yourself – go ahead if you’re an adult. Just don’t ask strangers to pay for it. Same for voluntary abortions – either pay for it yourself or buy additional medical coverage if for some reason birth control wasn’t for you.)
My family was raised Catholic – some of it stuck even if we don’t attend as adults – my one elder sister was a surgical RN who switched specialties from surgery to psychology when it became clear unless she was willing to perform at-will abortions her career progression was limited. .My one younger sis had a daughter with a rare genetic problem and though she would have liked more kids didn’t – she didn’t want to abort any babies that also had the problem.
Someone who hates Catholics may get a thrill at the thought of forcing them to pay for or actually perform an at-will abortion but your power-trip or “freedom of choice” doesn’t trump someone else’s freedom of choice. You can get your cake with male genitalia frosting designs at some other cake shop and your at-will abortion performed by some other medical professional.

I didn’t write one word in support of.forcing any medical provider to perform or forcing any IN program or employer to pay for an abortion.
My post is an additional restriction on RECEIVING not providing medical care so that no hospital would be mandated to treat the uninsured for anything including ER services. I really don’t see how you could jump to the grossly incorrect conclusion that I am proposing anything other than that.
CC – only the 1st para was addressed to you specifically – I would disagree with not providing normal life-saving procedures for the indigent – I would agree they have no right to non-life-saving procedures.
The rest was getting ahead of the curve because inevitably someone on this thread will try to argue that refusing to pay to chemically sterilize a child or cut off their tally-wacker because…. trans “rights”… is murder. Or that not having a “right” to at-will abortions is murder.

I definitely disagree about forced medical care. Doesn’t matter what the procedure or treatment consist of. Any coercion is equivalent and.IMO no one has a ‘right’ to force others to perform services and definitely not provide them without payment. That’s nothing more than short term slavery or theft dressed up in an emotional appeal.

Life saving care will never be ended. Bad visual to have people dying on the hospital steps. I
could see the hospital directing non critical cases to urgent care which is much cheaper and
often all that is required but even such redirection might be a tough sell.

You could do that but considering the code of medicare care and the size of payments this is akin to getting blood from a rock.

I didn’t say ‘end life saving care’. I said remove the legal compulsion/mandate to provide ER care. Didn’t exist until ’86 if I recall so it isn’t as if we don’t have significant living memory without it. Route the indigent to Charity hospitals or teaching hospitals.
Reporting to ICE on immigration status is gonna become the norm across all social services or the support for continued taxpayer funding for those service will crater. Staff can be charged and work as an orderly in the prison hospital while they serve their sentence.
Medicare payment rates gotta change to market rates. We must get to transparent billing on a fee for service basis to get control of costs. In any event upping the garnishment to 30% and as highest priority above other garnishment will definitely work. For public assistance/Social Security take 1/2 the amount until repaid.
People have to take responsibility for the consequences of their actions. When society refuses to to do so and instead offers bailouts for bad decisions or a series of bad decisions it provides perverse incentives creating moral hazard.

100% of women who had abortions under this mandate. Because once you open up the “life-threatening conditions” exception you can bet every abortion doctor will find and sign off on any “life-threatening condition” for a woman seeking an abortion.

I can think of a few situations but pretty uncommon. I can’t think of a situation that would require a abortion in the ER.
Contrary to the claim of this piece, ectopic pregnancies are not deadly – there have been live births. While healthy mother and child may be less common, death is not a guaranteed outcome.
