As we go through this process, the outcome of which is not certain, don’t feel alone. You are not alone.

The major networks have called Nevada and Pennsylvania for Joe Biden, and thereby the national election. Of course, network calls are just that, network calls. Trump still has a chance in Georgia (very tight, down a few thousand), Arizona (down about 20k), and North Carolina (up about 75k and likely to win). Those are three of the four legs he needs, but the fourth, Pennsylvania, is unlikely (down 35k which probably will increase).

So it’s not over, but we have to be honest with ourselves that it remains a longshot. Trump needs hard evidence of major fraud, miscount, or computer malfunction to prevail in court. A specific category of ballot that was not legally cast is going to have to be identified, and it’s going to have to be in a sufficient quantity to make a difference. I hope they find it.

Yet the media, Democrats, and a lot of Republicans are celebrating that it’s over.  I understand how alone and demoralized that can make you feel. Obama supporters did the same thing in 2008, and to a lesser extent, 2012.

Yet this is not 2008.  One of the benefits of having been at this at Legal Insurrection since October 12, 2008, is that we’ve been through several cycles. Unlike Obama’s victory in 2008, we are starting out in a much better position in the House, and in state legislatures and statehouses that will influence redistricting. The massive red wave of 2010 could be replicated in 2022. The Senate will depend on the two Georgia runoffs on January 5, 2021 — if Republicans win at least one of them, the Senate is secure at least as a blocking mechanism against leftism. There are risks of defections and wobbliness, but no one knows how to use a slim majority to advantage as much as Mitch McConnell.

None of this cures the loss of the presidency, with all its power. Major reforms in higher education, the economy, and elsewhere will be unraveled quickly. Non-enforcement of criminal and immigration laws through executive inaction is likely. Already our enemies — Iran and its offspring, China, and others — are celebrating along with domestic Biden supporters.

The permanent political, bureaucratic, and media classes which set out from day one to destroy the Trump presidency also are celebrating. Trump represented an existential threat to break their griplock on the nation, and in so doing created a coalition not seen before — tens of mllions of racially and ethnically diverse working-class patriots. The national divide no longer is race, but class and access to power, between those who value individual liberty and rights and those who use their power to silence others.

There will be time, when it is over, for retrospective, including how Democrats out-lawyered and out-strategized Republicans using coronavirus as the excuse to remake voting and lower voting security. We will need to deal with big tech censoring.

But as we go through this process, the outcome of which is not certain, don’t feel alone. You are not alone.

And don’t despair of their taunts, draw strength from them.

      Why do think there were so many reports of (r) poll watchers being denied entry, evicted, or forced to “watch” from across a cafeteria width of a room? And a rush to commingle ballots that arrived before and after the new “emergency Covid” dates?

      Stealing elections is something the dems had figured out long before Landslide Lyndon shared a ticket with JFK.

      The poll watcher interference will – as always – result in at most slapped wrists. Even less if the local DA is one Soros funded. And without a witness who isnt part of any irregularities you have suspicion but not proof.

      And the commingling means that short of voiding all ballots for a do over – something courts have almost never done – voiding the last minute (and possibly illegal) alterations to election laws is an exercise

      So Giuliani seems to think a large number of Philly votes are going to get tossed under the current law due to the unlawful exclusion of poll watchers.
      Is the fact (if proven) of Wisconsin and Michigan ballots arriving in mass to the tune of 130,000 and or 160,000 between 3 and 4 am with not one vote for Trump enough to make a prima facie case that the novel mass mailing is unreliable enough that SCOTUS lacks sufficient faith in the election that only invalidating it will cure what has transpired?

      That may be, but without the House, Senate and Presidency issues such as the Prof’s noted “need to deal with big tech censoring.” will not be accomplished. If there is a Harris Biden administration, the DoJ’s antitrust suit against Google will be dropped quicker than the proverbial hot potato. Assuming GOP retention of a small Senate majority, any Harris Biden administration will return to the Obama administration’s inviting friendly lawsuits from Leftist activist organizations, striking a “settlement” before trial which gives the administration what they could not achieve through the Congress and also pays the Leftist organization inflated costs and potentially “damages” to fund the next friendly lawsuit and other operations. And, of course, the ubiquitous Executive Orders, or even more Departmental memoranda like DACA which the courts treat as if they were an actual Executive Order if not a duly passed and signed statute.

