Jack Smith Asks Judge to Pause Trump’s Election Interference Case

The DOJ cannot prosecute a sitting president.

Special Counsel Jack Smith asked the judge to pause all proceedings in President-elect Donald Trump’s election interference case due to his victory over VP Kamala Harris.

“The Government respectfully requests that the Court vacate the remaining deadlines in the pretrial schedule to afford the Government time to assess this unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy,” wrote Smith. “By December 2, 2024, the Government will file a status report or otherwise inform the Court of the result of its deliberations.”

Trump faces charges for allegedly trying to overthrow President Joe Biden’s 2020 victory.

The DOJ cannot prosecute a sitting president.

Trump will be inaugurated on January 20, 2025.

Smith and the DOJ already started evaluating how to handle the case against Trump knowing a trial is unlikely before the inauguration.

Smith’s case has hit many roadblocks.

In July, the Supreme Court said “that a former President have some immunity from criminal prosecution for official acts during his tenure in office.”

Smith filed a superseding indictment against Trump in August, trying to narrow the allegations to comply with SCOTUS.

Smith removed the section accusing Trump of trying to leverage the DOJ to go after state officials, which took up five pages. It also means that Smith removed Jeff Clark, coconspirator 4.

The special counsel also took out Trump’s alleged false statements and inserted general language.

The new indictment points out “the political and personal nature” of Trump’s alleged reactions on January 6, 2021.

Smith also described Mike Pence as vice president and Trump’s running mate in the accusation that he tried to pressure Pence not to certify the election.

Other than that Smith didn’t change much.

      There is no need for him to retroactively declare something declassified because the President, whether you share him or not, is the sole arbiter of what is and is not declassified.

      There is no higher authority he must send his declassification declaration to because he IS that authority.

Whatever Smith decides to do, it’s very likely Chutken is never going to dismiss this case until Trump is forced to pardon himself just as that other crazy judges refused to dismiss the Gen. Flynn case even though the government moved for dismissal. In that case, the judge even went so far as to examine the possibility of appointing HIS own prosecutor. It was insane. He should still be Impeached for it.

Trump should establish a special prosecutor – I would suggest Mike Davis – to investigate the circumstances of January 6th. During the course of that investigation, Trump could agree to be interviewed by Davis after Davis offers transactional immunity in exchange for that testimony. This circumvents Chutken because if she still refuses to dismiss the case, it becomes immediately appealable because Trump has a valid claim of immunity.

Unless and until the matter of the lawfulness of Smith’s appointment is settled, the only action that should be proceed is the complete dismissal of all charges. That should be the only motion Judge Chutkan rules on. Any so-called evidence assembled by Smith’s team is potentially tainted anyway.

Yeah, can’t prosecute a sitting president… that’s the ticket.

How about we state the obvious: there is no underlying crime. At all.

This bogus prosecution was entirely fabricated to thwart someone from being elected to office.

As far as I am concerned, the Trump DOJ should arrange to make Jack Smith a permanent resident of a 6’ x 9’ concrete domicile in Florence, Colorado for what he’s done.

It’s that serious, and would be even if the parties were reversed.

Bar complaints should start flying. Take this bad actor’s license to practice away!

Smith was overheard asking the judge if he knew anybody who was good with passports.

No mercy. Everyone involved in the lawfare against Trump and anyone who supports him as well as those that drove Covid nonsense down our throats should be hounded to the gates of hell.
