Jean-Pierre: Biden EO ‘Paves the Way for Medicaid to Pay for Abortions’
Our taxes fund Medicaid, which is not allowed to be used to cover abortion except in the case of rape, incest, or the mother’s life is in danger.
Our devout Catholic president is doing everything he can to ensure women access abortion, including using taxpayer-funded Medicaid. He signed Executive Order 14076: Protecting Access to Reproductive Healthcare Services.
States have banned abortion or are on the way to banning abortion. Other states have gone all in and keep abortion legal.
Even if it means violating the Hyde Amendment, which bans using federal funds for abortion unless the mother’s life is in danger or the case of rape or incest.
The EO doesn’t cover the travel expenses to get the abortion. It covers the abortion.
Medicaid definition: “Medicaid is a joint federal and state program that provides free or low-cost health coverage to millions of Americans, including some low-income people, families and children, pregnant women, the elderly, and people with disabilities. The federal government provides a portion of the funding for Medicaid and sets guidelines for the program. Medicaid programs vary from state to state.”
In Biden’s EO: “Sec. 3. Advancing the Ability to Obtain Reproductive Healthcare Services. In furtherance of the policy set forth in section 1 of this order, the Secretary of HHS shall consider actions to advance access to reproductive healthcare services, including, to the extent permitted by Federal law, through Medicaid for patients traveling across State lines for medical care.”
I have a horrible headache, but it got worse reading the lies spilled across the page to justify using taxpayer money to pay for baby murder:
There have been numerous reports of women denied health- and life-saving emergency care, as providers fearful of legal reprisal delay necessary treatment for patients until their conditions worsen to dangerous levels. There are also reports of women of reproductive age being denied prescription medication at pharmacies — including medication that is used to treat stomach ulcers, lupus, arthritis, and cancer — due to concerns that these medications, some of which can be used in medication abortions, could be used to terminate a pregnancy. Reportedly, a healthcare provider, citing a State law restricting abortion, even temporarily stopped providing emergency contraception.
The people who do this are stupid because state laws do not require them to do any of this. They “fear” legal blowback. Give me a break. It’s just as bad as making women who had miscarriages think they aborted their baby.
Anyway, no shame in this administration. Press Secretary Karine Jean-Pierre didn’t even try to sugarcoat it:
JEAN-PIERRE: “Look, I mean just to — it’s really important what this is going to do. It’s going to help, in particular, low-income women. If you think about it, paves the way for Medicaid to pay for abortions for women having to travel out of state. Secretary Becerra will invite states to apply for Medicaid waivers to allow them to provide reproductive health care to women who live in states where abortions are banned, those he judged to be the strongest and most effective on both legal and policy grounds. That’s what the President is doing, he’s reviewing the options that he has.”
You guys, it’s so important that this EO will allow using taxpayer money to pay for abortions.

Pregnancy is generally powerful proof of good reproductive health for a woman. Elective abortions are not health care for a woman anymore than penis enlargement surgery is health care for men.
Studies have shown that Black women experience induced abortions at a rate 4x more than white women in the U.S. By definition, abortion has a disparate impact on Blacks and therefore, is clearly racist.
As long as these women are aborting the least useful of the population, then the government should pay all costs, including travel, hotel, and abortion expenses. Throw in meals and that’s a bargain.

Quite frankly, I believe Sanger was wrong. But only from the perspective that she decided that certain races or ethnicities were not worthy. Especially when her “Planned Parenthood” offspring set up shop in low income, mostly black, neighborhoods.
I find it hard to have any concern for anyone who makes their own decision to seek abortions. I do have a concern when the effort becomes genocide.
My preference would be that women not use abortion as a form of birth control.

Nothing is wrong and as of yesterday Scott is starting to feel what I am sure will be a growing backlash.
To the point you inferred, one issue they have is people like Lindsay and Scott have come out with good “lines” and “act the part” of conservatives. (Basically they lied or misrepresented themselves which is not new in politics)
They were able to get away with it in the past because the left was not so rabid and they could “hide” it. They were able to hide in that “grey zone”.
The BIG problem with uprooting them is getting well financed and capable people to run against them.
One of the best we ever had was DeMint but he was just lucky and was basically a regular guy. He didn’t have the money.
Don’t expect the RNC/GOPe to help anyone unseat “their” candidate.