Donald Trump being straight up nuts(something I figured out inside of 30 seconds of observation back in 1982) may have played a role in his defeat.

    1. GA isn’t rolled back; SoS has dispatched State personnel and Sheriff to Fulton CO to investigate ‘substantial irregularity’ (16 EC votes)

    2. PA isn’t rolled back due to obvious fraud, lack of compliance with observation, lack of ballot segregation in over 25 counties despite assurance to SCOTUS pre election
    (20 EC votes)

    3. Wisconsin isn’t rolled back due to illegal cure of absentee ballots missing incomplete witness information (10 EC votes)

    4. AZ isn’t eventually called for Trump plus claims of in person votes being over ridden by ill trained poll workers, state law requires each non counted over vote to be examined to determine voter intent… (11 EC votes)

    Add those to projected 214 current Trump count and 271 EC votes for Trump.

    But ok let’s stipulate none of that happens and Biden does win. The answer to your question is who wins the fight between Jill Biden and K Harris.

    If J Biden then a four year term.

    If K Harris, then Joe resigns just before half his term is up. Harris becomes POTUS for two years and is eligible to run for two complete terms of her own.

      Just after, not just before. If she serves a full 24 months, she has logged a full term in office. If one day (hour?) less than 2 years, she can run for 2 full terms.

    Mark Steyn has an excellent podcast “Election Plus Three” segment that details over a century of Democrat election fraud featuring such attractions as Philadelphia. It is definitely worth the time to listen to.

    The pressure is tremendous as the MSM all want to push Trump and 70 million Americans into the weeds. Trump is just sour grapes… the future is so wonderful… I can hardly wait for the next lockdown.

    There is no good night to go into… just a Republic to save from destruction. If ever there was a person to shoulder this, it is Trump. We are talking Washington/Lincoln stuff here. But he must not shoulder this alone…we are all squarely in the sights of the Progs. 450 Flag officers told Trump this is the most important time in US history. We are not alone.     I won’t even give Biden that long. As we saw with the Nov. 2020 general election the democrat party no longer cares about the “optics” of their corruption and fraud so will have no problems removing Joe from the presidency. I predict within a month (perhaps two) of his inauguration they’ll simply 25th amendment him, put him in a basement in an undisclosed location, and install Harris as the president. And the coup will be complete.

Today I removed my Trump 2020 flag from the flagpole on my boat, folded it reverently, and stowed it in the forward locker.

We must resign ourselves to the fact that DJT lost. He fought a great fight, but the combination of the mainstream media; EVERY cultural institution in the U.S.; the traitorous Nevertrumpers; the Deep State; and the Democrat party was just too much for him to overcome.

Voters KNEW that if they reelected Trump, there would be riots in the streets. They voted for Biden to prevent that. Simple as that.

    No offense and I will even grant the point. However, if voters believe that force is only used by one side and base their decision on that belief to avoid violence, what you described is voter intimidation.

    I am certainly not calling on anyone to change the minds of those voters by demonstrating that every side is capable of violence. Not endorsing or suggesting it.

    First, there is NO evidence that any Trump voters voted for Biden. What there is, is increasing evidence that irregularities occurred, in counting the votes, which corresponded to suspicious, often statistically impossible result; such as 23000+ ballots appearing in the middle of the night, all cast for a single candidate, the one trailing, several times the number of votes cast for a specific Presidential candidate, while prominent down ballot candidates show far, far fewer votes and the down ballot candidates, in the party of the candidate who was initially leading, remain nearly the same as those cast for the Presidential candidate. There is a huge treasure trove of building circumstantial evidence available right no and it is increasing daily.

          My ballot receipt has a number on it, and that number is associated with my name.

          What would somebody look for? Oh, maybe about 61 boxes of ballots, with a whole string of votes by dead people or people who moved?

          That hunt is on, right now.

      Amy’s job is to apply the law. It is somebody else’s job to demonstrate reasonable suspicion, do discovery, and proffer evidence of fraud.

      And the burden of proof is on the proponent of disputed ballots to prove that they should be counted. That burden will apply to both sides, as there are credible allegations of both deprivation of votes for DJT as well as inflated votes for Biden.

