Famed civil rights attorney Gloria Allred will be in a Boston area courtroom Wednesday in an attempt to unseal the sworn testimony given by Republican Presidential hopeful Mitt Romney, in a prior court case, RadarOnline.com is exclusively reporting.

The Boston Globe is headed to court tomorrow morning for an emergency hearing in an attempt to obtain a court order to unseal the sworn testimony given by Mitt Romney in a prior court case and to lift a gag order so that the parties can speak about Romney. Gloria Allred will be in court representing one of the parties in the case,” a source close to the situation tells RadarOnline.com.

The emergency hearing will take place at the Norfolk Probate & Family Court in Canton, Massachusetts, and Justice Jennifer Ulwick will oversee the proceedings which will begin at 9 a.m. EST.

    A few thoughts…

    1. this level of nasty would only appeal to the hate-twisted moonbattery, not the average American

    2. whatever the family court (which normally has a strong bias toward protecting minors) has is probably very old news

    3. IF the court rules, it is still subject to an emergency writ to a higher court to stay the order

    Bottom line…I ain’t skeered. I worry more about the back-blast from a Trump stupidity.

      I would bet Trump is just being strategic by letting it be known he can counter sleaze with sleaze. It’s said in other places that Trump may have uncovered divorce papers for the Os. Unconfirmed, but somebody is out there letting it slip to test the waters.

      I do not understand. According to another website, the woman was not a minor — she was in her late thirties. Hasn’t the conservative rap against Romney been that he’s maybe not really pro-life? So wouldn’t unsealing court records showing he counseled a woman not to have an abortion just confirm his pro-life position?

    Reports state Gloria Allred will represent the Boston Globe in a quest to open sealed testimony regarding abortion counseling by Mitt Romney, acting in capacity of ‘bishop,’ to a Mormon woman by the name Carrel Hilton Sheldon, a self-described social Democrat.

    It is reported Sheldon proceeded with the abortion in spite of Romney’s urging to consider the life of the child and she subsequently left the Mormon church.

    There presently exists a legal gag order on the court records pertaining to this set of events.

      She went on with the abortion, despite his advice. It was her own damned choice.

      The consequences of her actions should not be Romney’s fault. He gave advice. She chose not to take it. The LDS, as just about every denomination that calls itself Christian (with a few exceptions), have a very high appreciation of life, especially innocent life. She should have expected that from a religious denomination that considers itself “conservative.” When she chose to join that congregation, she had to read the rules, accept and follow them. If she didn’t want to, again, that was her choice.

      The results or consequences were totally self-inflicted. They’re not Romney’s fault.

      All Allred wants to do here is to go all “War on Women” on Romney and the LDS church – which, BTW, has been expanding everywhere.

      (And, since we know how Leftists went all gung-ho on Mormons after the passing of Proposition 8 in CA, and MA allows for gay marriage – which Romney did NOTHING to stop -, don’t be surprised at this.)

So Gloria is going to ask a judge to lift a gag order and unseal some sealed testimony so that she can use it to potentially embarrass a presidential candidate and influence the outcome of a national election?

Even the worst kind of Democratic hack judge would probably be hesitant to comply with a request that obviously has nothing whatsoever to do with the merits of the case that is before the judge. Then again, it is Massachusetts, where the normal rules of jurisprudence don’t seem to apply, so who knows?

However, my experience has been that 95% of the time, judges in family courts are social justice leftists, so Gloria may prevail in getting whatever unsealed…

Emergency? EMERGENCY? Why is this an EMERGENCY, other than blatant partisan advantage? If this judge accedes to this request, I hope it will be seen for what it is.

That said, I couldn’t care less if Michelle & Barack Obama filed for divorce. Who cares.

They are trying a repeat of the O’s run for the US Senate here in Corruptuionstan, aka Illinois. In that race they got a friendly judge to unseal the divorce records of his opponent which contained the usual statements “he is rotten, larger than me, I am frightened”, etc. The ex wife defended her ex husband but to no avail, he lost the election and the whole US has suffered since.

There should be a law in every state prohibiting Gloria Allred from ever appearing in a court room unless in shackles and a bright orange jumpsuit. I can’t come up with words vile enough to describe my feelings for her.

I am earnestly praying for the protection of Romney.