Kabuki theater d/prog style. It’s red meat to their base that an honest trial court will stop because federal funds can’t be used for abortion as a general rule. Red meat to a base that may work out for an election 3 months away – especially after the Kansas result. It looks like the Republicans peaked in July in the generic ballot, as gas prices fall and the broad impact of the Dobbs decision, particularly the secondary and tertiary effects, begins to sink in.
I wouldn’t go that far. The problem in Kansas was the ambiguous wording. Because it left room for interpretation the d/prog pro abortion team used that opportunity to project all sorts of bad things into that space. The d/prog are smart, sometimes the r shoot themselves in the foot and sometimes intentionally….
The takeaways from Kansas, IMO, are:
1. If on the ballot or legislation the wording must be precise and without ambiguity.
2. If not the pro abortion team will capitalize on that to project bad things into that ambiguity.
3. When given a choice voters will not blindly support legislation or vote for constitutional amendment that contains ‘slippery’ imprecise wording that might deliver something they don’t want.
4. Voters have stopped trusting the political class at all to do the right thing with the power and authority granted to them; see Covid emergency, Trans and CRT in schools, budgetary gimmicks and so on
Nationally there might be a small galvanizing around pro abortion team when that is directly on the ballot. In most places it won’t be. The midterms will be an economic/pocketbook election. For the future abortion is unlikely to be THE issue until the bigger issues are solved. IOW, abortion is a rich, 1st world issue and until we are back to enjoying a rich 1st world experience it will remain far down the list of most voters priorities.

Or are you saying that she was correct, but that doing so would somehow manage not to violate the law?

Sure it does, the Hyde amendment precludes federal funds, in particular Medicaid, being used for abortion services. It’s part of the authorization for use of the pool of funds. The executive can’t get around that with an EO.
The Biden Administration has been pushing the envelope with, essentially, ruling by fiat, through EOs, and the like. There was a recent case where a District Court vacated a Biden Admin “emergency” COVID-19 rule that had bypassed the APA. This was seen by Democrats as the equivalent of a nationwide injunction. Except that it wasn’t, and instead just vacated the rule. There is a guest writer at Volokh talking about nationwide vacatur, and while it is proper for APA violations. He argues that the rule was void ab initio, so there is no valid remedy except vacatur.
I think that the same thing is applicable here. Congress has mandated that federal funds not be spent on elective abortions, through the Hyde Amendment. Congress allocates how money is to be spent, and the President does not have the legal power to override this (remember Nixon getting slapped down for Sequestration?) The Executive Branch can, of course, make funding decisions where Congress left them the discretion to do so. That wasn’t the case. The Executive Branch was left no discretion here, and thus Biden’s EO is likely ultra vires and void ab initio.
Hyde Amendment Codification Act – Prohibits the expenditure for any abortion of funds authorized or appropriated by federal law or funds in any trust fund to which funds are authorized or appropriated by federal law .
Prohibits the use of federal funds for any health benefits coverage that includes abortion. (Currently, federal funds cannot be used for abortion services, and plans receiving federal funds must keep them segregated from any funds for abortion services.)
Excludes from such prohibitions an abortion if: (1) the pregnancy is the result of rape or incest; or (2) the woman suffers from a physical disorder, injury, or illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would place her in danger of death unless an abortion is performed, as certified by a physician.
They must be looking for a fight, and this will get them one. People object to using tax money to pay for other people’s entertainment, much less wholly optional killing of a baby. They’re very clear that this is a bright line.
I am pro-choice, but I agree that people should not be forced to fund acts they consider to be murder. The Democrat Party at the national level is well aware of this sentiment, and I view this as a cynical ploy to pick a fight for the purpose of fund-raising. It is similar to the attempt to legalize infanticide that immediately proceeded the overturn of Roe v. Wade.
The push to legalize infanticide may have been the last straw for the conservatives at SCOTUS: they and their liberal friends may have realized that some people will never lose their appetite for fighting over the issue of abortion.
Hey, it’s an “investment” with a great rate of return. Spend a few Medicaid bucks on abortion and get thousands of dollars for selling baby body parts.
Maybe Bill Gates can get in on some of that action. After all, it’s right up his alley, being a eugenicist and all. He loves a good rate of return on investments.

I’m sure things like that have happened somewhere. Doctors, hospitals and pharmacists are not used to running legal risks, except perhaps with opioids. Some state laws could be construed broadly, especially with regard to aiding and abetting. In virtually all states, state law is enforced by locally elected prosecutors, and some of these guys are overly ambitious and are looking for new precedents. When the law is in rapid flux it is natural that some people will be overly cautious.
