Federal Charges Against David DePape In Paul Pelosi Attack
Charged with Assault and Attempted Kidnapping.
When I said we needed for evidence to come in before reaching conclusions about the attack on Paul Pelosi, I suggested from what was known “The ‘MAGA’ attacker turns out to be more Jared Loughner than anything …” It’s looking like that was the case, just like Loughner, someone suffering deep mental problems and delusions when he shot Gabby Giffords.
That attacker, David Depape, was reportedly pscychotic and suffering from a mental breakdown, and an FBI Criminal Complaint just filed seems to confirm he was delusional.
From the FBI Press Release:
A California man was charged today with assault and attempted kidnapping in violation of federal law in connection with the break-in at the residence of Nancy and Paul Pelosi in San Francisco on Friday.
According to the complaint, David Wayne DePape, 42, of Richmond, was arrested on Friday inside the Pelosi residence by San Francisco Police Department (SFPD) police officers responding to a 911 call from Paul Pelosi, husband of U.S. House of Representatives Speaker Nancy Pelosi. Paul Pelosi later described to police that he had been asleep when DePape, whom he had never seen before, entered his bedroom looking for Nancy Pelosi.
According to the complaint, minutes after the 911 call, two police officers responded to the Pelosi residence where they encountered Paul Pelosi and DePape struggling over a hammer. Officers told the men to drop the hammer, and DePape allegedly gained control of the hammer and swung it, striking Pelosi in the head. Officers immediately restrained DePape, while Pelosi appeared to be unconscious on the ground. As set forth in the complaint, once DePape was restrained, officers secured a roll of tape, white rope, a second hammer, a pair of rubber and cloth gloves, and zip ties from the crime scene, where officers also observed a broken glass door to the back porch.

9. On October 28, 2022, at 2:23 a.m., San Francisco Dispatch received a 9-1-1 call from Paul Pelosi (“Pelosi”) located at the Pelosi residence in San Francisco, California. Pelosi stated words to the effect of there is a male in the home and that the male is going to wait for Pelosi’s wife. Pelosi further conveyed that he does not know who the male is. The male said his name is David.
10. At 2:31 a.m., San Francisco Police Department (“SFPD”) Officer Colby Wilmes responded to the Pelosi residence, California and knocked on the front door. When the door was opened, Pelosi and DEPAPE were both holding a hammer with one hand and DEPAPE had his other hand holding onto Pelosi’s forearm. Pelosi greeted the officers. The officers asked them what was going on. DEPAPE responded that everything was good. Officers then asked Pelosi and DEPAPE to drop the hammer.
11. DEPAPE pulled the hammer from Pelosi’s hand and swung the hammer, striking Pelosi in the head. Officers immediately went inside and were able to restrain DEPAPE. While officers were restraining DEPAPE, Pelosi appeared to be unconscious on the ground. Officers removed a cell phone, cash, clipper cards, and an unidentified card from DEPAPE’s right shorts pocket. DEPAPE provided officers his first and last name. After officers asked DEPAPE if he had an ID on him, DEPAPE said it might be in his backpack on the back porch and later stated his backpack was near the broken glass. When officers removed DEPAPE from Pelosi’s residence, police body worn camera footage showed a glass door that appeared to be laminated glass, broken near the door handle. San Francisco Police Department recovered zip ties in Pelosi’s bedroom and in the hallway near the front door of the Pelosi residence. In addition, law enforcement searched DEPAPE’s backpack at the Pelosi residence, and they found, among other things, a roll of tape, white rope, one hammer, one pair of rubber and cloth gloves, and a journal.

13. Pelosi was interviewed by SFPD Officer Ariane Starks in the ambulance during transport to San Francisco General Hospital. Pelosi stated he had never seen DEPAPE before. Pelosi was asleep when DEPAPE came into Pelosi’s bedroom and stated he wanted to talk to “Nancy.”1 When Pelosi told him that Nancy was not there, DEPAPE stated that he would sit and wait. Pelosi stated that his wife would not be home for several days and then DEPAPE reiterated that he would wait. Pelosi was able to go into the bathroom which is when he was able to call 9- 1-1. Pelosi stated that when the officers arrived, that was when DEPAPE struck him with the hammer.
The statement DePape gave was other-worldly, including a plan to wait several days for Nancy to return:
15. In a Mirandized and recorded interview of DEPAPE by San Francisco Police Department Officers, DEPAPE provided the following information:
a. DEPAPE stated that he was going to hold Nancy hostage and talk to her. If Nancy were to tell DEPAPE the “truth,” he would let her go, and if she “lied,” he was going to break “her kneecaps.” DEPAPE was certain that Nancy would not have told the “truth.” In the course of the interview, DEPAPE articulated he viewed Nancy as the “leader of the pack” of lies told by the Democratic Party. DEPAPE also later explained that by breaking Nancy’s kneecaps, she would then have to be wheeled into Congress, which would show other Members of Congress there were consequences to actions. DEPAPE also explained generally that he wanted to use Nancy to lure another individual to DEPAPE.
b. DEPAPE stated that he broke into the house through a glass door, which was a difficult task that required the use of a hammer. DEPAPE stated that Pelosi was in bed and appeared surprised by DEPAPE. DEPAPE told Pelosi to wake up. DEPAPE told Pelosi that he was looking for Nancy. Pelosi responded that she was not present. Pelosi asked how they could resolve the situation, and what DEPAPE wanted to do. DEPAPE stated he wanted to tie Pelosi up so that DEPAPE could go to sleep as he was tired from having had to carry a backpack to the Pelosi residence. Around this time, according to DEPAPE, DEPAPE started taking out twist ties from his pocket so that he could restrain Pelosi. Pelosi moved towards another part of the house, but DEPAPE stopped him and together they went back into the bedroom.

