Biden Administration Proposes New Title IX Rule That Would Force Schools to Embrace Gender Identity in Women’s Sports

“For a party that claims to care about women, the left sure is intent on depriving them of the opportunity to fairly compete”

The Biden administration is proposing major changes to Title IX, via a new Rule Proposal as to how it is interpretted, which would expand the law to include gender identity and would penalize schools in some cases.

Sports for women and girls are the focus here, and not in a good way.

FOX News has details:

Biden admin roasted over new transgender Title IX regulations: ‘Insane injustice’

Critics lashed out at the Biden administration Thursday after it unveiled its proposal for new Title IX rules to expand the meaning of sexual discrimination to include gender identity as it relates to the application for transgender athletes participating in women’s sports.

Under the Department of Education’s proposed rule, no school or college that receives federal funding would be allowed to impose a “one-size-fits-all” policy that categorically bans transgender students from playing on sports teams consistent with their gender identity. Such policies would be considered a violation of Title IX.

“As a woman who has made history breaking glass ceilings, we must protect women. Women and girls have fought tirelessly for their rightful place in sports, and Title IX has been a crucial tool in leveling the playing field,” Rep. Nancy Mace, R-S.C., told Fox News Digital.

“Allowing biological men to compete in women’s sports compromises the hard-won progress women have made in achieving equal opportunities in athletics. We need to find solutions that respect and protect the rights of all individuals while also preserving the integrity and fairness of women’s sports,” she added.

Sen. Marsha Blackburn, R-Tenn., told Fox the proposed new rules ran in stark contrast to Democrats’ usual rhetoric on women’s issues. “For a party that claims to care about women, the left sure is intent on depriving them of the opportunity to fairly compete,” she said.

Rep. Andrew Clyde of Georgia commented on Twitter:

You’ll be shocked to learn that the LGBT lobby is angry about the proposed changes, because they don’t go far enough.

The Hill reports:

‘A backwards betrayal’: Biden Title IX proposal draws criticism from LGBTQ community

Some LGBTQ advocates this week slammed the Biden administration’s proposed revision to Title IX, accusing the president of backtracking on his commitment to protecting transgender young people.

The proposal, released Thursday by the Education Department, would prohibit the adoption of policies that “categorically” ban transgender athletes from school sports teams consistent with their gender identity, rebuking broad bans that have been implemented by 20 states, and counting.

But K-12 schools under the administration’s proposal would still have the leeway to limit transgender athletes’ participation in sports if they determine that including them will undermine competitive fairness or increase the risk of sports-related injuries, a senior Education Department official said Thursday.

“The proposed regulation would give schools flexibility to identify their own important educational objectives,” rather than adopt a one-size-fits-all approach, the official said on a call with reporters.

LGBTQ Americans and their allies have had mixed reactions to the administration’s proposed changes. While some are celebrating the possibility of a new federal civil rights law prohibiting laws that bar transgender students from participating in school sports, others say the proposal is a disappointing departure from prior actions and statements made by the Biden White House in support of equal rights for transgender people.

“State lawmakers take note — discriminating against transgender athletes is wrong and a violation of federal law. This new rule makes that abundantly clear,” said Kelley Robinson, President of the Human Rights Campaign, the nation’s largest LGBTQ advocacy group.

It’s fascinating to watch Democrats and their allies in media and corporate America fall all over themselves trying to impress a tiny, loud, entitled, and increasingly radical minority.

Rona Rino Romney (the unbelievably incompetent and corrupt GOP Chairwoman) is on the case.

    Or not.

She’s the new Boehner. Don’t delude yourselves that we’ll come anywhere near winning an election in 2024 (if there is one) with this corrupt useful idiot “in charge” of the GOP treasury.

I think you forgot the “Trump-supported” part. She was his pick. It’s important to note that, no?

How pray tell is it sad to point out Trump’s mistakes?

Actually, it is becoming more and more possible that Trump’s constant media coverage is reaching a saturation threshold.

More important to note her actions/inactions, and reelection, that to blame President Trump for getting poor advice.

I highly doubt he supports her(?) now.

You do know she was reelected, with Trump’s full support, in January of this year, right? What has happened over the past few months that makes you think he no longer supports her?

When what you hope and wish is not what is real, it’s time to rethink your stance, no?

States should pass a law that requires use of genetics to determine whether a person is male or female. If the Feds want to cancel federal funding so be it.

Teachers unions would howl if they still didn’t get their cut, which makes me think they will come first and other programs will get cut if they don’t follow the strong arm of government.

No “Ys” and set a level for testosterone. That would be XO (Turners), XX (normal). There is a very rare disease in which there are no testosterone receptors despite XY. That is really a “super” female in appearance.. The testes are undescended.

Anything with a “Y” is out including the rare XXY and XXXY types.

The trans are the newest and most militant street army for the Left. You wouldn’t hit a “woman” would you? Batter up!