        You have a funny notion of “both sides,” viewing that as a “heads-I-win, tails-you-lose” proposition.

        Whether allegations (“claim”) of anything are truly credible ultimately rest on the evidence, whether that proves convincing or not when closely scrutinized. Please get and let us know when a court of some consequence finds there to be reliable evidence of any fraud, let alone fraud sufficiene to move the needle. We’ll be waiting

          Yes, but the ballots have been removed from them, so if they’re subsequently found to be invalid it’s too late to cancel the vote.

          So the only equitable answer is to call the election void.
          While i hear of a few states using mail in balloting before the china virus, no en mass unsolicited ballot scheme happened before this, so at some point, SCOTUS is going to have a novel issue.

          Bannon had an interesting interview with someone about a covert classified program called “hammer” that was developed for use in foreign countries where the US wanted to inter with regimes. This may amount to a “Q” level conspiracy theory, but it does fit nicely with Ronna McDaniel’s discovery of a computer “glitch” that flipped 6,000 Michigan votes to biden and the same software is used in 47 counties.

          At some point the results can not be cured by exclusion or recount and the whole thing must be voided.

          If the end result of the novel mail in ballot scheme is that a fair election is in doubt, then the whole thing has to go.

          I’ve never heard of pass interference in an election, but there’s documentation of Trump and other “r’s” vote count being reduced

          In PA, there’s a video showing Trump at 1,690,589 and Biden 1,252,537 in the beginning, and at the end Trump 1,670,631 (-19,958) and Biden 1,272,495 (+19,958)

          It would seem to me Trump would only need show that the is unreliable, and not the details. Thomas already ordered them to segregate ballots arriving after the polls closed.

In my view this is a disenfranchisement of white suburban and rural voters on a massive scale by un-elected Democrat election bureaucrats (enabled by their elected Democrat bosses) in Detroit, Milwaukee, Philadelphia, Atlanta and others on a massive scale. If it is permitted to stand the consequences will be unimaginable.

In my further view, this is a natural and logical result of failure to enforce the law in urban Democrat jurisdictions. If Democrats can Burn, Loot, Murder and cause Mayhem (BLM squared) with impunity, what would possibly deter them from violating mere election laws?

My hope is that this will result in a great awakening and reaction by the disenfranchised. My solution would be a unanimous Supreme Court decision that disqualifies Electors from States where significant fraud is demonstrated (which would require an examination of ballots (audit) , not a recount that would place a stamp of legitimacy on the process). The Court should realize that it will be emasculated if laws are meaningless.

Permitting this blatant theft by majority/minority jurisdictions will signal the end of the rule of law and elections anyone will have confidence in.

To quote Hillary – Trump should never concede – coming from the smartest woman in the world it must be good advice.

Only Legal Votes Matter.

    This election gives us a taste of who will control the country if the Interstate Compact to circumvent the Electoral College passes: A handful of failing large cities in Deep Blue states.

Their algorithms and mad dash to seek attention through fear and hate have led them to maximize fear and hate within the nation – they have given a false victory to over 70 million people who will no longer have faith in the courts when Trump wins through lawfare.

They have convinced us that the enemy is each other – when the enemy is the system that is causing over 70 million people to lose faith in the system, either by fraudulent elections, or elections decided by courts. Those complicit in this #MediaIndustrialComplex will have a reckoning one day.

    I am done. Wasn’t able to vote for Barry (Goldwater, that is) because the voting age was 21 and I was six months too young. Haven’t missed an election since.

    When you vote, you cast a vote both for the candidate and for the System. Candidates have been a mess the last half century, now it is clear that the System is irretrievably corrupt.
    The Stoics figured it out 2000 plus years ago. Now, I finally get it.

While I have thee utmost respect for Professor Jacobson, I still believe that all the Trump campaign has to do is show that:

1) Incredible statistical irregularities occurred during the count, in five cities.

2) That illegal activities [excluding poll watchers] coincided with those irregularities and which would have made it easier to hide illegal activities.

3) There is any evidence that any ballots were not legitimate.