Are we to believe that the front door was unlocked? That really is the only explanation if it opened for the police without being opened by a third person.

When did the police go in? Did they go in the front door when they first arrived? Did they go in only after DePape hit Pelosi? Did they enter by the glass door?
Why didn’t DePape restrain Pelosi?
Just who was DePape planning on luring to the residence? If it was all about Nancy, Nancy, Nancy that does not make sense.
Good questions that you raised:
“When the door was opened …” If both men (one in just underwear) were struggling, then who opened the door? It wasn’t the police.
If Pelosi didn’t know who the individual was, how did he know his name was “Dave”?
With all of the security cameras, and alarms, how does one sleep thru all that, only to woken up by the presence of the intruder?
A lot of conversation occurred before the police arrived, and then the struggle began. Which goes back to the first question: Who opened the door for police?
Maybe the body cams will shed some light….if they don’t suddenly get erased accidentally.

Given the people involved and the Fed’s obvious interest in getting out ahead of the story with their own spin it’s not beyond possibility that someone would be sanitizing unhandy information.
See paragraph 11 in the affadavit. It describes shorts with pockets. I’m the first to say that the affadavit is sloppy and incomplete, but the “shorts” in that description would not be underwear.

Based on my observations of derelicts in Seattle (where I lived) and Portland (where I travel every 4 or 5 weeks for errands), those would be surfer-style board shorts that I’ve seen on plenty of derelicts in both places..
I think there are gaping holes in the affadavit. Cannot say for sure what’s true. On the underwear front, release of surveillance and police bodycam vids and snaps would at least clear that one up, along with the weird interaction at the front door. In the meantime, people should back away from the “tighty whities” line.
Not only that, but the glass is on the OUTSIDE of the door. How does that show a break in?
If the panelled glass in the outside door is laminated, it might either be glass with a strong plastic film glued to the inside of the glass or two layers of glass with a plastic film glued between them. Either way, if you use a hammer to attempt to smash the glass the plastic film will stop unconstrained glass fragments from being projected into the interior if a hammer is used from the outside. As long as the plastic film is untorn, glass fragments will tend to fall on the outside of the window panel. This may explain the quantity of glass fragments on the ground outside the house, and from the angle of the picture/video you might not be seeing an equivalent amount of glass also on the inside of the door.

I believe kidnapping is only a federal offense if it crosses state lines, involves something that crosses state lines( telephones for example) or demand for a ransom. None of which seem to apply here.

Since there is no mention of Nancy being there I presume she was in DC. So no federal kidnapping charges should apply. There might be other charges that could apply but federal kidnapping charges are not among them.

I read the FBI affidavit- and to put it quite simple:
I do not believe a single word of it. The initial reports don’t come close to the new narrative- and we have to believe that there was NO SECURITY at the house at all, not even an active alarm system. Totally not believable.

I’ve seen pics of the broken glass on the door DePape supposedly entered through. Every liberal rag in the world- well, if you break glass from one side some ends up on that side. Well, some, not all or most, and the photo looks like all or most.

Perp could very we’ll have let Pelosi call 911, or was tricked, or simply lost focus, allowing a chance to call. A determined and SANE kidnapper wouldn’t have allowed it, but with a lunatic, all bets are off.
The attack seems to have been more of a meandering, aimless, but still dangerous, lunacy, not a mad, ferocious bludgeoning, which it could have become, had not the cops intervened.
Living in a safe city where no alarm is needed, the unthinkable happens. An intruder quietly breaks the glass in the back door of Pelosi’s home without waking anyone up. He then goes upstairs where he finds Mr Pelosi in bed. The intruder starts asking about his wife and quick-thinking Pelosi realizes this must be a bad guy and says, “I have to use the bathroom.”
Anybody gullible enough to believe the intruder gave Paul Pelosi a ‘time out’ to use the bathroom is pretty gullible. Anyway, to continue the story, Paul always charges his phone in the bathroom next to the commode and, genius that he is, Paul makes a 911 call—speaking in a secret code which the 911 operator is totally familiar with.
A couple of minutes later, someone knocks at the front door, which is downstairs. And so, holding a hammer, they both go downstairs together to see who it is. Upon seeing the police, the intruder gets angry and hits Paul in his great big fat oversized head.
This will now be the hottest news from now until election day.