Motto of the Democratic Party? “Cheat whenever you can.” (When you don’t even rate a participation trophy as a man, call yourself a woman.)

I think sports is a lot about selling game tickets and merchandise marketing, I have not seen anyone willing to buy a ticket to a game which will be about some guy “in a dress” winning, And I have similarly not seen people flocking to buy the sports clothes just like the guy was wearing. Privately people can dress and think as they wish but publicly I think the fad of guys winning at women’s sports will be self limiting no matter how many rules we create,

    An interesting reflection.
We’ve discussed the “committed” who will now boycott Bud Light on principle.
We’ve possibly forgotten the contribution of the average schmuck who will avoid the beer now solely because he doesn’t want to be called out by his buddies for drinking “that gay stuff.”

People just need to calm down a bit here. No new rules have been implemented at this time. This is just a ” Notice of proposed rulemaking.” and nothing has changed at this point. They now need to allow a 30 Day comment period and satisfy all the other requirements of the Administrative Procedures Act before they make these permanent changes to Title IX. Yeah, it’s a shitty way to bypass the Republican controlled House of Reps. but there you go. democrats do shitty things. Now what are the Republicans going to to do about it. I predict they’ll howl in outrage and then do nothing to prevent these disastrous rule changes.

henrybowman in reply to Lucifer Morningstar. | April 8, 2023 at 4:23 pm

But you can. That’s precisely what 30-day comment periods are for — us. You can comment online.

    LM,

There isn’t much Congress can do directly. They granted the Sec Ed rulemaking authority and as long as he follows the APA then the Biden Admin does have the power to do it.

The comment period is where the public gets tested; do they care enough to raise high hell which might get the Biden admin to pull this b/c they fear electoral consequences?

Once enacted the Congress can use the Congressional Review Act (CRA) to overturn this but only if a majority exists and of course the grassroots support to encourage that. The only other thing the HoR can do is target funding the Biden admin wants. Individual Senators can put a hold on nominations and a group of 6-8 could seize the floor and filibuster to stop everything in the Senate. All those actions are a little extreme and PO everyone around them so without sufficient public support to do it odds are it won’t happen.

IMO, unless stopped during comment period this goes into effect. Earliest opportunity to reverse it comes after the next Congress is seated post ’24 elections assuming a GoP majority exists in both HoR and Senate using CRA. The poor performance in the midterms and for Senate ’20 as well is taking a toll. The goal should always be to win the damn elections b/c nothing gets done without getting into office.

And keep noting, no woman is out to join a male sport.
Very few have tried, for example a football place kicker but they don’t really make it.

Dimsdale in reply to Skip. | April 9, 2023 at 10:05 am

Trans “males” included. They only take advantage when they have a huge one (maybe I should rephrase that….).

Among his many other credentials, Joe Biden is now anti-woman.

Can’t wait for the stories to start about how his love for trans issues started as a teen in his free time while he was away from the schul or HBCU or marching for civil rights.

Women’s sports to me means field hockey in blue uniforms, whose rules I don’t even know. That’s what they did while guys’ PE classes were playing football.

If they stuck to that, I doubt any guy would want to play in women’s sports, or if anybody would notice.

The trouble starts when women start playing guys’ sports and loser guys see an opportunity to finally be good at one with weaker opponents.

Males, who are pretending to be females, have a biological advantage over real females.

Mr. 10% says the pretenders must be allowed to compete. He is totally OK with Mr. Thomas to cheat and beat woman, when he was never able to beat men. https://www.youtube.com/watch?v=kc-M_tnQOKY

Is Mr. 10% OK with whites who identify as black so they will qualify for affirmative action?

Gender identity: a male who feels or simulates the feminine (gender) or is anti-social standards that normalize a favorable juxtaposition of the sexes. A male who is cis-sexual (i.e. homosexual). A feminist/masculinist/social progressive who has misogynistic proclivities.

E Howard Hunt | April 8, 2023 at 5:37 pm

These rules should be restricted to balless sports.

Where are the women loudly objecting to this proposal?

. . . crickets . . .

So how slow am I?
I just figured out today what “men can have periods” and “men can have babies” actually means.
Before, I thought this was just wokester crazy talk, like “your speech is violence.”
Then this afternoon, it hit me — they’re talking about [women pretending to be men] having babies and periods.
Oh. Right. Now I understand why even the MSM hasn’t been denouncing this as crazy talk. It’s within their previously acceptable bounds of crazy.

As I have said before, the issue of men playing womens sports is trivial in the big picture.

What is vastly worse is the “scientific” belief that a mental illness can be cured by mutilating the human body to make the mentally ill believe they are in fact biologically the opposite sex. Further, that this delusion of medical and biological science has been embraced by such a large segment of the population (progressive population) with real science be damned.

If more men crossed over and smashed victories and world records to prove the point, this theatre would end real soon.

Honestly that’s the only way this ends… outflank them and bring it to it’s logical conclusion.