The argument will be that, because of the secret nature of the ballot, once the ballot is counted, there is no way to determine whether it was legitimate or not. And, that means there is no way it can be removed from the vote total. Now, if those votes are in a secure place, and the total of those votes is known, that number can be excluded from a greater total of which they are part.

The counter argument will be that innocent voters will be disenfranchised if all the votes, in a specific sample, are excluded. However, this would only apply to voters within the tainted sample. And, if the tainted votes are included, this taints the greater total and disenfranchises voters whose votes are not suspected of being tainted. In other words, it is the least intrusive solution which safeguards the total vote cast while limiting the number of those disenfranchised to the bare minimum.

The courts have to deal with their main function, redress. They have to make a victim whole. And, if it is proven, through a preponderance of the evidence that fraud did occur and that said fraud could have denied Trump the election, then the outcome has to be adjusted. Will this occur? It is a long shot. The courts do not really like to decide political contests. And, in this case, they know what to expect if the results of the election, as called by the media, are reversed; violence in the streets.

    One thing they can verify is the number of eligible voters VS. the number of ballots cast.
    Arguing the 80+ percent turnout is problematic, but when it is over 100% it becomes easier.
    Plus, multiple ballots by voters should be pretty easy to check.
    All is not lost.

      Turnout is never over 100%. No state, no precinct, has ever reported more votes than registered voters. Reports that they have always turn out to be false.

      What you do have is turnouts that are implausibly high, but you can’t prove they’re not correct. It is possible that everyone in that district suddenly decided to turn out. Especially with postal voting becoming so popular this year, maybe people who never bothered to vote in person decided to vote by mail. I don’t believe it and you don’t believe it, and the judge won’t believe it either, but what we all believe isn’t relevant; without evidence to the contrary the judge must take it as if it were true.

        I get all that.
        It may be implausible, but we have never done it this way before, and impossible isn’t an option.

The numbers in its original story were fabricated; but even it retracted its claim. Here’s its updated story. Which is still wrong.

          A lot of places vote over 100% all the time. They don’t vote more than 100% registered voters; they vote more than 100% of eligible voters such as adults living in the precinct. The reason is that people leave the county and are left on the voter roles. For example, Los Angeles County has over 2 million people on the voter rolls who do not live in the country. The huge question is who votes those dirty ballots. We know that Democrats hate to surrender them. For example, look at all the law suits Judicial Watch has launched to clean them, but it never happens. Those dirty ballots combined with anonymous mailings make it easy to cheat.

          No, no place records more votes than eligible voters. Reports that claim to have found such places always turn out to be relying on out-of-date census information.

          And no place records more votes than registered voters either. The fraud happens when people apply for absentee ballots in the names of registered voters (who may not actually exist, or may exist but not know that they’ve been registered), intercept them when they arrive, and vote in that person’s name.

          You need better fact checkers.

          The largest amount of dirt on any voter listing is the people who moved, but are still registered. Some states seem to keep them nearly indefinitely. Many counties in Colorado, California, and other states have less than 80% accuracy in their voter registrations.

          In 2012, one Philadelphia precinct voted more than 160% of the adult population in the precinct. 140% for a precinct is not uncommon, and 110% happens all the time.

          In some cases, the courts have ordered the voter registrations cleaned, but the states never complied.

          As I said, Judicial Watch is active in this area. You can check with them for more info.

I’ve read that that McConnell is wooing Senator Manchin. West Virginia’s energy industry is in the Left’s crosshairs. With their radical agenda, Manchin may be coaxed switching politically to an Independent (or Republican) as a way to secure a majority against The New Green Deal.

Manchin won’t survive as a Democrat in West Virginia in the 2024 presidential cycle. He either announces his retirement or switches parties.

Seems to me, the way the Democrats have behaved every day since the election in 2016, and especially this year, with riots in the streets and cries for defunding the police, etc., if there was ever going to be a massive red wave in America again, last Tuesday would have been it. If you run the numbers of mail-in votes for president against the state referendums and Senate votes cast the percentages for a President only vote there are many states that are way beyond the statistical chance of it happening with that large of a gap. Maine, New Hampshire, North Carolina, South Carolina, Kentucky, Ohio, Minnesota, Nebraska, and even California all had an unusually high “President only” votes in their mail-in ballots.

This election is being stolen. Keep your powder dry the Liberty tree needs a little pruning.