Can an attorney with no stake in the case even ask for the documents to be unsealed? Hope Romney’s attorneys either kill this move outright in court or ask for a new date when Romney himself is available to ask the court. Say, Nov 7th?

    There appears to be precedent for a media outlet to apply for unsealing of records in MA, based on a “well-established common law right of access to the judicial records of civil proceedings.” http://masscases.com/cases/sjc/432/432mass593.html

    I’m not a MA attorney, but in most states, court records are presumptively public records, so a court has to have a compelling reason to seal them — e.g. to protect privacy of a party, or to protect a criminal defendant’s right to a fair trial. The case I linked above suggests that if the interest that compelled sealing in the first place no longer exists, then a media company can petition for unsealing. Can any MA attorneys confirm?

Seriously…how does she define emergency to the judge? What is the emergency? Beyond having uhhhhbama re-elected, I can’t imagine what the emergency could be.

She’s a recent (October this year) Duval Patrick appointee.

Judge Ulwick is new the bench and can be a bit quirky with some of her orders. They are always well reasoned but sometimes a bit creative. There is no telling what she will do. And remember, Judges in Massachusetts are appointed and are not up for re-election.

    Unfortunately as a friend who was once a lawyer (he sadly has fallen to schizophrenia) explained to me morality and legal ethics have NOTHING to do with each other.

If this disgusting and obvious ploy has ANY affect on the vote, then we’re truly a doomed country. Allred is contemptible, but that anyone would pay attention to this “surprise”, this late-in-the-game silliness….as if whatever it is would be a lot worse than the Commander-in-Chief and his minions letting 4 Americans, one an Ambassador, be murdered.

As I said before, Allred better not go into attacking the right of a clergy to counsel someone from his/her parish. She better not go there.

Either way, this definitely tells me she is going all “War on Women” here.

    I scanned the Ace piece, and I know a lot about LDS theology (I have family members who are LDS).

    This would be tantamount to a Catholic priest counseling a woman to carry a child to term, and relinquish it to be adopted by a good family.

        SWORN testimony in a family law case by a clergyman suggests a severing of parental rights, OR…

        a very nasty child custody controversy.

        Normally, in most jurisdictions, LDS leaders have the same clerical status as a priest or other religious leader has, and there is a privilege against compulsory testimony, but it belongs to the congregant…not the person counseling. A few exceptions exist, and they only come into play in really unhappy circumstances affecting the best interests of a minor (assuming that is implicated here).

      If this is the case in which Romney, as a Mormon bishop, counseled a woman not to have an abortion, then perhaps he was questioned about the specifics of his religious beliefs in the deposition (or whatever the sealed testimony was). Since Romney was acting in his capacity as a bishop when he allegedly “intimidated” the woman, his religious beliefs would have been relevant, and they may have been explored in great detail.

      The woman, as a party to the lawsuit (presumably the plaintiff) would know the substance of Romney’s testimony. The woman reportedly went ahead with the abortion (despite Romney’s “intimidation”), and also subsequently left the Mormon church because of Romney’s behavior. She clearly has a big grudge against both Romney and the Mormon church. If she believes that something Romney said in the deposition about his religious beliefs/practices could be used to embarrass him now, perhaps that is what Allred is after.

        So, in this case, she wants to sink Romney, the Church of Jesus Christ of Latter-Day Saints – along with an entire American population that is hurting economically.

        This woman thinks that a clergy for a religious organization demanding accountability is a bad thing. What the heck did she expect – “live and let live”? That’s not how most religions work! She would have gotten the same speech from a priest or a minister at another church. The “I’m going to do as I damned well please!” doesn’t work when accountability is demanded.

        And for that, she wants to destroy somebody?

        This is the reason why Church matters are separate from that of the State, as the First Amendment plainly protects the “free exercise” of religion.

          I see this kind of thing a lot in family law cases where one spouse/parent has a dark history.

          They often come back into court to get the “stamp of approval” of an authority. They often go to extreme measures to show they are not who they were, including tarring everyone involved in the prior actions.

          Of course, we are totally speculating here. I have no idea if any of this really applies.

Do we have any idea what kind of material Allred filed in support of her motion?

How hard can it be for someone to run to the courthouse to get a copy, or is this stuff online?

Or did Allred make the announcement after the court closed?

If this was going to amount to anything, why did they wait until now to go for it? Was that because the imminence of the election was what makes it an emergency? I’m not sure that adds up.

