Political Prosecution of Trump “Tears at the Fabric of the Country” and is “a Master Manipulation by Democrats”
My interview on the Tony Katz Show: “It’s a gross manipulation of the Republican primaries…. they are not only going to raise Trump to martyr status so that he gets the Republican nomination, they’re also going dirty him up in the court case so that he can’t get elected president in the general election.”
I appeared this morning on the Tony Katz Show on Rumble to discuss the only thing anyone is talking about: The indictment and arraignment of Donald Trump.
The full video is at the bottom of the post. In this video excerpt, we focused on the bigger picture of how that indictment of Trump fits into a fissure in society (this is two clips combined into one video):
Katz: …. legally it’s referred to as stacking. When you don’t have a lot, you make one thing look like a lot of things. So you stack them one on top of the other. So if you have 11 checks and you have seven journal entries and four of this, and two of those, it’s like Rodney Dangerfield in Caddy Shaq, gimme two of those, gimme six of those, gimme a couple of those naked lady tees. That’s the stacking. So that’s the process that Alvin Bragg, the district Attorney Manhattan, used in in this case. But what you are bringing up is this idea that what Trump did in paying Stormy Daniels the way he did was that this was an intent to well engage a fraud and it does engage another crime. But he doesn’t mention what the crime is. And a matter of fact, in the press conference that the DA Alvin Bragg had, he states that he doesn’t have to mention what the other crime is. How does that pass your sniff test?
WAJ: It doesn’t pass it in any case, but it certainly doesn’t pass it in what legally is a groundbreaking case of bringing an indictment against a former president and leading political opponent. The president of, I forget if it was Guatemala or Honduras [note: it was El Salvador] put out a tweet about that. If this happened in any other country where a major political opponent was arrested on flimsy charges based on a far-fetched legal theory with little disclosure, we would laugh at that. We would not call that democracy. And that’s what’s happened here. It may be that Trump did everything Alvin Bragg said that there were false checks for, but it would never, we know it would never be prosecuted against anybody else. And it was only prosecuted because Donald Trump’s running for president. I don’t think there’s a person on the face of this earth who thinks that this case would’ve been brought if three months ago or four months ago, Donald Trump had announced I am not running for president again.
So that’s what this is about. This has all the appearances of a political prosecution. And you’re right, there are a lot of commenters from the left who recognize this is really weak stuff. There’s a guy at Vox who is usually brutal towards people like Trump. And even he said this is not the sort of legal theory that you bring for the first time a former president is going to be indicted, that this whole thing could collapse, there were numerous legal infirmities with it, unresolved legal questions. And this is not what you do to a former president and political opponent

Katz: But when we live in a world that has such little trust in the institutions, you can’t trust the FBI, the IRS went after the Tea Party, you look at how the DOJ treats parents — and you cover that at legalinsurrection.com over and over and over again. Does there begin to be a worry that people like Alvin Bragg are going to hurt the profession in a way that there’s a total lack of faith in the profession? Or do they feel we’re lawyers, we’re totally insulated, we can do whatever we want, with impunity. And what’s worse comes to worse, I’ll end up getting a job in some other way because the progressives will take care of me.
WAJ: I think this is the sort of thing that tears at the fabric of the country. If you’re going to charge a major political figure during the early stages of the primary season with a crime, you better have really solid ground and it better be a serious crime, not a bookkeeping crime that’s seven years old. So I think this really does tear at the fabric. It feeds into the distrust of institutions. I’ve written a lot about institutional capture and how almost every major institution, with the exception of the Supreme Court, has been captured by the left. And of course, now that the Supreme Court is not captured by the left, they want to de-legitimize it, so they’re attacking the Supreme Court. And there is a real concern in this country that people completely lose faith, and it leads to a fracturing of the country.
We’re not going fracture along geographic lines, we’re too integrated as a country But it;s the so-called national divorce, I think a lot of people are tuning out and checking out and creating alternative systems. You’re on Rumble now, why are you on Rumble? Rumble was created because YouTube was being abusive towards conservatives? YouTube was shutting people down. YouTube was captured part of Google. It’s captured. So people are finding we are fracturing not necessarily geographically as a country, but socially as a country into our own little silos and our own pockets. And that’s not healthy.

