Newark, NJ, Mayor Sues Alina Habba Over Arrest at ICE Detention Center
Newark Mayor Ras Baraka is also suing Habba for defamation.
Newark Mayor Ras Baraka filed a lawsuit against Alina Habba, the interim U.S. Attorney for New Jersey, over his arrest at an ICE detention center on May 9.
According to the filing, Baraka seeks “damages and to remedy” Habba, “subjecting him to false arrest and malicious prosecution” for allegedly violating his rights protected by the Fourth Amendment.
Baraka is also suing Habba for defamation.
Authorities arrested Baraka at the Delaney Hall ICE detention center in Newark after he ignored warnings to leave.
“Baraka reportedly entered the federal facility without authorization and refused to leave when ordered,” reported Shore News Network at the time. “Homeland Security Investigations issued repeated directives for the mayor to remove himself from the premises, which he allegedly ignored.”
Fox News reported that the City of Newark filed a lawsuit against GEO Group, alleging “it failed to permit entry to safety inspectors and violated city construction code, including by conducting electrical and plumbing renovations without proper oversight.”
Reps. Rob Menendez Jr., Bonnie Watson Coleman, and LaMonica McIver were also at the center, demanding entrance in the name of oversight.
Baraka claims the authorities arrested him “without probable cause while peacefully complying with law enforcement orders.”
Baraka accuses Habba of working with DHS and outside of her “prosecutorial function” by ordering “the unlawful arrest, later broadcasting defamatory and prejudicial statements to the public before” anyone booked or charged him.
Habba’s office later dropped the trespassing charge after a judge lashed out at her over the arrest.
The judge also dismissed the charge with prejudice. Habba’s office cannot refile the same claim.
Habba has also charged Rep. LaMonica McIver (D-NJ) for violating Title 18, United States Code, Section 111(a)(1) for assaulting, impeding, and interfering with law enforcement.

Baraka is also suing Habba for defamation.
The plaintiff in a defamation lawsuit has to prove maliciousness. Good luck with that.
And criminal charges – unless egregiously bogus – are not allowed to be considered defamation, I’m pretty certain. If ANY probable cause can be shown, and it isn’t prosecuted as “false arrest” you’re going to lose.
I see we’re continuing with the judicial policy of “it’s not a crime if a Democrat does it”.
What this actually is is a person who wants to be Governor desperately trying to keep in the media spotlight

When did the facility refuse access to which building inspectors and under what conditions? Let’s be logical with questions: If the inspector is the mayor then he has nothing to stand on if his credentials, if they exist, aren’t current and he isn’t serving as an official inspector. Give him enough rope.

The city had sent various inspectors to the facility over the weeks before the incident. The federal contractors running the place turned them away because the federal government is not subject to the local code. That’s why the congressmen decided to show up and exercise their right under federal law to do a surprise inspection, and Baraka decided to tag along. The facility said we have to let them in, but we don’t have to let you.
I wonder if the mayor has learned the old rule of politics that

But isn’t bright enough to realize that the Federal Government has a city hall that’s bigger than his.
I’m not an attorney, but I am willing to bet that in a city hall measuring contest, he’s gonna lose.

It was a mistake to drop the lawsuit especially if he is on camera breaching the gate or physically touching the officials preventing him from entering. To late to refile the case?

He claims he was peacefully following orders. ICE says he was ignoring orders. A lot of ICE agents will testify against him, plus there’s video.

The difference is that they have the right to demand entrance, at any time and without notice. Baraka does not.
That applies only to democrats. I recall many times Republicans have attempted to enter federal facilities and were refused entrance.

You are wrong, as usual. The law is very clear. All Congressmen, regardless of party, are entitled to enter any DEI facility that is used to detain prisoners, in order to conduct oversight there, at any time and without any notice. Since that law was enacted no Republican has ever been refused entrance to such a facility.
Not true. Republican congresspeople were denied visitation to the J6 gulag at least one time, if not more.
The “J6 gulag” as you call it is not a DEI facility.
Sorry, I meant DHS facility, of course, not DEI. All these acronyms can get confusing. But the law specifies “Any facility operated by or for the Department of Homeland Security used to detain or otherwise house aliens”. As far as I know there is no similar law covering facilities used by the Bureau of Prisons or any other agency to detain J6 defendants.
I hope the judge finds the the mayor exceeded his authority and orders him removed from office.
The judge can’t do that. He has no power to make such an order. Even when Baraka was charged with an offense, and could have been convicted and sentenced, that sentence could not have included forfeiture of elected office. And of course now he’s not charged with anything, and can’t be any more, so there can be no conviction or punishment.