The only other explanation I can think of is sheer desperation.

If anyone had “the goods” on Mitt, it was the Democrats and Ted Kennedy. He could have used every little dirty thing back then. Why didn’t he?

When running for Governor in 2002, Democrats in MA could have unsealed those records. If they had “the goods”, they would have definitely used them. Why didn’t they?

And why is that Female Spawn of the Devil doing that NOW?

And why is the Boston Globe getting involved in this, when they could have done this way back then, in 2002 – just as the Chicago Tribune did to Jack Ryan in 2004?

I don’t know much about law….but, Professor, on what grounds would Allred ask the court to unseal the records, assuming she was not the lawyer for the original case?

We’re ALWAYS trembling about what they’re going to do to us at the 11th hour, rather than shattering the paradigm from the beginning and putting THEM on the defensive — from the beginning. You know, I’m getting pretty mad at that woman, Gloria Allred. She obviously thinks all women do (or must) think with their “lady parts” above all else.

Sorry Gloria, but I don’t think with my “lady parts”. At this point in my life, they’re quite irrelevant to me. (They are for The Duke, for sure.) 😉

But Allred really thinks that way. Is that ALL she believes? Is that the core of her being – to protect and preserve the rights of women’s “lady parts” – even at the expense of men?

If all that matters to women is their right to, ahem, “choose”, then I don’t want it, and I refuse to be called a “woman” in her mold. I have two children, daughters. They’re right here with me. I’m raising them, as the Almighty gave me and their father that responsibility. I will be there for them always.

I fear for their future.

I see The Duke, whose career has been stagnant and rotting on the vine since The One was elected four years ago. It is taking a depressing toll. And he’s not the only one. I see other women around me worried about their husband’s prospects. Careers stagnated. Careers or jobs ended. Having to do with less – much less. Inflation has taken a serious toll everywhere – even here in the Houston area, which was supposed to be relatively “untouched” by this recession. Newsflash – we’re suffering here as well, and it is mainly because of The One, the Democrats and all who support them.

I fear for his future – and all the men’s.

Lots of women’s careers and jobs have also been stagnated around here, and even lost. I know of a friend of mine, female, who lost her job pretty much unannounced. She has had to make do with much less because of it. And she’s single. If anyone was supposed to think with her “lady parts”, it is my friend. But she’s not.

Gloria Allred, Obama, Democrats: stop insulting our intelligence. We don’t just think with the “Lifetime”, or the “Oprah” radar. We see what’s around us, yet you dare to tell us, “Who are YOU going to believe – US, or your LYING eyes?”

All of our futures are at stake here – even our own children’s. If this economy keeps sinking under the sea level like the Titanic, I don’t think people are going to have much time or inclination to think that much with or about their genitals.

“Lady Parts” don’t matter. Our futures do.

A couple of thoughts:

(1) Do any readers practice law in MA, and if so, can you hunt down a summary of the standard for unsealing family court records?

They’re presumably sealed to protect the privacy of the parties to the action, not to protect the privacy of witnesses who testify in those proceedings, but can you confirm? And if my surmise is correct, would Romney even have any standing to oppose the Globe’s request to unseal, especially if the parties to the proceeding don’t object to the unsealing?

(2) If the judge grants the request, would Romney have any means (or standing) to immediately appeal the order and stay the unsealing pending review?

On on the Trunp side, Hillbuzz is speculating that Trump has info on Obama claiming to be foreign student in order to game the system and get financial ad. Brietbart has also speculated on this in the past.

Maybe Elizabeth Warren is representing her…oh wait…

    She can apply to the court for permission to appear pro hac vice; it just requires sponsorship by a Massachusetts-licensed attorney. I did that once when I was in MA temporarily, working in the Boston office of a law firm I used to work for. It’s not a big deal. And there have to be plenty of MA Donk attorneys willing to sponsor her.

Logic, logic, logic. Then tell them to point out where in the capacity of Governor he tried to or succeeded in interfering in a woman’s right to choose or in regard to women obtaining birth control.

The vicious attacks by the left on Sarah Palin and Tim Tebow’s mother are part of what drove me away from the hypocritical Democratic Party.

Obama and his cronies are desperate they know they need something BIG to blunt Mittmentum.

