Media Beclowns Itself Over Trump Jobs Report Tweet
Oddly, they didn’t seem nearly as interested in the stellar jobs report itself
The leftstream media went into full meltdown mode Friday after President Trump tweeted that he was looking forward to the jobs report.
With the speed of the ace reporters of yore leaping into action when an actual story breaks, they all leaped to their keyboards and tapped out stories about how Trump “broke protocol,” may have broken a federal rule, may be guilty of insider trading or “worse,” was “indiscreet with confidential information,” and on. And on.

Trump gets the jobs numbers the night before their release. If he’s tweeting about them before their release, it’s not far-fetched to imagine him telling an investor friend in advance.

The main complaint appears to be that the president “broke protocol” in his tweet. Protocol, however, is not law, and in this case, it’s nothing more than a policy directive.
[A] 1985 Office of Management and Budget policy directive published in the Federal Register during the administration of President Ronald Reagan outlined an updated procedure to ensure that the jobs report and other significant federal economic indicators would not be released prematurely.
“All employees of the Executive Branch who receive prerelease distribution of information and data estimates … are responsible for assuring that there is no release prior to the official release time,” the directive said.
“Except for members of the staff of the agency issuing the principal economic indicator who have been designated by the agency head to provide technical explanations of the data, employees of the Executive Branch shall not comment publicly on the data until at least one hour after the official release time,” the directive added.
The question appears to be whether or not this restriction applies to the president, and if it does, if he did reveal anything that violates it (like the actual numbers).
USA Today continues:
Jacob Frenkel, a former SEC enforcement attorney, said protocol, practice and tradition, no matter how long in existence, “are not laws or regulations.”
As the nation’s chief executive, the president has the right to disseminate information as he sees fit, said Frenkel, who added: “He did not break or violate any securities laws and acted entirely within his discretion.”
However, Jason Furman, who chaired the Council of Economic Advisers during President Barack Obama’s second term, told The New York Times via email in March 2017: “The interpretation of our administration (like Clinton and Bush) was that this applied to POTUS” (President of the United States). “There were times they wanted Obama to comment, his flight or whatever was taking off at 9:20 and they would hold off until 9:30 so he could comment then.”
Interestingly, CNN’s John King dared anyone to locate evidence of any president since Reagan who breached this protocol. The GOP accepted the dare.
Today the media hyperventilated when @realDonaldTrump teased the monthly Jobs Report.

They don’t seem to understand that Trump can release the jobs report anytime he wishes. It is not like certain MSM don’t already seem to have the story written. AP in particular under the Obama administration. Speaking of which, a blast from the past:

Each time, we should be asking the question, “But do they know it? Is there any hope of the current “news” media ever learning something like professionalism?”

“Meltdown” is an exaggeration, but criticism was warranted. He had a couple of better options available.
1. Move the cup to his left hand before returning the salute. This would be the better way.
2. Don’t return the salute at all; if desired, acknowledge with a nod or a word or two. He,still would have been criticized, but with less substance.
A salute is a sign of respect. That image showed disrespect for the people in uniform.
There’s a story I heard out of Boot Camp, not sure if it’s anecdotal or really happened, but..
A Drill Instructor walks up on a 2d LT ordering a Private to render 50 proper salutes. He takes the LT aside and asks what’s going on. LT explains the Private failed to salute him in passing. DI “gently’ reminds the LT that the Duty the Private has to salute offers is the same Duty the LT has to return that salute.
LT is now standing before that Private returning the 50 salutes he ordered.
The President is the Commander in Chief. As such, he has a duty to learn how to render a proper salute (see John Kerry on how NOT to) and to swap his damn coffee cup to his offhand and return salutes from subordinate troops. It signifies many things, but if you are civillian, think of it as a reminder that no one is above the Rule of Law. Not even the CINC.

The president has no legal duty to return servicemen’s salutes. But it’s common manners to do so. But if he doesn’t want to, fine. Saluting with the coffee cup is a bigger insult than not saluting at all. It shows he doesn’t give a ****.

The insanity gripping the anti-Trump media is astounding.
First, the “insider trading” analogy is total garbage. Insider trading is when a person uses information which is not made public to engage in stock transactions which benefit that person and do not benefit other stock holders. In this case Trump made the knowledge public and, as no stock or other valuable commodities are involved, he did not use that knowledge for personal gain at the expense of others.
Second, the “violating protocol” argument is superfluous BS as well. While many previous Presidents MAY have waited for an official release date on reports generated by executive departments, it has been traditional for these highlights of such reports to be “leaked” by low level bureaucrats to the media. Here the Prez gave us the preview of coming attractions personally.
Third, the claim that Trump violated “regulations” is totally bogus. Trump, being the head of the Executive Branch is the one responsible for enacting the regulations governing the performance of members of his branch of government. This means he can ignore any regulations not mandated by federal law or other act of Congress and can authorize anyone in his branch of government to speak, publicly, on any subject he desires. He acted well within the bounds of his authority.
What tees off the media is:
1) the jobs report is hugely favorable to Trump and
2) Trump released this information directly to the public, thereby denying the media the ability to look clever by claiming to have ferreted out “hidden” information.
In other words, Trump made them look bad. And THAT is what really frosts their cookies.
Hang on a sec. The president cannot ignore regulations. Regulations have the force of law, and bind everyone, including the president. But nobody’s even alleging that this broke any kind of regulation. The farthest anyone’s gone is a directive by President Reagan, which of course is not a law, and which Trump is free to ignore. Not that he did so, but he could.
Nor is he the first president to do so.
No, regulations ONLY have the force of law IF they are enacted at the direction of a law or other act of Congress OR an act of Congress provides a criminal penalty for a specific regulation. In this case, my statement was: “Trump, being the head of the Executive Branch is the one responsible for enacting the regulations governing the performance of members of his branch of government. This means he can ignore any regulations not mandated by federal law or other act of Congress and can authorize anyone in his branch of government to speak, publicly, on any subject he desires.” Notice the phrase “… regulations governing the performance of members of his branch of government…” and “This means that he can ignore any regulations not mandated by federal law or another act of Congress…”.
All departments within the US Government can establish regulations, which control employee behavior. Unless there is an act of Congress which makes violating a specific regulation a criminal offense, then there is NO violation of law for violating that regulation. The Executive branch can establish a regulation which makes it an offense, punishable by administrative action including dismissal, to commit an action without authorization from superiors.
I don’t think those are regulations. They’re orders, directives, procedures, instructions.
Regulations, as far as I know, are only those that implement Congress has authorized the executive to make, in order to implement a law it has passed. Therefore there’s a procedure for making them and for changing them, and the president is bound by them.
No, policy which regulates the behavior of employees are regulations. They are internal regulations and do not subject violators to criminal action, unless such action is authorized by law or a Congressional act.
What you are doing is conflating regulations which govern the internal working of an agency and its power to regulate the actions of those not within the agency. Both are regulations, but only the latter requires congressional authority.
As to the President being bound by internal regulations, this is only true if those regulations are specifically set by Congress. If the Chief Executive is authorized to create such regulation for his underlings, then he can do pretty much whatever he wants, in that regard.
We seem to be in complete agreement about the substance so there’s no point in arguing about terminology.