Nope, he was not clad in underwear, at least according to the affadavit. In paragraph 11, it mentions pockets. If we believe at least that part of the affadavit, DePape was wearing shorts. Based on my observations of derelicts in Seattle (where I lived) and Portland (where I travel every 4 or 5 weeks for errands), those would be surfer-style board shorts that I’ve seen on plenty of derelicts.
I think there are gaping holes in the affadavit. Cannot say for sure what’s true. On the underwear front, release of surveillance and police bodycam vids and snaps would at least clear that one up, along with the weird interaction at the front door. In the meantime, people should back away from the “tighty whities” line.
A tidbit: It so happens that I charge my phone in one of the bathrooms in our house. Not for any weird reason. We are terrible housekeepers, and that’s the least messy place.

If the police were on the way so quickly how was there time for the scenario as outlined in the same statement have time to play out?
Witness one was working private security, saw a man dressed all in black (NEW DETAIL! Never before revealed!) walking near the Pelosi residence. And therefore- near where he was working a private security detail. And HE didn’t call 911? Huh? Just sat there like a lump and did nothing?

We all know the FBI has serious credibility issues these days, why would they assign basically a junior agent ( 3 years of experience) to head up one of the highest profile cases in the region involving the most high profile residents.
If it is a fed case we won’t see the evidence as federal cases are not given the same media access as a state or local case. My gut tells me he gets some type of plea deal and the case is never presented and the evidence never sees the light of day.
He serves his time and gets deported back to Canada in 20 years or so.

I think this is even easier than the plea deal: get a competency hearing where he says a few very nutty things, the judge declares him incompetent, and he disappears into an institution. Unlike the plea deal, he doesn’t have to agree to anything.
Note they won’t let you interview people that are criminally insane very often. Not nearly as often as they let you interview criminals locked up for 20 years. So there becomes no way for him to fess up until much later.

David DePape was not clad in underwear. He was wearing surfer-style board shorts. So says the affadavit, in paragraph 11: “Officers removed a cell phone, cash, clipper cards, and an unidentified card from DEPAPE’s right shorts pocket.”
I have no way of knowing who here has any interactions with the homeless. I have had some, in Seattle where I lived, and in Portland, where I have to go every 4 or 5 weeks. It’s fairly common to see these derelicts in shorts, even in chilly weather.
Why does it matter? Because the whole “tighty whiteys” commentary is being used to infer a sexual interaction between DePape and Pelosi, either as lovers or as a hired escort, which further implies that they have known each other and therefore the “strange intruder” claim is a lie.
For all we know, they did know each other, and the affadavit is made up out of whole cloth. Cameras outside the house and on the police officers’ bodies might clear this up, but for the moment, the affadavit does NOT support the widely-spread underwear element. This is one of many reasons why authorities should release camera data.
There are all kinds of questions surrounding what’s in that sloppy, contradictory affadavit. I suspect that the leaks over the weekend about underwear came from a mistaken reading or interpretation of DePape’s wearing “shorts,” the miostake being overlooking that the shorts had pockets.
This would seem like a trivial detail, and on the surface it is. But the implications are not trivial. At the very least, people here ought to take note of it and suspend the “tighty whities” speculation pending something more definitive.
Trust me, I am not in any way blessing that affadavit as a whole, or even the shorts-with=pockets part. Still, it ought to be taken into account.
p.s. The affadavit doesn’t say surfer-style board shorts. That’s my assumption, based on never once having seen a bum wearing shorts in anything other than those. If derelicts like DePape wear tennis shorts or swim shorts with pockets, I have not seen it — ever.
It’s unlikely that DePape would have, or maybe even could have, carried all those items in his underwear.
Anyway. DePape is probably a deranged lunatic, a criminal, a drug addict, and possibly unemployed, but he was NOT homeless.
He was living in a school bus parked in the driveway of a house in Berkeley. The sloppy affadavit placed him in Richmond, which is 6 miles away. In any case, how did he travel to San Francisco? I think it’s safe to assume that he didn’t take that school bus.
I think he lived in the garage, not entirely sure. Still, living in a bus at a property he has access to is unconventional, but not homeless, IMHO.
Technically, the affidavit doesnt say he was wearing the shorts. The shorts could have been on the premises. He could have stripped down, the shorts could have been strewn. Without the camera evidence, no one knows.
Something else just occurred to me. If the affadavit isn’t a complete bullshit story, DePape was wearing either the board-style shorts my other comments mentioned, or black cargo shorts. I’ve seen cargo shorts on derelicts too.
We will never know the truth because the Assistant US Attorneys are either incompetent, corrupt, unethical, or all three. I have yet to meet a AUSA who was actually intelligent. They are sociopaths and narcissists. The worst attorneys I’ve ever met.