We need to punch back twice as hard.

    There will be numerous attorneys before the judge tomorrow. Romney will have counsel there representing him to argue his case. Unless the judge rules to unseal them and an appeals court upholds the lower court’s ruling (there will be appeals filed either way), Romney cannot address the issue due to the gag order.

    As of now, there’s nothing for him to get ahead of.

Personally, I’ve become absolutely numb to all the feces the left and Obama has been slinging. It’s like watching MTV every day, eventually you start losing IQ points. It just doesn’t stick and I really don’t care. Jerry Sandusky could be the nominee and I’d still vote against Obama.

1) Do religious leaders sometimes counsel their fellow adherants not to have an abortion, not use medical marijuana, stay with a difficult (and possibly abusive) spouse, refrain from fornication or other sexual acts?

3) Did she have the abortion?

4) Did she have the child?

If Republican-minded lawyers in California and Massachusetts are not willing to do their part to investigate and defend against the likes of Gloria Allred and Elizabeth Warren, then it is time to revisit opposition research (even though Allred is technically not an opposing candidate).

Why would Allred represent the Boston Globe? Don’t they have their own lawyers for this? Something seems fishy.

Non story, and the electorate will not care.

Mitt doesn’t seem worried. At all. He has been through the gauntlet against Democrats before, I don’t think there is a skeleton out there left that can bring him down. That isn’t to say Allred won’t try to blow whatever this is out of proportion with the help of the media.

I think this would taint Obama, who already looks increasingly desperate. The women who would be inclined to believe Allred are already voting for Obama. I suspect the rest will see this for what it is, a last ditch effort to save a failing campaign.

And if Mitt was a party to having the records sealed, isn’t he a party to having them opened or not?
Thirdly, what’s the emergency to open the records if not to do harm to one or more of the parties?

    Obama may have overestimated how far he can successfully push issues like this. There was a news story up a couple of days ago about Sandra Fluke making a well-publicized appearance in (I think) Nevada. It was attended by a whopping crowd of about ten people. And I must say Fluke, Allred and Warren are all repugnant to me.

Is it at all certain that Gloria Allblue is out to assist Obama specifically? If she’s in Boston, could she be out to sink Scott Brown?

Mandatory disclaimer time: Not licensed in Mass., not licensed in your jurisdiction, not your lawyer, any information given is general in nature and speculative.

In theory, there is supposed to be a pretty high burden to get a gag order lifted or a seal broken on a sealed case. That’s because, in theory, there’s a pretty high burden to get the gag order/seal issued in the first place. Remember, the presumption is that anything in the court system, with the exception of juvenile criminal records, is considered to be public record. Someone has to go to a judge, ask for the gag order/seal to be issued and give a damn good reason why.

Note I said in theory. Depending on the jurisdiction, and I know nothing at all about Mass., records are routinely sealed for matters involving a minor or where financial information is at issue. However, in those circumstances you better show a very compelling reason indeed to get those orders lifted.

Now to parse the story. This is in family court so it could be estate, child support/custody, divorce proceeding, things of that ilk. This says it’s seeking testimony given by Romney under oath. That’s interesting phrasing. It could be court testimony or it could be a deposition. There’s also nothing that says that Romney was a party to the suit and from the phrasing of the article, which you would assume was vetted six ways from Sunday by the attorneys before it ran, it indicates to me that Romney was a witness, not a party.

This is all blatantly uninformed speculation on my part, of course. But my guess is that it’s not the abortion story because an IIED case wouldn’t be before family court. Maybe the woman tried to get the child back? I vaguely recall that she put the child up for adoption though that could be wrong.

As far as how does Allred know, gag orders do not apply to information given to counsel in the course of representation. Thus whoever this is would be able to tell Allred about it and it is even possible that they may have a copy of whatever the testimony is.

Frankly, unless it’s a love child or a live boy situation, Allred’s better off with the motion being denied. Then there’s total speculation without confirmation as to what’s in it, thus letting the oh noes sister wives speculation continue. Romney is in the worst possible position as he cannot counter without being in violation himself.

Were I the judge? The hearing would begin with some very pointed questions as to just how it was that this hearing became public. Once a gag order/seal is issued, everything about the case is supposed to be out of the public eye, even hearings on the matter. I’d be walking in itching to throw someone in jail.

