Democrats Burn Their ‘No One Is Above the Law’ Card in Response to Wisconsin Judge’s Arrest
“While all the facts are not yet in, the implications of this arrest are chilling. This is a drastic escalation and dangerous new front in Trump’s authoritarian campaign of trying to bully, intimidate, and impeach judges who won’t follow his dictates.”
One of the most oft-repeated talking points from Democrats and media figures during President Donald Trump’s first term in office and the four years after was “no one is above the law.” They said it in part because Trump had the nerve to fight back in the court of public opinion— and courts of law when necessary — against the Democrats’ blatant lawfare schemes.
But it didn’t take long before their masks slipped off, once again revealing who they really were underneath: crass hypocrites to whom the rules – and their purported “standards” – don’t apply.
Such has been the case this week after the arrest of Milwaukee County Circuit Judge Hannah Dugan, 65. According to the FBI charging document, Dugan was taken into custody by the FBI for two alleged U.S. Code violations: “Obstructing or impeding proceeding before a department or agency of the United States” and “Concealing an individual to prevent his discovery and arrest.”
Judge Dugan, as Legal Insurrection reported, was arrested Friday morning after witnesses said she helped 30-year-old Mexico native Eduardo Flores-Ruiz, an illegal immigrant, and his attorney evade an arrest from ICE. The judge allegedly steered them out of her courtroom, where Flores-Ruiz was last week for a pre-trial hearing on three misdemeanor counts of battery, and through the jury doorway instead of the main courtroom door, where members of ICE were waiting outside for his hearing to conclude.

Flores-Ruiz eventually tried to flee but was arrested after a foot chase.
Though Dugan has since been released from custody, Democrats consumed by Trump Derangement Syndrome have escalated their inflammatory rhetoric, effectively nuking their “no one is above the law” talking point in the process:

There’s no way she can now claim to not have known the purpose of the ICE agents at the court. She allowed her late-stage TDS to get the better of her. If she had kept her wits, she could have possibly played the situation in a way to maintain plausible deniability. But now now. That ship has sailed.

It would appear that the FBI and ICE agents attempted to bend over backwards to comply with the requests of the Chief Judge (Dugan’s boss, apparently) to NOT make any arrests within the courtrooms or other “sensitive” areas, but ONLY in the public areas, specifically having asked if the public hallway OUTSIDE the courtroom was a public space. The Chief Judge having agreed, they continued with their original plan to arrest him in the hallway. One of their stated reasons for doing this here, rather than in the street prior to his criminal court appearance was that he would have to pass through security “screening” and would therefore have a much lower probability of being armed, and that the arrest could be done quietly (and with 6 guys there, overwhelming force) and without fuss.
The back-up affidavit also makes it clear that “Judge” Dugan was quite blatant in her actions to aid and abet the illegal (who’d already been throw back once in 2013) in his evasion of arrest.
Not only that, she made it much more probable that some type of altercation would ensue following his initial escape and continued evasion. It is easy to see that had he made any preparations in advance to have a friend provide him a getaway car or worse yet a weapon, it is quite probable that “Judge” Dugan’s actions could have resulted in injury or death to innocent bystanders.
The affidavit makes it quite clear that she willingly and knowingly broke the law(s). What’s amazing is that she may actually have to pay some kind of price for it. Normally just having the “D” after your name is a guarantee of lack of indictment, but she may be in for the “FO” portion of FAFO. Of course, if it’s a jury trial no one in Milwaukee will ever vote to convict her regardless of the facts.
Almost everyone agrees that no one is above the law. The problem is that some people “think they are above the law”.
Case in point—may I introduce you to one such person who was so detached from reality that she considered helself above the law:

There is a copy of the arrest warrant being shared on social media. It looks to be genuine. The complaint came from the FBI, but the warrant was signed off on by Stephen Dries, a FEDERAL MAGISTRATE.
It wasn’t just the Trump administration, it was also a member of the judiciary.

The FBI presented the magistrate with sufficient probable cause for the warrant to issue.

A magistrate is appointed at discretion of Art III CT to aid/assist workload… in a way analogous to doing triage and providing lower level care like.a.Physicians Asst or a Nurse Practitioner working under supervision of an MD. Wonder how many folks demanding and declaring that a Federal District Judge is the only source of ‘real judicial authority’ b/c of their Art III status as Inferior Courts are also objecting to the use of magistrates to sign off on search and arrest warrants or make basic rulings on bond or discovery and other early motions? They ain’t appointed by President, subject to advice and consent confirmation vote of Senate so they ain’t Art III Judges anymore than an Immigration CT Judge is.

A Magistrate Judge is basically a staff member of an appointed Article 3 Judge, and as a staff member, (s)he is tasked with handling the VERY routine stuff (Pleas, Initial Appearances, sometimes Initial Bond hearings, Officially re-reading the Accused their Miranda Rights in Court on the Record). They CAN have more powers if the Article 3 Judge delegates them more, or if the parties AGREE to have an action heard by the Mag Judge (usually for efficiency purposes). Parties that don’t like a ruling of the Mag Judge can file either for De Novo review by the Art. 3 Judge, or can appeal directly to the District Court of Appeals for the region.
There IS a procedure for objecting to a Magistrate Judge hearing any part of a Federal case (be it Criminal or Civil)

Though the point is the folks who breathlessly sneer at the rulings of Immigration Judge b/c those Judges are not Art.III Judges declaring their rulings should be ignored on that basis seem silent on Magistrates who handle all sorts of very important issues like signing off on a search or arrest warrant to conduct a kinetic raid at a residence. These same folks also ignore the impact of other non Art III rulings from agencies SEC, Tax Court, FEC, FCC. SSA VA determinations….and the Military Justice system which has its own CT of Appeals where the only possibility for Art III review is SCOTUS, assuming they grant cert.
Either non Art III processes are valid or they ain’t. The folks whining loudly that non Art III decisions are somehow not valid, can be ignored and the like need to choose a lane: valid/invalid, consistently apply it and be willing to live with the consequences. No pre-dawn raid with dozens of FBI in full tactical gear and automatic weapons
