Republican Ohio Governor Calls Special Session to Get Biden on November Ballot

Maybe the DNC should check every state’s ballot certification deadline.

Ohio Republican Gov. Mike DeWine called for a special session of the General Assembly to get President Joe Biden on the ballot.

Ohio’s ballot certification deadline is August 7.

The Democratic National Convention is August 19-22, and the party formally nominates Biden as its nominee.

That means Biden wouldn’t be on Ohio’s ballot.

“Ohio is running out of time to get Joe Biden, the sitting President of the United States, on the ballot this fall,” said DeWine. “Failing to do so is simply unacceptable. This is ridiculous. This is (an) absurd situation.”

Maybe the DNC should check every state’s ballot certification deadline.

The special session should happen on Tuesday. From WBNS:

The question of whether Biden will appear on the ballot has become entangled in a partisan legislative fight to keep foreign money out of state ballot campaigns, a year after cash tied to a Swiss billionaire boosted a successful effort to enshrine abortion rights in the solidly red state’s constitution.

The Democratic National Convention, where Biden is to be formally nominated, falls after Ohio’s ballot deadline of Aug. 7. The convention will be held Aug. 19-22 in Chicago.

Since Ohio changed its certification deadline from 60 to 90 days ahead of the general election, state lawmakers have had to adjust the requirement twice, in 2012 and 2020, to accommodate candidates of both parties. Each change was only temporary.

This year lawmakers were unable to come up with a fix by the May 9 cutoff set by Ohio Secretary of State Frank LaRose.

DeWine said he spoke to LaRose on Thursday and he said we’re “up against a wall.” LaRose told him next Wednesday is the drop-dead deadline.

“I’ve waited. I’ve been patient. And my patience has run out,” DeWine said.

DeWine said his proclamation will allow for passing a Senate version of the bill that also bans foreign nationals from contributing to Ohio ballot measures.

      The problem with the ‘whataboutism’ argument you make is this date for certification is a well KNOWN issue. The DNC and the Biden campaign knew the dates for certification for each of the States. Instead of opting to comply with KNOWN deadline they simply proceeded to act as if these deadlines didn’t matter or were not applicable to them.

      Each State can set the rules for the elections they run. Congress could always act to override these dates and set a uniform certification date for Federal elections or just for Presidential elections. The Biden WH could ask Speaker Johnson nicely and as the Speaker of the House he might throw his support and the support of the GoP HoR majority behind the Federal legislation to disk which would preempt State Statutes. That is the real solution; political officeholders with the authority to do so acting to issue a political remedy and not the CT jumping in. Certainly not a Gov bending over backwards with a special legislative session to benefit one candidate.

      The true problem here IMO is that the Ohio legislature already considered the issue and chose not to act to make a fix during the regular legislative session. My own State of Alabama had a similar certification deadline of 82 days prior to the election but in regular session they made a temporary change for the due date to 77 days prior to accommodate the very late DNC nominating convention schedule…just as they did in 2020 for the Trump and the GoP Nominating convention also held in Aug. Both major policy parties are aware of the potential problem.

      Here the Ohio legislature refused to act in regular session and DeWine, after PO the GoP base with his veto and after he riled up many members with his botched handling of the East Palestine derailment and toxic spill is calling the legislature into SPECIAL session. Then he arrogantly chides them about him ‘losing patience’? If I was a member of the Ohio legislature that alone would would cause me to vote no on this or any other damn thing the Gov arrogantly demanded, eff that crap. He.already failed to garner support for a fix with his crappy attitude. Maybe he should have chosen to support house bill 68 instead of folding to the transgender mob and d/prog and issuing a VETO? Horse trading is the name of the game and DeWine doesn’t seem to have any horses to trade and he certainly isn’t offering any up as yet. Catching fly requires honey not vinegar.

    Ohio is safe for Trump and any other Republican so for Democrats to win Ohio it really would take every Republican willing to run dying at the same time.

    What this shows is how arrogant the Democrats are in not thinking they need to follow rules or even know the rules.

    If the governor did not do this the supreme court would just order Ohio to put Biden on the ballot so it isn’t unreasonable to want to avoid that.

      Just an interesting contrast. You posit that the Supreme Court would rush [if you are lucky it still takes quite a bit of time to get on their docket] to get Biden on the Ohio ballot. Yet that same Supreme Court could not be bothered to respond to allegations of nationwide vote fraud that installed Biden in 2020.

Gov DeWine is a very good example of how the chamber of commerce brand GoP operates.     I went to web search to find out his position on guns. I was quite surprised to find that DeWine is an exception to L Neil Smith’s ‘Vulcan Mind Meld” metric. Signing constitutional carry, arming teachers… but a mixed bag, also containing red flag advocacy and private sale background checks. Not your typical chamber-of-commerce R, but far from MAGA.

It seems like 90 days was not a good idea.

Find me a Democrat governor that would do the same for Trump or frankly any Republican.

If Biden were not put on the ballot in Ohio, it would ultimately end up at the Supreme Court before this year’s election.

    The Constitution is pretty clear: “Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors…” It’s the state Legislatures’ Constitutional responsibility, not the Governor’s nor the courts’, to direct the manner in which Electors are appointed. That includes the ballot deadline.

    Usually referred to as SCOTUS not SCUSA. I doubt SCOTUS would do anything as it is clearly the States responsibility under the Constitution. There is nothing stopping people from writing in Biden’s name if it comes to that.

I agree that the Ohio legislature should amend the deadline to make sure Biden is on the ballot — but it should make it conditional on Trump being on all 51 ballots; if there is one ballot from which Trump is excluded, then Ohio should exclude Biden.
