Trump Justice Department Sues California Over “Sanctuary State” Status

California’s politicians who have been waging a War on President Trump now face a lawsuit from the Department of Justice over its new status as a “Sanctuary State“.

The Trump Justice Department filed a lawsuit Tuesday night against California, saying three recently-passed state laws were deliberately interfering with federal immigration policies.


It marked the latest legal and political confrontation with the nation’s most populous state, which the federal government says has repeatedly stood in the way of its plans to step up enforcement actions in the workplace and against criminal aliens.

“The Department of Justice and the Trump Administration are going to fight these unjust, unfair, and unconstitutional policies,” Attorney General Jeff Sessions was expected to tell California law enforcement officers on Wednesday. “We are fighting to make your jobs safer and to help you reduce crime in America.”

The Justice Department will allege that the California laws intentionally obstruct enforcement of federal immigration law and harm public safety.

The Justice Department will ask a federal judge to block the California laws, which restrict how state businesses and law enforcement agencies can cooperate with immigration authorities. Attorney General Jeff Sessions is to address the lawsuit in a speech Wednesday at the California Peace Officers Association’s 26th Annual Law Enforcement Day, saying, in part: “We are fighting to make your jobs safer and to help you reduce crime in America. And I believe we are going to win,” according to an excerpt of his prepared remarks.

Sessions has a reason to feel confident. A judge recently ruled that the Justice Department did not have to immediately dole out grant money to the Golden State that has been withheld over concerns over the “Sanctuary State” rules.

The amount of money at issue — $1 million — was relatively small and was at this point only delayed, not denied, U.S. District Judge William Orrick said. While he rejected the state’s request for a preliminary injunction to turn over the money, he also rejected a request by the U.S. Department of Justice to dismiss California’s lawsuit.

The judge said the suit raised “weighty and novel constitutional issues” that would benefit from additional argument.

Meanwhile, Governor Jerry Brown is handling the situation with as much dignity and decorum as we would expect:

    Why sue them in left-coast federal courts that consistently violate the constitution and re-write the laws to favor left-democrats? They are setting us up for frustration and defeat.

    Arrest the Oakland mayor, the San Francisco mayor and city council and a few others. And have them tried in Texas or in Sheriff Joe’s county in Arizona, where we have a chance at justice being served… and we can watch the talking heads explode. 🙂

California cheered when SCOTUS struck down AZ’s attempts to make immigration laws. I wonder if they’ll be just as thrilled when SCOTUS strikes down theirs?

Sessions should have also indicted the Oakland mayor for obstruction – the hell with making her a leftist hero (she already is.)

If Sessions finally gets around to investigating hillary klinton and/or obama, it’ll be perceived as revenge for California’s intransigence.

Waiting sometimes works but in Sessions’ case, it has proven toxic. We need a fresh face in wholly corrupted Department of Justice.

    This ‘lawsuit’ reminds one of Squeaker boehner’s ‘lawsuit’ against obama.

    Even if the Supreme Court rules in Justice’s favor (in ten years from now – thanks, Mr. Magoo), the loons of California won’t enforce it.

i had been waiting quite awhile to see if Jeff S was actually trying to get anything done or was just happy to be in a job that he has coveted for a LONG time.

AG Sessions represents we, the people, to defend and protect the Constitution. I, initially, was angry hat he wasn’t protecting POTUS. But now, if he is FINALLY awake, I hope that he will do the job he was hired to do.

as far as POTUS goes, he knows how to fight to protect the people of the USA.

I hope that the 9th Circuit does NOT stick it to the people that they, too, are sworn to protect in a Constitutional manner.

BTW Tucker Carlson, Mark Levin, Laura Ingraham are all defender of we, the people and Normative Bible Believers of all faiths (as well as agnostics and moral atheists).

1) Just for giggles, a little earlier today Governor Jerry Brown called the filing of a Federal lawsuit against California over immigration “a declaration of war against California”. That has implications that cannot be pulled back from.

2) The suits are not as portentous as it would be if for say they had filed a suit against a conservative. The courts in the 9th Circuit are more loyal to the Democrat Party than to the law and the Constitution. It will take years to get to the Supreme Court, where John Roberts stands a good chance of deciding that state nullification of Federal laws is allowable.

3) If California loses, they will likely openly defy the law and every Democrat in the country will back them.

Democrats do not accept the results of elections. They surely will not accept a ruling by a judge they disagree with. Which means that the next step is force.

    Probably not. But it’ll go to the Ninth Circuit first, which means it’s a toss-up. The Ninth has upheld many of California’s most egregious civil rights violations — especially regarding Second Amendment cases — and SCOTUS has had a … we’ll say “mixed history” … of correcting them.

    Call it the “Disneyland solution”. When Disneyland admits too many guests and is severely over-capacity, they don’t forcibly kick people out. Instead, they start shutting down attractions “for repair or maintenance”, and people leave on their own.

    So turn off the federal aid (of which they consume more than they provide, so it’s a win-win for the Union), pull out all federal workers (including law enforcement, military, and National Guard), and let them become their own little socialist Banana Republic. We’ll see how long they can hold out. 🙂

I’m liking this development. California has been in open defiance/rebellion against the rest of the Union for a while.

But I’d take a different route, myself.

If they don’t want to honor the social contract, fine. Consider it null and void (this is not an exclusive list):
– California no longer has to pay federal taxes.
– California is no longer bound by the ACA and businesses can offer whatever plans they like.
– California is no longer bound by the U.S. Constitution or Bill of Rights (not that that’s mattered much), and can ban any guns they want.
– California is free to stop federal officials from the Trump Administration at the border and deny them entry.
– Ditto for federal agents trying to enforce federal law.

However… (also not an exclusive list):
– California is no longer eligible to receive Medicare or Medicaid subsidies.
– California is no longer eligible for any other federal aid, either.
– California residents wishing to travel to the rest of America must submit to Customs and Border Patrol inspections.
– (My personal favorite) California’s Senators and House Reps can go the @#$% home; if their state will not participate in good faith, then they don’t need to participate at all.

Membership in the Union is a contract, which requires adherence to the U.S. Constitution and carries with it both costs and benefits. Violating the contract might eliminate the costs, but it also eliminates the benefits (doesn’t California consume federal resources far beyond what it provides in federal taxes anyway?). You don’t get to have your cake and eat it, too.

Well I guess this is positive but how long will this take to even see if it is successful and achieves the stated goals?

Sessions needs to mobilize the DHS, ICE etc… A few hundred arrests in a week is not even a drop in the bucket when we just consider the number of illegals in California. That drop probably evaporates before it reaches the bucket when we consider the whole of the USA.

Hit the employers of illegals(not just a token few – Go Big!) and I am still waiting to hear anything about prosecutions for H-1b fraud.

Too little and far too slow.

The way to handle California is the same as the way to handle North Korea. The big weapon is economic. Squeeze until it hurts, then squeeze some more until they’re desperate to make it stop.

This is serious business, and it needs commitment much like a shooting war. But shooting wars are horribly expensive for all parties involved, and even those not involved. Squeezing is much cheaper.

I see why people seem agitated with this Milhouse character. He has nothing of substance to say but proceeds to call people names. It’s like chatting with an elitist atheist, where they lose the argument and begin an inner decay of themselves.

The US needs to issue a travel advisory to anyone going to California. You are much more at risk going there than to Mexico.