Oh and I do agree there’s at least a 90+% chance this is going to be lifted.

I’m not licensed to practice in MA, and in the 4 states where I am licensed, I stay the hell away from domestic law matters. In probate and guardianship it is routine for filings to be sealed. I don’t really have an informed opinion about the batting average on efforts to unseal. I realize it sure worked to hurt Jack Ryan in IL (via CA).

Romney’s people should assume the worst, and expect that whatever it is, it will be released by the court, or Allred will leak it with plausible deniabilty, if the court orders it to remain sealed.

So, were I Romney’s counsel at the hearing tomorrow I would put any and all possible witnesses on the stand, including Allred to establish who has knowledge of the sealed information, and how they obtained the information. Mind you, this would not be about the information itself, but about the dissemination of the information which is sealed (for the time being). I would nail that down before the Judge rules, to exert the maximum suasion against the folks who might be inclined to leak the information, even if the Judge rules against them.

I think Allred is a despicable POS, reason # 876,239,173 in the endless series of examples which explain why people hate lawyers.

The situation room at the WH gets full confirmation and real time footage starting within two hours of the commencement of the attack. obastard sat there for seven hours as the attack raged on and never ordered drone strikes or reinforcements of any kind. He sat while the Islamacists finished their business and having their way with our people.

    How much was o paid by the Islamic radical factions to allow this devastating attack on and humiliation to America?

As far as Mitt is concerned this may be a case of no good deed going unpunished. Ace found a 1996 story in the Boston papers not available on line through the paper but which was copied in its entirety at what appears to be a fashion blog. The original reporter was not sympathetic. Neither were most of the comments on the blog.

Allred and Stemberg, her ostensible “client” (and make no mistake that the real client is obastard), will puff this up like the Hindenburg to get as much distraction and smear mileage out of it they can, which will be a lot in view of the media’s desperation to talk about anything but Benghazi.

    My negative commentary is based on two decades (nine in the military, three in Chicago, the rest in the SF Bay Area) of watching the bad guys win almost 100% of the time. By “bad guys,” I mean corrupt military and civilian officials. (And no, it’s not navel-gazing: most of it has to do with monstrous breaches of propriety and ethics having nothing to do with me.) No matter what they did/do, they seem to get away with it.

    In addition to that… Why is it the press can so easily investigate what Sarah Palin painted in her high school ceramics class, but they can’t report on Sheriff Joe Arpaio’s investigation and proof of multiple forged Obama/Soetoro documents?

    The silence is deafening!

      The fecklessness by the GOP ‘establishment’ in chasing down the details of Obama’s fake life is as horrifying as a communist with a falsified mainstream life being elected president.

      We’re only as safe as our ‘police department.’ (Those ‘police’ used to include the press. Obviously, not anymore.)

Speaking of unsealing private records, Donald Trump has some info he has said he will reveal later today regarding Obama. Seems he has divorce documents that Michelle filed in 2000. Trump has been married and divorced more times than most of us have, so I think he realizes that a straightforward divorce should not be a major problem for a politician.

However — if Michelle alleged habitual drug use, a sexually transmitted disease, mental or physical abuse of herself or her daughters, or infidelity with an individual or individuals of other than the female gender, it could be, as Vice President Biden would say a “big f—ing deal.”

I should add that the divorce story is a rumor, not something I have confirmed.

If it is the Stemburg divorce, it appears Gloria Allred is slipping.

Ms. Sullivan Stemberg was worth $5 million at the time of the divorce and spent $4 million pursuing the divorce???

Mitt Romney supposedly has no objection to the testimony being unsealed.

Ms. Stemberg lives in an upscale $62,400 a year apartment/condo and her ex-husband pays for her health insurance and has provided for their child via a trust.

How did Gloria Allred land this client?

Will Gloria Allred actually help this women get more alimony/support or is this woman going to be one more female client of Gloria Allred who gets used by Gloria and then ditched when media attention moves on?

Does Gloria Allred really think this is going to impact the election or is she just aggrandizing herself for another 15 minutes of fame?

Does Gloria Allred really care about women? If so, why hasn’t she taken her considerable tenacity, perseverance and pugnacity and moved to African, the Arab world, or South Central Asia, where women get treated like dogs and 12-year-old girls get shot simply for trying to obtain elementary education?

The stench of Democrat desperation is stifling.