WAJ: Well, There’s a great deal of deference given to the prosecutors to present their case the way they want to. So a judge is only going to throw this out is if there’s some legal problem with it, and many people have pointed out there are many potential legal problems with it, including it’s a novel theory, that a county prosecutor, this isn’t even a state attorney general, that a county prosecutor can upgrade a misdemeanor to a felony based on an alleged intent to violate a federal law when the person has not been charged with actually violating the federal law. So this is like a hypothetical. If Donald Trump intended to violate a federal law, can we upgrade this from misdemeanor to felony? So this is like a law school exam, except it’s not law school, it’s real life and it’s a gross interference in our political process.
It’s a gross manipulation of the Republican primaries. The obvious thing is it’s an attempt to get Trump, that’s clear, right? But it’s also a manipulation because as I think was pointed out or on Tucker Carlson last night, he didn’t necessarily endorse it, but he pointed out that one of the theories here is that the Democrats, this is their master manipulation, that they are not only going to raise Trump to martyr status so that he gets the Republican nomination, they’re also going dirty him up in the court case so that he can’t get elected president in the general election. People have to remember that a lot of the reaction coming from Republicans is to rally around Trump. That’s not necessarily the reaction in the rest of the country. That’s not necessarily the reaction with the so-called suburban women who sunk the campaign for Trump last time. So this really appears to be a master manipulation by Democrats.

It’s not Bragg so much as the judge who didn’t immediately toss it out. Bragg’s just a politician, the judge is a judge.

Just as breaking certain trusts irreparably destroys relationships, tears in certain “fabrics” cannot be repaired.
This indictment of Donald Trump is what’s coming for the rest of us. The ‘tear’ cannot be repaired. Anyone who puts any trust in the left/democrat/GOPe swamp is deluded – or part of the fascist swamp.
They used to laugh at the John Birch Society and its “conspiracy theory” that a one-world government was the goal of a mega-wealthy/influential elite. What was preventing this plan from succeeding, the JBS postulated over the 60 years of its existence (using facts, figures, statements of these elites), was the political structure of the USA, mostly notably the diffusion of power. All other countries of the world would quickly fall in line for a NWO. The sticking point was America and its constitution that limited government. If limited constitutional order could be overthrown, then the USA too would fall in line.
Not wanting to continue freedom-from-excessive-government-control structure, the D party, the academy, the law schools, the media and others are doing their best to concentrate power. This out-and-out coordination is now an open secret to do away with America as founded.

Huh? What do you mean he didn’t require a law that was broken? The law Trump is charged with breaking certainly exists. Bragg didn’t just invent a law. The question is whether Trump broke it, and the case that he did is very tenuous at best. Even if there’s a technical violation it’s not at all serious, and even that’s a stretch. But people who seriously do violate this law are charged all the time.
What Bragg said (correctly) that he didn’t have to disclose (for now) is the “other crime” that he says these crimes were committed to cover up. Trump is not being charged with that other crime, so Bragg doesn’t (yet) have to say what it is. Eventually he is going to have to, but he’s dragging it out as long as he can, probably because it’s going to make his case even weaker and more laughable when he does.
Former Fed Prosecutor keeps bringing up the fact the payments to Stormy occurred a short time before the election in Nov 2016. The crime of assigning hush money as a legal expense didn’t occur until four months later when filing the paperwork. It’s quite a stretch to say a crime committed in Feb 2017 was to fraudulently help his election FOUR MONTHS EARLIER.

