LIF, launched on March 1, 2019, grew out of this Legal Insurrection “Blog” that started in October 2008. LIF consists of three projects: The Blog, CriticalRace.org (launched February 2021) and the Equal Protection Project (EqualProtect.org)(launched 2023).
All of our projects fight against discrimination done in the name of Diversity, Equity, and Inclusion.
We seek to end “Need Not Apply” practices. At many institutions in higher education, racially and ethnically exclusionary scholarships and programming send clear messages to White students, and sometimes also Asian and Hispanic students, that they need not apply.
We completely reject the notion that the remedy for past discrimination is present discrimination, or that the answer to racism is more racism. And we are ready to marshal all our legal and public relations resources to fight for equality.
At the Legal Insurrection Foundation, we’ve built a powerful weapon to dismantle “need not apply” discrimination. Through the work of EPP and CriticalRace.org, our researchers and attorneys investigate and expose DEI discrimination. And then we take legal action to stop it and to shame the institutions for violating our most fundamental principles of equal protection of the laws.
In less than two years since launch, EPP has challenged over 50 colleges and universities regarding almost 150 separate discriminatory programs. Among our recent cases, we have challenged:
- 51 discriminatory scholarships at the University of Rhode Island
- 42 discriminatory scholarships at the University of Illinois – Urbana Champaign
In approximately half of our cases, the institution cannot stand to have their discrimination exposed in the media and opt to remove discriminatory terms of the programs.
We have received enormous media recognition and coverage reaching at least several million people a month.
But we go beyond cases. We have been a leader in exposing discrimination in the name of DEI being built into algorithms and Artificial Intelligence that operate behind the scenes. In some ways it’s worse to have “need not apply” operating secretly.
We also have stood with the Asian community in fighting supposedly progressive measures that make clear Asians (and Whites) need not apply:
- We brought a federal lawsuit on behalf of Asian parents whose children were treated less favorably than Black and HIspanic children under state-funded science programs – that lawsuit is moving forward after we defeated the state’s motion to dismiss.
- We joined with the Chinese-American Citizens Alliance of Greater NY to fight against a state constitutional amendment enshrining DEI reverse discrimination into the NY State Constitution (see rally image below). The amendment narrowly was passed by voters, but it’s important to fight not just the easy battles, but the difficult ones as well.
