Judge Orders Reinstatement of Virginia Teacher Tanner Cross, Who Objected to Proposed “Preferred Pronoun” Policy

We recently covered Virginia teacher Byron “Tanner” Cross who Sued Over Suspension For Publicly Opposing Proposed “Preferred Pronoun” Policy.

A court has just granted a temporary injunction reinstating Cross, according to a tweet from his lawyers, Alliance Defending Freedom:

BREAKING: Tanner Cross, a Virginia elementary school teacher and ADF client who was suspended for raising concerns to the board about a proposed gender policy, has won a temporary injunction and the judge has ordered his reinstatement.

A massive victory for freedom of speech.

NBC4 reports:

A Virginia teacher must be reinstated from leave after telling the school board he wouldn’t address transgender students by their pronouns, a judge ruled.

The court granted Tanner Cross’s request for a temporary injunction immediately, saying the district must allow him to return to his position and stop banning him from Loudoun County Public Schools property.

Judge James E. Plowman Jr. wrote that he granted the injunction because Cross’s rights to speech and religious liberty are central to the case….

During Friday’s hearing, an attorney for the school system said the principal at Leesburg Elementary School had to remove Cross from one of his jobs the next day because he feared backlash from parents, and over the course of 48 hours, five parents asked him to remove their child from Cross’s class.

Cross’s attorney argued it was his client’s right under the First Amendment of the Constitution to express his views at the public meeting.

We can be certain that the five parents who objected to Tanner Cross being in the classroom are plotting to mutilate their own children.

That’s what the schools do with any kid who makes the mistake of following the school’s recommendations that they question their sexuality. The kids are outed as trans and shunted into counseling and puberty blocking treatments that strip these children of the only sexuality they can ever have: the one they were born with.

Most parents try to protect their children from this evil but some of them like the leftist-communist way that it reflects on themselves and to get that leftist status are eager to assist in the mutilation of their own children.

    Where are these outings occurring? Blockings? I’m asking, how widespread?

    Neither the children nor their parents are so marked. It seems that both that set of parents, along with their children are exquisitely aware of their strangeness. That set of people is scared to death about the ignorance that attends to that condition, why they are like they are, both public ignorance and their own.

    Being wrong in their assessment of how best to protect the long-term welfare of their own children is not evil. It’s evidence of ignorance and an acknowledgment of despair.

If an elementary school student wants to be known as Ze/hir, their parents need to be investigated because the kids damned sure didn’t come up with that themselves.

This is not a massive victory…it’s a victory but it’s a temporary injunction.

The real question becomes what will be the ruling on his free speech rights when he refuses to actually use the pronouns in his classes or interaction with others at the school. The injunction was granted merely because he had a free speech right to express his views at the board meeting (which should have been a given and not even required a judge honestly).

And yes, the LGBTXXYABZ activists or their wannabe child warriors will be all over it in a hurry to test the limits.

    I agree that it is not a massive victory, they will most certainly go after him. Their being sued and losing may make his prospects of prevailing much better.

I suspect that there will be reports of “abuse” against the teacher now that he bucked the liberal orthodoxy.
At least in elementary PE, they don’t dress out so there will not be any locker room complaints. The sad society we live in today.

As noted above, it is only a temporary injunction pending either settlement or trial. If the school district should lose at the trial court level, you can be absolutely sure that they will be willing to devote a huge portion of the district budget to appeals. And given that it is Virginia, it will probably be specially subsidized by the state in the process.

My personal experience with parents who have philisophical differences with teachers & ask that their children be removed for the mental and academic health of their children generally results in the school responding with a firm “No” and an admonition to suck it up, buttercup. But that was before people were woke.

If we live in a place where allowing a person to refer to a boy as “he” is a massive victory, we are screwed nine ways from Tuesday.

I don’t have kids in the system but subscribe to local school board’s newsletters. Maybe a year ago they hired a part time person at full time pro rata of $75K, to deal with transgender etc. issues. My tax dollars at work.
