Leftists are outraged about the planned deportation of Mahmoud Khalil, the anti-Israel activist, and recent graduate of Columbia University.
Large crowds marched through the streets in New York City on Monday afternoon. Some of them are even calling this a free speech issue without a hint of irony. Leftist students can practically burn down a college campus if Ann Coulter is invited to speak and get conservative staffers fired for making them feel ‘unsafe’ with their speech, but Mahmoud Khalil’s free speech must be protected at all costs, apparently.
And of course, an activist judge has already stepped in to protect Khalil.

A judge is slamming the brakes on the Trump administration’s attempt to deport a pro-Palestinian activist who helped lead Columbia University’s 2024 student encampment protests.
The judge ordered the Trump administration and attorneys for Mahmoud Khalil to appear for a conference Wednesday morning at 11:30 a.m. at court in Lower Manhattan.
“To preserve the Court’s jurisdiction pending a ruling on the petition, [Khalil] shall not be removed from the United States unless and until the Court orders otherwise,” Judge Jesse Furman wrote.
“This is good news and we have to keep fighting, both to ensure that he is released and to protect free speech,” said Jamie Beran, CEO of Bend The Arc Jewish Action.
“It doesn’t matter what our views are, we are all vulnerable as long as any one of us can be detained without due process,” supporter Madeleine Elfenbein added…
Word of the judge’s decision comes as protesters took to the streets of Manhattan to demonstrate against Khalil’s arrest. Demonstrators gathered at Foley Square to call for his release. That group of protesters then started marching through Lower Manhattan.

Unlike them, I know history. Since 1917 and the Balfour Declaration, Muslims have been clear that they would wipe any attempt to form an Israel off the map. By the 1930s they started terrorizing Jews (and got the worst the worst of it when the Jews defended themselves).
In WWII, the Muslims were first non-Germans to support the Nazis and formed multiple SS Divisions so they could murder Jews.

Judge Furman of SDNY blocked the Trump administration from removing Mahmoud Khalil from the US, “a Radical Foreign Pro-Hamas Student,” as the White House described him.
According to reports, Khalil was moved not out of the US, but to an ICE detention center in Louisiana. Why is that important? Because while Furman issued his order based on Khalil’s New York petition for habeas corpus (i.e., that he be released pending further litigation), the law requires that the petition be filed in the federal court district the subject is being held in. If Khalil isn’t in New York anymore, and it seems fairly certain he isn’t, then Furman has no jurisdiction over the case.

I’m probably being unfair to this judge and his family but I’m pretty tired of progressive Jews with their holier than thou anti-Western values sabotaging the system that affords them the luxury of allowing them to sabotage it. It’s also time we harshly deal with miscreants like this “protest leader”. He and his ilk shouldn’t even be in this country. There is no value to us having him here.
Generally (but only generally) speaking, “observant” and “Progressive” don’t go together.
His family does have a history of support for Democrat causes, but that was long ago, when the Democrats were several orders of magnitude less insane than they are now. I have no idea what his politics are, or what his family’s are nowadays.
However, big caveat, like Prof J he is a member of the Conservative movement, not Orthodox, and Progressives are much more prevalent in that movement, though they tend to be concentrated on the less-observant side of the spectrum. PA governor Josh Shapiro is also Conservative, and apparently observant, but fairly Progressive. So there is that.
In any event, as far as this case is concerned we have no idea what he believes. He has given no indication of his opinion, so all the right-wing criticism is completely out of line. All he’s done is what any judge would do, which is keep the petitioner within US jurisdiction until the petition can be heard. That doesn’t reflect any opinion whatsoever on the petition’s merits.

Why are they claiming he’s a student? He had graduated and was just living in student housing as a courtesy from the school.
Just as the Iranian embassy hostage takers were 30-40 year-old “students”. And illegal men able to grow full beards crossing the border are “youths” and “children”. You can’t play the Victim Card if you don’t play The Game.
And, arguably, the school was giving him that privilege in order to keep him listed as a student. I don’t know that, but I can see it being true (given what else we know about this school, and academia in general).
Had a coworker, Chinese (Taiwanese) foreign student who has finished his degree program at Syracuse University. His wife was still a student at SU and while he was waiting for her to graduate he continued working at the store – as management – rather then not work even though he only had a student visa. Someone – prob jealous that he got to be a manager – because he was best one there for the job – ratted him out to INS. He got sent home sans wife.
Store really REALLY needed good managers, no one else was really able to do his job well. It benefited no one to expel him, and someone incapable of NOT working for a year – when he d-well could have – and capable of higher level work – is just the sort we need to allow to stay.
Whereas no progressive cares if a productive benefit to the country person gets on the bad side of INS, if they’re someone all “Death to USA / Israel / Jews” and no benefit to us, they qualify for staying here on both of those two things, apparently.
This is not activism. Any judge would have done exactly the same. There is a petition pending, and no judge would allow the subject to be deported before hearing it. If the government has solid evidence that he has committed a deportable offense then the judge will lift the order.

Does this particular Judge have jurisdiction given the petitioner is reported to be in Louisiana, IOW not located in the Circuit, much less District, where the authority of Judge exists? If the Judge issued an order for which he lacked authority then that is activism.
Judge/Forum shopping is a two way street and even if that’s what the Gov’t did here by removing this petitioner to Louisiana …that’s tough cookies.

Sure it would. If the petitioner filed in the wrong Fed CT he is SOL b/c that District Judge has exactly the same amount of authority over this petition as you and I have; zero. Politely tell him so and move on is all they gotta do. Come to it the Admin can use the authority of the Alien Enemies Act which offers basically zero oversight to the Executive; as a practical matter it may as well be a plenary authority.
He’s reported to be in LA now, but he’s equally reported to have been in NY when the petition was filed.

A visa is a privilege like a government grant. It doesn’t have to be awarded in the first place. But like a government grant, once awarded it can’t be canceled as punishment for exercising a constitutional right.
And in this case it’s not just a visa but a permanent residence permit, which makes him a “US person”, protected by the constitution even when abroad.

Actually, it can. Any grant of residency, via visa or green card, is probationary. Violation of anything that would have prevented the award will get it revoked. At least, if you’re following the rules.