      It turns out 90% of registered voters is in line with past performance in Wisconsin. I guess people who don’t vote don’t bother registering. The mistake many people are making is comparing this figure (ballots divided by registered voters) with official past turnout figures, which are ballots divided by the estimated number of eligible voters, i.e. all citizens over the age of 18. That figure is in the low 70s, which is in line with historical performance.

There is no shortage of evidence of election fraud and election laws being violated by corrupt courts, election officials, pollsters, and fake newsers. It is not incumbent on Trump to prove the fraudulent count is enough to reverse a result, but that reasonable suspicion exists to warrant corrective action in compliance with applicable state and federal laws.

The car honking started while I was at synagogue. As I left on my way home someone on the street cheerfully told me what a great day it was for the Jews, because “that antisemite” was out of the White House. I’m afraid I lost my temper and gave him quite a large piece of my mind. You can call Trump a lot of things and I might agree with you, or at least shrug it off as not worth arguing, but “antisemite” is not one of them.

      There are varied theologies within “Conservative Judaism”, but none of them accept that the Exodus from Egypt and the Revelation at Sinai actually happened, or that G-d literally authored the Torah and dictated it verbatim to Moses. Or that one day a literal descendant of David will restore the monarchy, rebuild the Temple, restart the sacrifices, and reinstate the Sanhedrin. Or that at the End of Days the dead will literally come back to physical life. In other words their religion has less in common with actual Judaism, as it was universally understood until very recently, than do Islam or many forms of Christianity. Even a triple god seems somehow less of a deviation than that.

Sending millions of ballots into the wild is an unverifiable and therefore, invalid election. Once the ballot chain-of-custody is lost, there is no recovery.

In a valid election:

* Voter presents himself for a ballot
* Election official verifies voter is registered
* Election official issues one ballot to voter
* Voter marks ballot
* Voter submits ballet for counting.

All of the above steps are witnessed by multiple election officials and other observers. The ballot never leaves control of election officials.

Compare that to this election:

* Ballots mailed by private companies to registered addresses.
* Post office does not ensure delivery
* Ballots then received, marked and returned by unknown parties.
* Drop boxes receive unknown quantity of ballots from individuals.
* Mail boxes receive unknown quantity of ballots from individuals.

None of the above is witnessed by any election officials or private citizens. This is how a government takes complete control of an election and eliminates the voters.

There is no way to distinguish a valid ballot from a fraudulent ballot. In other words, we didn’t have an election, we only went through the motions of an election and now we’re suppose to take our government’s word for the outcome.

With a politicized and corrupt government, (IRS, DOJ, FBI, CIA, etc.) only a damn fool would believe anything this government says or does.

    Add dirty voter rolls to those issues. On the average, about 20% of the voter rolls are invalid mostly because the people moved to another county. If someone knows (they probably do) that those voters are not valid, then the system you mentioned that was practiced in this election, allows the people who know about the dirty ballots to vote them. By the way, most of the voter rolls are dirty on purpose.

Does anyone know what happened with incorrect absentee ballots in GA and PA? It sounds like the election boards were giving them to the campaigns to be corrected, but I wonder if this was only occurring with the Democrats. If so that would seem to be a pretty obvious violation of the voting rights act. Obviously those corrected after the closing of the polls would be illegal, but I’m talking about corrections before then.

And numbers like this are enough to turn an election. There were several million more absentee ballots for Ds than R in PA, and a 2% error rate would be 20k ballots corrected per million for D but not R.

And I can’t see how the board of elections could hide this. There’s going to be a % of successful absentee ballots for each party, both in the state and nation wide. If the nationwide average is 98%, and Rs in PA are about that, but the D’s are 99.5% in PA, well, that’s a problem.

This is basically how the NC election in 2018 was overturned, based on the % of absentee ballots for each party. In that case it was apparently good old ballot box stuffing, but the net effect is the same – the % of ballots cast by party doesn’t jive.

Investigators must look at every nursing home because of the voting fraud imposed on that population.

We are enraged.

    I too have thought about switching to Independent after witnessing the continued shameful conduct of the RINOs and their undisguised contempt for President Trump. He has succeeded time and again whereas so many of them are pathetic squishes and losers.