I just realized why Bragg isn’t naming the crime that was being covered up – he wants to catch Trump and the Republicans flat footed. Everyone is assuming (wrongly) that to be guilty Trump has to have been covering up his own crimes. Nowhere does the statute say this. He will be accused of covering up Cohen’s crimes. Remember, Cohen already pled guilty to a campaign violation for making those payments to Stormy and McDougal, so legally he committed a federal crime. By mischaracterizing the reimbursement payments in the records, Trump committed a state crime that is elevated to a felony for covering up Cohen’s crimes.
Don’t know why anyone downvoted you. That’s a clever analysis. Shows thought at least.
Does he even have to prove that this other crime occurred at trial? Or does he merely have to convince the jury that Trump was covering up some general criminal activity, which could have been an election law violation, paying a prostitute, running a criminal enterprise, tax evasion, or whatever. Does he even have to be covering up his own crimes? Since Michael Cohen pled guilty to a campaign violation regarding those payments, Bragg could say that Trump was covering up Cohen’s crimes.
Am I wrong, or doesn’t the second crime have to be a felony for the other felony to kick in? If so, then yeah, he has to get specific.
So, a defendant commits a misdemeanor. But the prosecutor can upgrade the misdemeanor to a felony by liking it to violation of some “other crime.” But the prosecutor is not required to immediately disclose what the “other crime” alleged to have been violated is. So the prosecutor can prevent the defendant from beginning the process of preparing a defense strategy by not disclosing what the “other crime” is.
If I’m understanding it correctly it strikes me as truly Kafkaesque.

As with far flung judges issuing nationwide injunctions during the Trump presidency, ordinary people are incredulous that there are no sensible men placed somewhere in the system who can put a stop to such outrages in a timely manner. Perhaps the DA being a black man who was graduated twice by Harvard makes it especially delicate.
Where’s our injunction’s? Why don’t we have a judge state that we are being invaded and our government has refused to do its job to protect its borders and citizens, declare an invasion that allows states to use force?
It is reported that two Republican DA in southern states want to find a way to indict the Bidens for their illegal acts. Bragg has sown the wind and the Bidens will reap the whirlwind.

Clinton was impeached for two felonies: Perjury and subornation of perjury, to which he eventually admitted to and received the lightest of taps on the wrist from the judge in the case.
Trump’s first impeachment attempt blew sky-high when the Mueller report was released and showed there was no there, there. Cue Weissmann in tears and thank God for Bill Barr (in this case).
Trump’s first real impeachment lacked a crime. Well, there was a crime there, but he was asking a foreign leader to help the investigation of a former VP who had admitted on camera to using his position to advance his son’s career.
Trump’s second impeachment also was lacking a crime, but that didn’t matter to the Dems.
Now we have photocopied criminal charges against Trump which *also* are lacking in a crime.
For a guy who supposedly is such a criminal, his political opponents don’t seem to have much on him other than maybe jaywalking or littering.
What the Democrats have inadvertently shown us is that Trump was probably the cleanest fucker to have ever been in the White House.
I think we are missing something here. There is almost certainly going to be legal action against Hunter Biden and possibly James Biden and “The Big Guy” The Democrats want to be able to claim that such action is retribution for the Trump prosecution.

Biden’s dirt may hurt his chances more, even with suburban women that see what was done to their kids, and others fed up with the Democratic manipulation, the abuse of power, and the overreach of woke. After all, Biden’s dirt has actual substance. Not to mention that he will have opportunities to again show his true cruel self, and his incompetence, other than to make things worse. The red speech is not going away. His documents situation is not going away. The border is not going away. There will be even more shoes to drop. The economy? China? Ukraine? Energy? Remember Obama’s famous words. In comparison, what else is there against Trump that does not walk and talk and smell like a witch hunt? So the head to head may not be the disaster people, in April 2023, make it.

Which is why Trump should spend EVERY moment on camera talking real issues, and he’s going to have a lot of moments. I was hoping he would take the opportunity last night . Say a few words about the bogus indictment, and pivot to his policy the left wants to stop.
