The Biden administration is seriously considering paying $450,000 each to illegal immigrants who were separated from their families under Trump in 2018.
It’s difficult to believe they would even think of doing this as so many Americans are still suffering the after-effects of the COVID shutdowns. American citizens lost their businesses, savings and homes.
Not to mention that there are still homeless veterans and so many others deserving of help.

The Biden administration is in talks to offer immigrant families that were separated during the Trump administration around $450,000 a person in compensation, according to people familiar with the matter, as several agencies work to resolve lawsuits filed on behalf of parents and children who say the government subjected them to lasting psychological trauma.
The U.S. Departments of Justice, Homeland Security, and Health and Human Services are considering payments that could amount to close to $1 million a family, though the final numbers could shift, the people familiar with the matter said. Most of the families that crossed the border illegally from Mexico to seek asylum in the U.S. included one parent and one child, the people said. Many families would likely get smaller payouts, depending on their circumstances, the people said.
The American Civil Liberties Union, which represents families in one of the lawsuits, has identified about 5,500 children separated at the border over the course of the Trump administration, citing figures provided to it by the government. The number of families eligible under the potential settlement is expected to be smaller, the people said, as government officials aren’t sure how many will come forward. Around 940 claims have so far been filed by the families, the people said.
The total potential payout could be $1 billion or more.

To say that this news has some people up in arms would be an understatement. The first thing to take note of here is that the huge raft of lawsuits mysteriously only involves families that were separated during the Trump administration. Doesn’t that immediately cast the entire process in a bit of a partisan light?
Children are still being separated from parents (or in too many cases, coyotes and human traffickers posing as parents) on the southern border every day. And those separations were regularly taking place during the Obama/Biden administration, where the entire “kids in cages” story actually began. But oddly enough, the administration isn’t going to accept the blame for any of those, only admitting to alleged sins committed by the 45th President.
This is outrageous.

Sovereign immunity is a problem but maybe not. Here’s a theory; where the feds have a statutory responsibility and fail to act creating injury to a person or community does that failure to act constitute an equivalent abdication of immunity? Especially in the realm of immigration where the feds have gone to CT to invoke their dominion over the issue to preclude State action.
A reliance upon the feds argument that ‘it’s our job, not yours, you can’t be involved BUT where we fail to exercise that responsibility and duty then no entity can go to CT to make us follow the law that Congress has passed’ seems a stretch. Discretion on individual cases is fine, attempting to invoke discretion on entire categories of cases or at present all cases doesn’t seem tenable.
Let individuals and communities impacted access simple nuisance doctrine to make the feds remediate the results of the failure.