In every jurisdiction where Republicans have the power to do so – Georgia is one, I believe – the “vote by mail” scam needs to be shut down.

Dems know this, which is why they’ve pushed to “nationalize” voting laws to remove every possible impediment to the type of wholesale cheating which goes on in the cities they control.

Republicans need to grow a pair & call “vote by mail” what it is – “Dems want vote by mail because it allows them to manufacture fraudulent votes to cancel out the real votes of their opponents.”

If the Democrats pull off this cheat, then it’s time for Trump to start a new party. I believe Trump could pull a large amount of minorities, if he separates himself from the label of “racist” (unfairly), that the Democrats have put on Republicans.     I continue vote for the down ballot and local reps and attempts to attach yet another tax to my real estate. We get the old “But it’s ONLY 3%!” On literally evey election day for the last decade, including the low turnout midterms. We have been “It’s only 3%’d” to death. The Democrat population stronghold in Bozeman keeps voting themselves our money and we are currently looking to move out of the county for this reason. But so far our votes still hold off some of their referendums, so we continue to vote while we’re still here.

I’d be lying if I said that Donald Trump is the most popular guy in the UK but I have noticed a lot of support for his fraud allegations in places like the comment section of the Daily Telegraph, the journalist Andrew Neil’s followers on his Twitter account etc (Neil is the best journalist here in Britain so he has got considerable support elsewhere.

On another point, I grind my teeth when I hear people refer to the President-Elect, Joe Biden. As far as I’m concerned (being a foreigner) no-one has yet cast a vote for Biden, these elections have been concerned with choosing the members of the Electoral College and it is only these Electors who get to choose who the new President is to be, and they can vote as they wish. It just hit me, accepting an election because we can’t prove it was fraudulent flips the classical burden of proof on its head. Historically, the burden of proof fell on the one seeking to exert power, rather than the one having power exerted upon them. That is why in a criminal case, it is the prosecution that must bear the burden of proof beyond a reasonable doubt, that their target did, in fact commit what they are accessed of. An innocent accused has, of course, had no time, prior to the accusation, to build accounts of their whereabouts, document proof of what they were doing during the time the crime was committed, or any such thing.

An election, in contrast, has months and years to prepare and plan all of their evidence of valid results, and numerous avenues to create and retain that chain of custody, and the results of the election decisions impose great rewards and great costs on he people involved.

Is to do otherwise not a foul inversion of one of our bedrock principles of the Rule of Law and a open invitation to its perversion?

Assuming nothing happens in courts, DOJ or state legislatures for GOP and DJT, can voters sue the state official that certifies the election. Can this be a class action and that continues after that person leaves office? Just wondering what legal liability these officials have?

    That’s what’s so incredible, that their insanely arrogant hubris may be their own undoing.
    At first I was somewhat dismissive of the accusation of “Trump Derangement Syndrome” but now I really think it’s a real, genuine sickness, though of course with most professionals being infected with it, it seems like it may be practically incurable. It’s kind of like abortion and sodomy: not so many decades ago when professionals were decent and truthful and warned about such vile evils, unlike today where they militantly, arrogantly, hypocritically DEMAND such depravity as they gleefully participate in the depravities they once warned against. God save us, for it really boils down to those who hate God and America more than anything else and must at all costs DESTROY those who disagree.

The irrefutable fact is that it’s MATHEMATICALLY IMPOSSIBLE for Biden to have won legally/legitimately, even without the massive evidence, affidavits, etc. of gross, virtually immeasurable election fraud on the order of MILLIONS of illegal votes. Whether or not our broken, biased legal system is capable of prosecuting said proven fraud is another matter. Thankfully the SCOTUS now has a constitutional majority of Thomas, Alito, Barrett, and hopefully Kavanaugh and Goresuch versus the treasonous Roberts et al lefties. No sane person living in the real world can argue the Biden cadaver won bigger than charismatic 0bama in view of how most of his laughable, few “rallies” could have been held in a phone booth, versus Trump’s spontaneous 100s of thousands, only those deranged by Trump Derangement Syndrome, utterly blind to the irrefutable reality that TRUMP WON by an even greater margin than he did in 2016. Pity the fools that pretend otherwise who should be in padded cells as dangers both to themselves and the public safety.
